NOTICE OFWITHDRAWAL-EXPRESS REVIEWPROGRAM
On April 16, 2007, the Division of Water Quality (DWQ) received your stormwater management plan
application to comply with the requirements of the 401 Water Quality Certification issued on November
30, 2005 to a project known then as "New Middle. School and High School B, Crane Road, Waxhaw,
NC". On Aprill8, X007, the DWQ requested additional information. No written responses have been
received sirl~e that time.., As.a result of your failure to provide adequate responses within the overa1130-
day timeframe of the- Express Review Program (and the requirement to return information expediently),
we are withdrawing your application from the Express Review Program.
Should you choose to pursue, the Marvin Ridge Middle School & High School Project (formerly known
as New Middle School & High School "B"), you must reapply and resubmit through the regular
-401/Wetlands Program with a modified application, which clearly addresses all issues DWQ identified in
previous correspondence.
Please be-aware that you have no authorization under Section 401 of the Clear Water Act for this
activity and any work done within waters of the state would be a violation of North Carolina
General Statutes and Administrative Code.
