Review of your application revealed it lacking necessary information required for making an informed permit decision. The permit application was deficient in the following areas: • Impact Totals. All the stream impacts were not accounted for in the PCN. The stream table in section C(3) only lists stream impacts resulting from the placement of rip -rap and does not account for the culvert structure itself. Adding in the impacts from the culvert would put stream impacts in excess of 100 linear feet. 0 Additionally, mechanized clearing was counted as a temporary impact in the wetland impact totals listed in the PCN table C(2) and on the plan sheets. Mechanized clearing is considered by DWQ to be a permanent impact. Avoidance and Minimization. DWQ does not feel that the project as proposed avoids and minimizes impacts to the maximum extent practicable. • The hydraulic opening of the system is already reduced by the causeway fill for the current 46 ft. bridge. The proposed 27' -10” x 5' -10" culvert would further restrict the hydraulic opening which would result in increased stream velocities during high flow events. This could result in scouring of the stream bed and banks. • The extensive placement of rip -rap upstream and downstream of the proposed culvert accounts for the majority of the stream, buffer, and wetland impacts. Please discuss what could be done to minimize impacts on this project to the maximum extent possible. Include in your response design alternatives such as bridging and other culvert options. You have 21 days to respond in writing with the requested information or notification to this office that the information is forthcoming. If, at the end of the 21 days, this office has not received this information in writing, we will assume you are withdrawing your application and it will be returned. Furthermore, until the information is received by the NC Division of Water Quality, we request (by copy of this letter) that the US Army Corps of Engineers place the permit application on hold.
