Salisbury Street Raleigh, NC 27604 May 6, 2021 US Army Corps of Engineers Raleigh Regulatory Office Attn: Ms. Samantha Dailey 3331 Heritage Trade Drive, Suite 105 Wake Forest, NC 27587 Re: Wendell Town Hall SAW-2021-00319 & NCDWR #20210325 v1 Request for NWP 14, GC 4135, and Riparian Buffer Authorization Sage Project #2021.008 On behalf of The Town of Wendell (owner & applicant), please find attached a complete application and supplemental information requesting written concurrence from the US Army Corps of Engineers (USACE) that the activities associated with the proposed Wendell Town Hall (Project) and the proposed impacts associated with the construction of Landing View Drive may proceed using Nationwide Permit (NWP) 14, General Certification 4135 (GC 4135), and Riparian Buffer Authorization. The use of NWP 14 for this Project was discussed with and approved by Ms. Sam Dailey of the USACE. Project Purpose and Location The purpose of the project is to construct a new town hall and connecting roadways for the Town of Wendell. The coordinates of 35.7801°N, 78.3785°W generally correspond to the center of the Site. Project Detail The overall Project consists of the construction of a new town hall facility with associated parking, stormwater control measures, and utility connections. Access to the Project will be provided by proposed connections to existing West Third Street to the north and to Wendell Falls Parkway via Landing View Drive which is currently under construction to the south of the Project. Proposed roadway details for Landing View Drive can be found in the Stone Arbor Construction Drawings. Water and wastewater services will be provided by existing infrastructure located adjacent to the Project. Heavy equipment typically used for utility installation projects (e.g., backhoes, bulldozers, etc.) will be utilized. No federally threatened or endangered species are listed to occur within 1 mile of the Project according to the NC Natural Heritage Program (NHP) Database (see attached report dated January 25, 2021). The southern portion of the Site where the proposed road is planned was determined to be within a 36-acre parcel that has a conservation deed (see attached Deed of Conservation). The conservation deed restricts the construction of buildings and only allows a road within the designated easement shown on the survey map included in the Deed. The impacts related to the proposed road as well as the roadway itself are required to occur within the designated easement shown on the survey map. The Site is not listed as containing a historic property or within a historic district. Based on a query of the GIS files from NCSHPO, multiple houses, structures, properties, landmarks, and historic districts were identified to exist within 0.5 mile of the Site. Most of these areas are to the northeast of the Site within the downtown section of Wendell. Project History A PJD request was submitted to Ms. Samantha Dailey of USACE by Mr. David Gainey of Sage on February 12, 2021. Ms. Dailey responded to the PJD request via e-mail on February 18, 2021 and concurred with the boundaries depicted on Figure 3 - Preliminary Jurisdictional Determination Wetland Sketch Map (dated January Wendell Town Hall Page 2 of 2 22, 2021). A riparian buffer determination site meeting was held on February 23, 2021, with Mr. Josh Brigham of NCDWR and Mr. David Gainey of Sage. A Buffer Determination Letter was issued on February 26, 2021 (NBRRO #21-025). Avoidance and Minimization The proposed town hall facility was planned to avoid impacts to wetlands, streams, and riparian buffers. The proposed roadway connection to Landing View Drive and the restrictions detailed within the Deed of Conservation dictate the alignment of the proposed roadway crossing to the south. The drainage being crossed contains a much broader wetland system upstream and becomes a more defined perennial stream system downstream of the proposed crossing location so impacts could not be completely avoided regardless of where the drainage was crossed. The proposed road crossing was aligned within the “Future Access Corridor 60’ R/W” to minimize impacts to the maximum extent practicable. Construction fencing will be used to define the construction corridor and prevent accidental impacts, while silt fencing will be installed to provide additional protection from runoff. Ground cover will be established immediately after ground disturbance during construction. Project Impacts Proposed permanent wetland impacts total 0.383 ac. (16,665 SF) for roadway construction. Proposed permanent stream impacts total 82 LF (1,003 SF) for a culvert. Temporary stream impacts of 32 LF (393 SF) are proposed for dewatering to construct the road crossing. Permanent riparian buffer impacts total 6,759 SF in Zone 1 and 4,455 SF in Zone 2 for the road crossing. Total proposed riparian buffer impacts are 11,214 sf (0.26 ac.). No other impacts are proposed. All temporarily impacted features will be restored and stabilized with native vegetation. The dewatering device shall utilize impervious dikes and a pump around. The limits of the pump around will be set for what can be completed in a day’s work. At the end of each workday, the work area will be stabilized, the pump around removed, and the flow restored to the channel. Work in the channel will only be completed during forecast periods of dry weather. Mitigation Permanent wetland impacts total 0.383 acre for roadway construction. Therefore, 0.77 wetland mitigation credits will be purchased from the EBX-Neuse I, LLC Wetland Bank. The Statement of Availability is attached. Stream impacts are below 150 LF and riparian buffer impacts are "Allowable Upon Authorization" per the Table of Uses. If you have any questions, please call me at (919) 244-0623. As the official Bank Sponsor, EBX-Neuse I, LLC, attests to the fact that mitigation is available for reservation at this time. These mitigation credits are not considered secured, and consequently are eligible to be used for alternate purposes by the Bank Sponsor, until payment in full is received from the Applicant resulting in the issuance of a Mitigation Credit Transfer Certificate by the bank acknowledging that the Applicant has fully secured credits from the bank and the Banker has accepted full responsibility for the mitigation obligation requiring the credits/units. The Banker will issue the Mitigation Credit Transfer Certificate within three (3) days of receipt of the purchase price. Banker shall provide to Applicant a copy of the Mitigation Credit Transfer Certificate and a documented copy of the debit of credits from the Bank Official Credit Ledger(s), indicating the permit number and the resource type secured by the applicant. A copy of the Mitigation Credit Transfer Certificate, with an updated Official Credit Ledger will also be sent to regulatory agencies showing the proper documentation.
