SUBJECT: Appeal request to the Town of Cary's No Practical Alternatives determination
The Town of Cary received an after - the -fact application for a No Practical Alternatives
determination (aka Buffer Authorization) in the Jordan watershed from Mr. David Crabtree.
After reviewing the application, on November 7, 2012, the Town of Cary denied the request.
15A NCAC 02B.0267 (11) (e) states "Any appeals of determinations regarding Authorization
Certificates shall be referred to the Director. The Director's decision is subject to review as
provided in G.S. 1508 Articles 3 and 4."
Pursuant to 15A NCAC 02B.0267 (11) (e), Mr. Crabtree appealed the Town's determination.
The Webscape Unit and the Raleigh Regional Office have reviewed the application and have
determined that it does meet the No Practical Alternatives and recommends approving the
application. Attached, please find a Buffer Authorization Certificate for your signature.
