NOTIFICATION OF INTENT TO CONSTRUCT OR OPERATE INJECTION WELLS
The followil:zg are "permitted by rule" an_d do not require an individual permit when constructed in. accordance
with the rules of 15A NCAC 02C .0200. This form shall be submitted at least 2 weeks p rior to injection.
AQUIFER TEST WELLS OSA NCAC 02C .0220 )
These wells are used to inject uncontaminated fluid into an aquifer to determine aquifer hydraulic characteristics.
IN SITU REMEDIATION OSA NCAC 02C .0225 ) or TRACER WELLS {ISA NCAC 02C .0229):
1) Passive Injection S y stems -In-well delivery systems to diffuse injectants into the subsurface. Examples include
ORC socks, iSOC systems, and other gas infusion methods.
2) Small-Scale Injection O p erations -Injection wells located within a land surface area not to exceed 10,000
square feet for the purpose of soil or groundwater remediation or tracer tests. An individual permit shall be required
for test or treatment areas exceeding 10,000 square feet.
3) Pilot Tests -Preliminary studies conducted for the purpose of evaluating the technical feasibility of a
remediation strategy in order to develop a full scale remediation plan for future implementation, and where the
surface area of the injection zone wells are located within an area that does not exceed five percent of the land
surface above the known extent of groundwater contamination. An individual permit shall be required to conduct
more than one pilot test on any separate groundwater contaminant plume.
4) Air lnj ection Wells -Used to inject ambient air to enhance in-situ treatment of soil or groundwater.

Kevin L. Sink, for himself as the Court Appointed Receiver ("Receiver") of Holly Springs
Quality Food Mart . LLC, hereinafter called nnd referred to as RECEIVER, and Holly Spring
Qualit}' Food Mmi, LLC ("LLC"), in considerntimi of the covenants, promises, and . uuderlakings
hereinafter provided, hereby grants to, Agra Environme11tal,Juc., its contractors, and
subcontractors, and the officers, agents, sei·vants, and employees of any of them(" Agra"); a right
t<> enter upon that plot of real prnpe1ty owned by the .LLC and located at 300 No .. th Main Street,
Holly Springs, North Carolina hereinafter cnUed and referred to as Property, forlhe purpose of
making ce11ain environmental investigations as hereinafter described.
In consideration of this right of entry, Agra cove.mrnts, promises and agrees as folJows :

Agra shall en tel' upon the Pr<>perty only as reasonably necessary to make the subsurface
exploration nnd install groundwater well(s), and to make such excavations, test borings,
and other tests as necessary.
Agra shall disturb the Pro~e11y no mo re than reasonably necessary to ac.complisldhe
aforesaid purposes, and shall restore the site as nearly as practicable to its condition
before its entry, and shall leave the site clean and in good order.
Agra shall have in effect, at its expense, at all times dmfag the coun;e of work on the
LLC'S property, nt lellst the following i11snrance: General Liability Insurance, Bodily
fojmy aild . Property Damage.
Agra shall indemnif)' and save harmless the RECEIVER, the LLC and its officers, agents,
servants, nnd employees from and against any death or injury to tlie person, or damage to
the property, difectly J'esu!ting from or arising out oft.he negligence of Agra, contractor
or sub-contractor eng;iged by Agra, or of any officer, agent, servant, or employee of any
of them, who at the 'ti,ne of such act or omission, is in or upon the Property,
The acce.ss granted herein is expressly conditioned upon the agreement by Agra that the
Receiver, on beha[f of himself and tJ1e LLC, discla.iins all responsibility for any work attd

theory, to assume any liability (or any acts performed by any party in connection with
such access .
The RECElVER and the LLC shaH have the right to fol! use and enjoyment of the
Property except for such use as may unreasonably interfere with tl1e exercise by Agra of
the righis granted by this Right of Entry.
RECEIVER has the right, capacity and ai,thority to grant the Right of Entry on behalf of
himself gr~nted herein.
