Dear Mr. Price:
On November 26, 2012, the North Carolina Division of Water Quality (Division) received your
request for comments on Jordan Hydroelectric Limited Partnership's propos Water Quality
Report for May — October, 2012 for the Jordan Hydroelectric Project, P- 11437, dated November
21, 2012.
On October 4, 2006, the Division issued Certification No. 3059 to Mr. Jim Price of the Hydro
Matrix Limited Partnership.
• Condition #3 required the following:
Dissolved Oxygen and Temperatures shall be measured from the water
discharged from the project location from May 1 through October 30. Annual
reports of the data shall be forwarded to the Division. If after one year of
monitoring of DO and temperature during operation these levels meet state
Water Quality Standards for these waters, monitoring may be discontinued."
The Division received your report which indicated that you met water quality
standards, however you plan to continue water quality measurements during
the time period specified in your water quality certification. Please continue to
send an Annual Report to this Office at 1650 MSC, Raleigh, NC 27699 -1650.

• Condition # 5 required the following:
Certificate of Completion
Upon completion of the project, the Applicant shall complete and return the
enclosed "Certificate of Completion" form to notify NCDWQ when all work
included in the 401 Water Quality Certification has been complted. The
responsible party shall complete the attached form and return it to the
401 /Wetlands Unit of the NC Division of Water Quality upon completion of the
project."
The Division received this completed form with your report and included it in the
project file.

Karen, I have not received any response or approval from you on the water quality report for 2012 for the
Jordan Hydroelectric Project (attached). I must file a copy of the report with FERC. If you could send an email
stating no objection, that would help. If I do not hear from you by Feb. 1, 1 will file the report with FERC.

Subject: Annual Water Quality Report for Jordan Hydroelectric Project
Attached please find the report on water quality compliance for 2012 for the Jordan Hydroelectric Project at
BE Jordan Dam on the Haw River in Chatham County. This is our first year of operation. There were no
violations of water quality standards during the six months of monitoring. The data, including equipment
malfunctions, are described in the report.
In the amendment order of March 30, 2007 Federal Energy Regulatory Commission ordered us to file a copy of
the annual report with them after the DWQ had 30 days to comment. If DWQ has any comments on the
report, please provide them within 30 days. Email comments are acceptable. If we do not receive any
comments within 30 days, we will assume there are none.
