Permit No. NC0026921 Parkton WWTP Robeson County Alderman Al McMillan Alf Parnell Robin Hill Benton Finley Fran Meinert Findings of BOD Exceeded: The day of the exceeded limit the DO had been going up and the clarity of the water had been poor has well. Since this problem occurred, we had timers installed to help control the DO level. We also cleaned out the sample bottle and changed out tubing. Findings of NH 3 Exceeded: This occurred during the same time the BOD exceeded. We have not had a problem with NH 3 since the timers have been installed. I would like to add The Town has received a Principal Forgiveness Loan 50 / 50 match. I know the Town is in fault of the exceeded, but this will be another hardship if we have to pay for this. We have already started receiving bills from the engineer firm for payment, which is in the dollar amount of $13,500. Please consider these things during the review. C) - Concentration 11/30/12 24 mg/1 24.88 mg/1 Monthly Average Exceeded Nitrogen, Ammonia Total (as N) - Concentration 11/30/12 9 mg/1 14.55 mg/1 Monthly Average Exceeded A Notice of Violation/Notice of Recommendation for Enforcement (NOV/NRE) is being issued for the noted violation of North Carolina General Statute (G.S.) 143-215.1 and NPDES Permit No. NC0026921. Pursuant to G.S. 143-215.6A, a civil penalty of not more than twenty-five thousand dollars ($25,000.00) may be assessed against any person who violates or fails to act in accordance with the terms, conditions, or requirements of any permit issued pursuant to G.S. 143-215.1. If you wish to provide additional information regarding the noted violation, request technical assistance, or discuss overall compliance please respond in writing within ten (10) days after receipt of this Notice. A review of your response will be considered along with any information provided on the November 2012 Discharge Monitoring Report. If no response is received in this Office within the 10-day period, a civil penalty assessment may be prepared. Remedial actions, if not already implemented, should be taken to correct any problems. The Division of Water Quality may pursue enforcement actions for this and any additional violations. If the violations are of a continuing nature, not related to operation and/or maintenance problems, and you anticipate remedial construction activities, then you may wish to consider applying for a Special Order by Consent.
