On March 9, 2021, the Division of Water Resources (Division) received your application requesting a 401 Water Quality
Certification from the Division for the subject project. The Division has determined that your application is incomplete
and cannot be processed. The application is on -hold until all of the following information is received:
1. The Division has not received the application review fee. The application is not complete until the fee is
received. Please ensure the application review fee is paid. [15A NCAC 02H .0502(a)(10)]
2. Does this project have a stormwater management plan (SMP) reviewed and approved under a state stormwater
program or state -approved local government stormwater program such as the water supply watershed
protection program? [15A NCAC 02H .0506(b)(3)]
3. The proposed wetland impacts require mitigation. As there are no wetland credits available in the watershed
from private mitigation banks, the next preferred form of compensatory mitigation is the Division of Mitigations
Services' (DMS) in -lieu fee (ILF) program. You may use the attached form to access the ILF program. Please
provide a letter of approval from DMS or provide an alternative mitigation plan. [15A NCAC 02H .0506(c)]
Pursuant to Title 15A NCAC 02H .0502(e), the applicant shall furnish all of the above requested information for the
proper consideration of the application. Please provide your response by April 23, 2021. If all of the requested
information is not received, the Division will be unable to approve the application and it will be denied as incomplete.
The denial of this project will necessitate reapplication to the Division for approval, including a complete application
package and the appropriate fee.
