From: Richmond, Martin Sent: Monday, February 04, 2013 3:02 PM To: Williams, Kelly Cc: Strickland, Bev; Higgins, Karen; Merritt, Katie Subject: bailey's landing subdivision Kelly— I've recently had my hands full with the purchase of what was supposed to be Phase III at Bailey's Landing. Then I heard a rumor that the original developers never paid the required mitigation for Phase I? I was able to issue a new letter to the new owner for the back phase (which I think is Phase III). There was already a pipe in the creek, the consultant (Jay Keller) said he thinks there was a pipe there already and the new one replaces on old one. I didn't believe it then and I don't believe it now. This impact— in my opinion —would have pushed them over a possible IP threshold. The site is off Tryon Rd, directly south of Dillard Drive. I think I have the new owners all taken care of, but... The new owner talked about how hard it was to get info from the original owners and their engineer Mike Stewart. In putting this together, it made sense why he could not ever get info from the current owners or their engineers: because they still owe mitigation and want nothing to do with this site. Is there any way we can confirm this payment or non - payment? I want to give everyone the benefit of the doubt, so I will, but if they owe mitigation I would like to know about it. These can be very difficult to deal with, but I'll do what I can to get what we are owed — if we are owed for the impacts currently in place. Thanks much, Martin Katie — do you remember this one being on our list of sites that owe?
