Dear Mr. Nobles:
The Division of Energy, Mineral and Land Resources (DEMLR), received a Stormwater
Management Permit Application for the subject project ohr January 25, 2021. A review of that
information has determined that the application is not complete. The following information is
needed to continue the stormwater review:
NOTE: This project was reviewed under the assumption that it will be a low -density
project. If this changes (either to high -density or mixed density) please let me know as
the comments will change. Low -density projects do not require the use of SCMs to meet
treatment requirements so the proposed infiltration basin was not reviewed for
compliance with the MDCs and will not be included as an enforceable part of the final
permit. The permit will contain language stating that the proposed infiltration basin exists
on -site, but is not associated with/subject to the post -construction permit (I can provide
you with the specific language if you like).
1. Please correct the following items in order to make this into a low -density submission:
a. Section IV,1 of the Application — Please add a note to the project summary stating
that the proposed infiltration basin is not required for compliance with the post -

b. O&M Agreement Form — Please complete and resubmit the latest version of this
form (which can be found at the following link:

of this form contains an option for "low -density" and this option should be

Agreement Form. If you do this, please place a note on the form stating that the
infiltration basin is not required for compliance with the post -construction permit
(Can place it in the "Location(s)" section of the cover page).
Supplement-EZ Form — Like the O&M Agreement Form, there is a newer version
of this form that should be used that includes low -density options (Can be found

i. Cover Page:
1. Line 5 — Please select "Low" for the project density.
2. Line 11 — Since the infiltration system is not needed for the post -
construction permit, this value should be "0".
ii. Drainage Areas Page:
1. Line 1 — This is not a high -density project so the answer should be
«NO
2. Drainage Area 1 Column — This information is not needed.
3. Entire Site Column — Lines 17-19 (Design Storm, Design Volume,
and Calculation Method) are not needed.
iii. Low -Density Page — Please include this page. Each separate vegetated
conveyance should get its own line and the information should match that

d. Deed Restriction Form — Please complete and resubmit the Low -Density
Residential Subdivision Deed Restriction Form (Link to the form:

BUA per lot), please use the second option where the maximum BUA per lot is
listed on a per -lot basis (Since lot 7 has zero square feet of BUA allocated to it).
For example, you can say "Lots 1-6 & 8-14 = 4,500 sf' and "Lot 7 = 0 sf' (Each

2. Please provide a USGS topographic map clearly showing the extent of the project area
(Section VI, 6). NOTE: The maps in the stormwater report exclude lots 1-4 & lots 12-14

3. Please provide time of concentration (Tc) calculations for the proposed vegetated
conveyances so the calculations may be verified (Section VI, 7).

4. Please clearly label the vegetated conveyances (To correspond to the information in the
Supplement-EZ Form) and show the drainage areas to the vegetated conveyances in the

6. The vegetated conveyances must have side slopes that do not exceed 3:1 (15A NCAC
02H .1003(2)(c)(i)). Per the calculations in the stormwater report, the side slope of the
roadside ditch is shown to be 2:1 (0.5 ft/ft).
7. Provide pdfs of all revisions, 2 hardcopies of revised plan sheets, and 1 hardcopy of other
documents.

Please note that this request for additional information is in response to a preliminary review.
The requested information should be received by this Office prior to April 1, 2021, or the
application will be returned as incomplete. The return of a project will necessitate resubmittal
of all required items, including the application fee. Please reference the State assigned project
number SW6210102 on all correspondence.
If you need additional time to submit the information, please submit your request for a time
extension to the Division at the contact below. The request must indicate the date by which you
expect to submit the required information. The Division is allowed 90 days from the receipt of
a completed application to issue the permit.
The construction of any impervious surfaces, other than a construction entrance under an
approved Sedimentation Erosion Control Plan, is a violation of NCGS 143-215.1 and is subject
to enforcement action pursuant to NCGS 143-215.6A.
