Fifth Street Washington, NC 27889 Dear Mr. Pelletier, This letter is with reference to SAW- 2012 -01410, Billy Roughton, Kitty Hawk, North Carolina and the letter from Mr. Tom Steffens of January 15, 2013. Comments have been referred from National Marine Fisheries (NMF) and the U.S. Fish and Wildlife Service ( USFWS). This correspondence is intended to propose a resolution to the comments. The NMF and USFWS have requested a further avoidance and minimization of the proposed impacts. The original submittal anticipated impacts to +/- 1.78 acres of wetlands. Based on our preliminary consultation, the Project Engineer was able to reduce the impacts to 1.5 acres by designing cantilever bulkheading and pre- treatment wastewater system; thus, reducing the area of impacts. NMF has recommended that Storage Building 5D and associated parking be eliminated. The elimination of this structure and parking will reduce the impacts by 0.1 acres. However, the drive aisle, parking, and the northern half of Building 5C are also impacted by the elimination of Building 5D. The result is the additional reduction of wetland impacts to 0.17 acres. Therefore, we now propose impacts of 1.33 acres associated with the revised project. Enclosed is the plat depicting the revised plan. The applicant has agreed to place the remaining wetlands on the site under a permanent, protective instrument upon receipt of approvals to construct the plan as proposed. USFWS requested a compensatory mitigation ratio of 2:1, and I have enclosed a Commitment Letter from The Great Dismal Swamp Restoration Bank for that level of mitigation. Once permitted, the Commitment Letter will be translated into an obligation for the amount of wetlands impacted and to be mitigated at a 2:1 ratio. This correspondence will attempt to address the request for additional information of January 11, 2013. This office believes that the proposed buildings can be moved or reconfigured to minimize the impacts to the wetlands. The original proposal was reduced through a combination of design of the retaining walls to be cantilevered and the use of pre- treatment systems for sewage disposal. These revisions reduced the impacts from 1.78 acres to 1.5 acres. In consultation with the U.S. Army Corps of Engineers and National Marine Fisheries, it was requested that Building 5D and associated parking be removed from the plan. This would result in a further reduction by .10 acres. However, by removing Building 5D, that resulted in the necessity to reduce Building 5C and associated parking because the drive aisle to the northern half of 5C was eliminated. Therefore, the revision resulted in a reduction of impacts 0.17 acres. Thus, the impacts have been reduced from 1.78 acres to 1.33 acres. The attached plan reflects this revision. 2. Plan drawings do not sufficiently show adjoining properties and wetland boundaries that extend off the subject site. The highway right -of -way is not clearly indicated on plan drawings to show alternative entrances into the property that may avoid wetland impacts. If access to the highway is restricted, provide documentation from DOT stating imposed highway access restrictions. We are unable to access the adjoining properties for analysis (trespassing laws, etc.); however, an analysis of the wetland areas proposed to be impacted suggests that the pockets are contained entirely on the site or at the upper reaches of any wetland body. The plan does not result in isolation of unimpacted wetlands and thus the anticipated total impacts are the same as the request for fill. A review of public records shows that a delineation was performed on adjacent properties owned by North Carolina Power. A copy of that delineation is provided. The access to the property from US 158 must be within the boundaries of the property that adjoins the NCDOT right -of -ways. The current plan anticipates utilizing the central wetland pocket for development so relocation of the drive will not reduce impacts to this pocket. 3. Plan drawings do not show stormwater management and treatment for this site. Calfee Engineering is the Project Engineer, and Mr. Calfee agrees that a Stormwater Management Plan will be required for the project; however, until the project is accepted, it is hoped the Division would accept acknowledgement that stormwater regulations must be met and a certification of design will be prepared, submitted and subject to approval. Provide documentation from an appropriate mitigation bank or the NCEEP indicating their willingness to accept your request to purchase non- riparian wetland credits to mitigate for the proposed wetland impacts listed in your application. Mitigation provider selection must conform to the requirements of G.S. 143-214.11. The letter provided from The Great Dismal Swamp Restoration Bank, LLC is a price quote not a credit reservation letter. Also, the letter expired on November 30, 2012.
