PROJECT SUMMARY: The applicant proposes to install a finger pier and boatlift on the south side of the existing access pier, increasing the total slip count from two (2) to three (3) on the Shallotte River. Vonatski May 3, 2021 Page 2 9. PROJECT DESCRIPTION The proposed project is located at 940 Copas Rd SW on the Shallotte River in Shallotte, Brunswick County. The property can be reached by traveling NC HWY 17 south towards South Carolina for 22 miles. Turn left onto NC HWY 17-BUS in Shallotte and continue for 1.8 miles. Take a left onto Village Rd SW and after 0.2 miles, take another left onto Copas Rd SW. Continue 2 miles until the destination is reached at 940 Copas Rd SW on the left. Existing structures on the project site include a single family residence and a private two (2) slip docking facility located on the southeast side of the property. The project site is approximately 0.6 acres and is vegetated primarily with domestic grasses and native trees. According to the application, high ground is elevated approximately 7' above the normal high water (NHW) level, and the shoreline (+/- 96 linear feet) is stabilized by native vegetation. High Marsh Coastal Wetlands within the applicant's riparian corridor include a 16' deep swath of Black Needlerush (Juncus roetnerianus) and Salt Meadow Cordgrass (Spartina patens) that extends from the edge of high ground out to the normal high water mark. The Low Marsh extends an additional 16' waterward of the High Marsh and consists of a dense stand of Smooth Cordgrass (Spartina alterniflora). The applicant's existing docking facility starts on the high ground and extends southeast into the Shallotte River. A 168' x 4' access pier (152' as measured from NHW) leads to a 16' x 12' open platform with a 20' x 10' boathouse (Slip #2) off the south side of the open platform. Immediately waterward of the open platform is a gangway leading down to a 12' x 16' floating dock (Slip #1). Residential properties border the project site to the north and south, Copas Rd SW borders the property to the west, and the Shallotte River runs along the eastern bounds of the property. The width of the Shallotte River measures approximately 340' from the edge of the applicant's marsh to the edge of marsh opposite the project site. The existing docking facility extends approximately 180' into the Shallotte River (as measured from the edge of marsh) or approximately 52% of the waterbody width. Based on the current '/4 width rule, the existing docking facility would be considered non- conforming. No permit history can be found for any portion of the existing docking facility but aerial imagery indicates it has been in place since at least 1999. The waters of the Shallotte River are classified SA by the Division of Water Quality and ARE designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries. This portion of the Shallotte River is CLOSED to the harvest of shellfish. Based on visual observations made by DCM staff during the April 2021 site visit, there appears to be NO Submerged Aquatic Vegetation (SAV) in the surrounding waters. Water depths in the vicinity of the proposed boatlift range from approximately -3' to -4.5', relative to NLW. PROPOSED PROJECT The applicant proposes to install a finger pier and boatlift on the south side of the existing access pier, increasing the total slip count from two (2) to three (3) on the Shallotte River. According to the application package, the proposed 25' x 6' finger pier would begin approximately 64' waterward of the NHW mark and extend to the southwest off the existing access pier (see Page #1). The proposed 12' x 12' boatlift would be installed adjacent to the east side of the proposed finger pier. The proposed boatlift would provide dockage for a single vessel (Slip #3). Based on aerial imagery and low tide measurements, the proposed boatlift would be located at the landward edge of the first of two navigable channels within the applicant's riparian corridor (Image #1). Water depths in the location of the proposed boatlift range from -3.0' to -4.5' NLW (See Page #4) and were verified by DCM staff during an April 2021 site visit. The waterward end of the proposed boatlift would extend approximately 66' beyond the applicant's edge of marsh to approximately 19% of the waterbody, meeting the current 'A width rule. As proposed, the finger pier and boatlift would not encroach within the 15- Vonatski May 3, 2021 Page 3 foot riparian setback of either adjacent neighbor and no setback waivers were obtained. 10. ANTICIPATED IMPACTS The proposed boatlift and finger pier would incorporate approximately 294 sq. ft. of Estuarine Waters and Pubic Trust Area. Water depths in the vicinity of the proposed project range from -3.0' to -4.5' NLW. The applicant has proposed to install an auto stop and limit switch on the boatlift to reduce substrate impacts during periods of below -average low water depths. All proposed structures would remain consistent with the pier head length of the adjacent neighbor to the south, be located landward of the channel, and not exceed the 1/4 width of the waterbody. No expansion of the existing non -conforming docking facility is proposed. The boatlift and finger pier would be located outside of both riparian setbacks. Minor increases in turbidity should be expected during piling installation.
