Dear Mr. Livingston.
On July 23, 2019, staff from the North Carolina Department of Environmental Quality
(NCDEQ) conducted a compliance audit of the Town of Ayden National Pollutant Discharge
Elimination System (NPDES) Municipal Separate Storm Sewer System (MS4) permit. The
audit resulted in the referenced Notice of Violation (NOV) on July 31, 2019, which details
required information submittals and specific deadlines to comply. As of the date of this
notice, the following required actions have not been completed:

The failure to complete each required action constitutes a separate violation of the MS4
permit conditions to furnish information as requested by NCDEQ in order to determine
compliance with the permit [Ref. Part III, Item C and Part V, Section A, Item 7].
The Town of Ayden is hereby recommended for assessment of civil penalties for
ongoing permit violations, which can be assessed at a maximum of $25,000 per day for
each violation and can continue to accrue daily until such time as the required actions
are completed.

This notification is a courtesy and Town of Ayden will receive any and all penalty
