Director Division of Vb'ater Quality June 5, 2007 DWQ Project # 07 0687 Carteret County CERTIFIED MAIL: 7006 0810 0004 4480 9193 RETURN RECEIPT REQUESTED James Maxwell & HG Maxwell 971 Millers Chapel Rd Goldsboro, NC 27534 Subject Property: Harker's Point Shoreline Stabilization and Habitat Enhancement Project Carteret County REQUEST FOR MORE INFORMATION Dear Messers Maxwell and Maxwell: On April 19, 2007, the Division of Water Quality (DWQ) received your CAMA application dated April 17, 2007 to construct the proposed sills, jetties and maintenance dredge a channel and basin. The Division of Marine Fisheries (DMF) has determined that the proposed project would impact the surrounding Submerged Aquatic Vegetation (SAVs). Because the proposed project would result in significant impacts, this Office has determined that significant uses could be removed or degraded by this project. Therefore unless modifications of the proposal are made to alleviate the concerns of DMF, we will recommend moving towards denial of your application as required by 15A NCAC 2H .0506 and will place this project on hold as incomplete until we receive this additional information. Additional Information Requested: If the project is modified to address the concerns of the Division of Marine Fisheries and there are no other objections, DWQ will have no objection to the project. Please respond within three weeks of the date of this letter by sending this information to me in writing and Ian McMillan of the 401 Oversight/Express Review Permitting Unit. If we do not hear from you within three weeks, we will assume that you no longer want to pursue this project and we will consider the project as withdrawn.
