The audit resulted in the referenced Notice of Violation (NOV) on August 13, 2020, which details required information submittals and specific deadlines to comply. As of the date of this notice, the following required actions have not been completed: Required Action/Information Submittal Submittal Due Date Draft SWMP version 2 (per 02/22/21 SWMP vl comment letter from DEQ) 03/24/2021 The failure to complete each required action constitutes a separate violation of the MS4 permit conditions, which require the permittee to furnish information as requested by NCDEQ in order to determine compliance with the permit [Ref. Part III, Item C and Part V, Section A, Item 7]. The Town of Lewisville is hereby recommended for assessment of civil penalties for ongoing permit violations, which can be assessed at a maximum of 25,000 per day for each violation and can continue to accrue daily until such time as the required actions are completed. This notification is a courtesy and Town of Lewisville will receive any and all penalty assessments under separate cover.
