Proiect Narrative:
The North Carolina State Ports Authority (NCSPA) is proposing to redevelop a portion of the Port of
Wilmington facility for use as a shipping container storage hardstand. The project is located east of
Industrial Road (shown as Myers Street in the location map below) and west of existing railroad tracks.
The project area has been in continuous use for Shipyard and Port of Wilmington operations since the
1940's, and has been used for a wide range of Port -related functions, including ship building, various
industrial activities, bulk material storage and vehicle parking. Four industrial buildings that were once
located on the project site have been demolished over the years. In some cases, the floor slabs remain.
One building currently remains on the site and is proposed for demolition. Site surface cover over the
decades has included the buildings referenced above, various pavements and slabs, equipment/tank pads,
gravel, rail ballast stone, gravel access roads, miscellaneous material stockpiles and isolated grass/soil
areas.
The project will demolish the existing building, pavements, and remnant floor slabs/foundations, and
construct a new 4.5-acre paved area suitable for storage of loaded and unloaded shipping containers.
Existing drainage patterns will remain substantially as they are today, consisting of sheet flow to an
existing closed pipe system that outfalls to the Cape Fear River under a ship berth approximately 820 feet
from the west edge of the proposed project area. A new shallow drainage swale will be constructed along
the edge of the existing railroad tracks to convey localized storm drainage from the rail line area into the
existing storm drainage system. There are no records of previous State stormwater permits forthe project
site. Based on available information, the project will not result in a net increase in the existing/historic
BUA (i.e., buildings, paved areas, and gravel areas). The project will have equal or better stormwater
controls than those that exist today for the site. The NCSPA is requesting a redevelopment exemption
from the State stormwater rules for this project.

Hi Amy.
Thank you for your phone calls regarding this project. When this project was first broached to us back in September,
we provided the steps needed to gain an exemption under the new State Stormwater rules. (An excerpt from that email
is provided below your Request here.) We received your request to enter the Express Program for this exemption
request on December 5; by that time, the Express program schedule was already full until the date that I believe I have
indicated to you —February 13, 2017-when you have a currently scheduled slot for an Express Review meeting with
Christine Hall.
Your other option is to send in the Exemption Request through the regular SW review process and it will be in the queue
for review based on when the complete request is received. Keep in mind that many staff will be on leave during the
holidays. So it is up to you and your client which avenue you wish to follow. Please let me know what I should do
concerning the currently scheduled Express Review date. I will need to know asap so that I can release it to schedule
another Express review during that time.

In speaking with Cameron Weaver I understand that the Port believes that a project they want to complete on Port
P1 operty is redevelopment and therefore does not need a stormwater permit. If that is true and the Port authorities
want a redevelopment exclusion for DEMLR (which is now called a Exemption under the 2017 rules) then they must
demonstrate to us that it meets the definition of redevelopment.
The definition of Redevelopment per GS 143-214.7 (a1)(2) — Any land disturbing activity that does not result in a net
increase in built -upon area and that provides greater or equal stormwater control to that of the previous development.
In order to demonstrate to us that it is redevelopment we need the following information:
1. A cover letter or narrative requesting the redevelopment exclusion.
a. Describe the existing and proposed project
b. How has the project met the redevelopment exemption requirements (i.e. no previous permits; not
installing more BUA than previously on site, equal or better SW controls installed) Can provide google
images to demonstrate BUA was previously on site etc.
c. Include name, mailing address and phone number of the land owner.
2. Provide two sets of sealed plans that show:
a. The layout of the existing BUA;
b. Existing drainage (i.e. BMPs, swales, pipes, buffer areas)
c. Sufficient existing contours and spot elevations
d. The layout of the proposed BUA, dimensioned
e. The proposed grading plan
f. Any proposed stormwater measures.
3. Calculations of the existing and proposed amount of BUA. These may be incorporated into the narrative if
desired.
4. Current impervious surfaces that are closer than 3C' 10 surface waters and are requesting a redevelopment
exemption can not be any closer to the surface waters with the new redeveloped BUA then what was previously
established.
5. A request for an exemption can be reviewed under the Express or the Standard program. There is no fee under
the Standard program, but the timeline is longer than in Express.
If the information above is insufficient for yoU to submit this package to Express, please let us know and we will schedule
a sccping meeting. Once we receive and review the package and determ`ne that the site is exempt, then you will
receive a written exemption for the area. This should be kept on file to show you are not required to get a stormwater
permit as long as you meet the definition of redevelopment for that area.
Let me know if you have any questions about the requirements to receive an exemption from the storrwater
permitting requirements.

I've talked with Georgette Scott, Stormwater Supervisor for DEC!, about this project. She will be responding directly to
you about the meeting request that Ray sent in on the Port's behalf. Bottom line from State Stormwater's view, based
on what Ray explained to me, is that there needs to be some measure of improvement in Stormwater Controls on the
site in order for Redevelopment to be pursued as a permitting option.
Let me know if there are ways I may assist.
