NHP & FWS iPAC systems. Note an updated official species list was requested 3 days ago, but has yet to be generate, but "WII be processed soon".
Based on other species lists in this area, we have conducted a preliminary biological determination for anticipated species. No suitable habitat exists
for aquatic species. Surveys were conducted in May 2021 for sumac in potentially suitable habitat areas and no species were found. Marginally
suitable habitat exists for RCWs, but no cavity trees were found no RCWs are known to exist within several miles of the project area. No suitable ealge
nesting habitat exists within 660' of the project area. As such, the project is not anticipated to effect any federally listed protected species.

Re: Justification Letter for wetland impacts
To whom it may concern,
The proposed project consists of a warehouse and associated parking and truck access. The site
contains wetlands on the northern portion of the property. In order to minimize the impacts to
wetlands on the site, the building and associated drives are located as far south on the property as
possible. The resulting impacts cannot be avoided due to the spatial requirements needed to
facilitate the truck loading areas. The building size and associated loading areas were determined
based on the needs of the future tenant. The loading areas are as small as possible, while still
providing sufficient room for tractor trailer loading/unloading and maneuverability. The provided
parking areas are based on future tenant needs and Town requirements. The fill that impacts the
wetlands is a 3:1 slope, which is the recommended maximum slope to ensure long term stability
and stabilization. A retaining wall was considered and determined not to be a practicable
alternative as it is cost prohibitive and is a safety concern due to the high volume of truck traffic in
close vicinity to the wall.
Regarding stormwater management, all stormwater from the site will be directed to a wet pond,
that will provide stormwater quality and peak flow attenuation per Town of Knightdale and State
requirements.

This document confirms that Wake Stone Property Company (Applicant) for the Hinton Oaks
Industrial Park (East) (Project) has expressed an interest to utilize 0.65 Riparian Wetland Mitigation
Credits from the EBX-Neuse sponsored Neu -Con Wetland & Stream Umbrella Mitigation Bank,
specifically wetland credits from the Arrington Bridge III Site, in the Neuse HUC 03020201. As the
official Bank Sponsor, EBX-Neuse I, LLC, attests to the fact that mitigation is available for reservation at
this time.
These mitigation credits are not considered secured, and consequently are eligible to be used for alternate
purposes by the Bank Sponsor, until payment in full is received from the Applicant resulting in the
issuance of a Mitigation Credit Transfer Certificate by the bank acknowledging that the Applicant has
fully secured credits from the bank and the Banker has accepted full responsibility for the mitigation
obligation requiring the credits/units.
The Banker will issue the Mitigation Credit Transfer Certificate within three (3) days of receipt of the
purchase price. Banker shall provide to Applicant a copy of the Mitigation Credit Transfer Certificate and
a documented copy of the debit of credits from the Bank Official Credit Ledger(s), indicating the permit
number and the resource type secured by the applicant. A copy of the Mitigation Credit Transfer
Certificate, with an updated Official Credit Ledger will also be sent to regulatory agencies showing the
proper documentation.

Instructions to Permittee: The Permittee must provide a copy of this form to the Mitigation Sponsor, either an approved
Mitigation Bank or the North Carolina Ecosystem Enhancement Program (NCEEP), who will then sign the form to verify the
transfer of the mitigation responsibility. Once the Sponsor has signed this form, it is the Permittee's responsibility to

copy of this form before conducting authorized impacts, unless otherwise specified below. If more than one mitigation
Sponsor will be used to provide the mitigation associated with the permit, or if the impacts and/or the mitigation will occur
in more than one 8-digit Hydrologic Unit Code (HUC), multiple forms will be attached to the permit, and the separate forms
for each Sponsor and/or HUC must be provided to the appropriate mitigation Sponsors.
Instructions to Sponsor: The Sponsor must verify that the mitigation requirements shown below are available at the
identified site. By signing below, the Sponsor is accepting full responsibility for the identified mitigation, regardless of
whether or not they have received payment from the Permittee. Once the form is signed, the Sponsor must update the
appropriate ledger and provide a copy of the signed form to the Permittee and to the USACE Bank/In-Lieu Fee Program

Conditions for Transfer of Compensatory Mitigation Credit:
• Once this document has been signed by the Mitigation Sponsor and the USACE is in receipt of the signed form, the
Permittee is no longer responsible for providing the mitigation identified in this form, though the Permittee remains
responsible for any other mitigation requirements stated in the permit conditions.
• Construction within jurisdictional areas authorized by the permit identified on page one of this form can begin only
after the USACE is in receipt of a copy of this document signed by the Sponsor, confirming that the Sponsor has
accepted responsibility for providing the mitigation requirements listed herein. For authorized impacts conducted by
the North Carolina Department of Transportation (NCDOT), construction within jurisdictional areas may proceed upon
permit issuance; however, a copy of this form signed by the Sponsor must be provided to the USACE within 30 days of
permit issuance. NCDOT remains fully responsible for the mitigation until the USACE has received this form, confirming
that the Sponsor has accepted responsibility for providing the mitigation requirements listed herein.
• Signed copies of this document must be retained by the Permittee, Mitigation Sponsor, and in the USACE
administrative records for both the permit and the Bank/ILF Instrument. It is the Permittee's responsibility to ensure
that the USACE Project Manager (address below) is provided with a signed copy of this form.
• If changes are proposed to the type, amount, or location of mitigation after this form has been signed and returned to
the USACE, the Sponsor must obtain case -by -case approval from the USACE Project Manager and/or North Carolina
Interagency Review Team (NCIRT). If approved, higher mitigation ratios may be applied, as per current District
guidance and a new version of this form must be completed and included in the USACE administrative records for both
the permit and the Bank/ILF Instrument.

The North Carolina Natural Heritage Program (NCNHP) appreciates the opportunity to provide
information about natural heritage resources for the project referenced above.
Based on the project area mapped with your request, a query of the NCNHP database indicates that
there are no records for rare species, important natural communities, natural areas, and/or
conservation/managed areas within the proposed project boundary. Please note that although there
may be no documentation of natural heritage elements within the project boundary, it does not
