Box 1065 Dunn, NC 28335 Subject: Lifting of Sewer Line Moratorium City of Dunn — Black River WWTP NPDES Permit NC0043176 Harnett County Dear Mr. Uskiewicz: On July 22, 2004 a moratorium on the issuance of sewer line permits was placed on the City of Dunn per the authority of 15A NCAC 2H .0223, which specifies that prior to exceeding 80% of their hydraulic treatment capacity, facilities must submit an approvable engineering evaluation of their future wastewater needs before permits for sewer line extensions may be issued. The July 22 letter erroneously stated the facility had operated at 100.7% of its treatment capacity during calendar year 2003. The Division had referenced an incorrect treatment design capacity in its original calculations. However, revised calculations that reference the facility's 3.75 MGD capacity still indicate the facility operated at 80.6% of design capacity during 2003, and therefore still falls under the authority of the rule. I have reviewed the City of Dunn's letter of August 2, 2004, requesting to have the sewer moratorium lifted. The information provided in the letter has shown the City has complied with the terms of 15A NCAC 2H .0223(1) through its studies and subsequent actions to address inflow and infiltration within the collection system. In addition to its routine system rehabilitation program through municipal funding, the City has secured grants to fund major collection system rehabilitation, and is seeking funding to finance a planned flow equalization project. Each of these measures should help conserve capacity within the treatment system and increase overall plant efficiency. I encourage the City to maintain an aggressive posture as you face the challenges presented by continued collection system rehabilitation and possible wastewater treatment plant modification. Please be aware that should flow at the wastewater treatment plant exceed the 90% of design capacity threshold, a moratorium could again be imposed as called for in 15A NCAC 2H .0223.
