Yes — except you can only submit the NOT once the E&SC plan has been closed (it would be helpful to explain in the
comments section that the first E&SC plan was suspended by the second one because you'll be submitting close-out
documents for only the most recent plan in that scenario). It is not the stormwater permit NOT that closes out the E&SC
plan (you are just terminating coverage under the NPDES permit with an NOT). I hope this makes sense!

Thanks for getting back to me so promptly. The entity will remain the same.
The early grading E&SC has not been closed — however, it will be superseded by the new approval.
To clarify my understanding, we will modify the existing COC by uploading the new grading permit— and then both E&SC
plans will be tracked by the same COC. At the end, when we submit the NOT, both E&SC plans will be closed.

Jonathan,
If it's the same site, just submit a Modification for the same COC and keep that one (as long as the same entity stays
responsible for the construction activity as before). You will upload the new E&SC approval. Did the early grading E&SC
plan get closed out already, or does that continue? If the early grading plan got closed out, then be sure to include that
documentation just so the file stays up to date. When it comes time to terminate the COC with a notice of termination,
we'll be looking for documentation that closes out ALL of the E&SC plans, just fyi.

Was hoping to get some feed back on how overlapping COCs are handled by your team and how they need to be
managed on the contractors end.
We opened a permit for Griffith Lakes Early Grading Package [NCG01-2021-1262] a few months ago. The Phase 1
subdivision plans just got approved with nearly the same grading limits & the exact same denuded acreage. Do we need
to open a separate COU If so, can they close the COC for the Early Grading?
