We purchased a lot of land at 3466 Governor's Island Drive Denver NC 28037 from the Seigel family in 2011. At that
time we called you to confirm that we were grandfathered and could replace the home and the pool within the existing
boundaries of the home that burned down. You had verbally given us the approval but Lincoln County would like to have
a letter from you confirming your determination. Also please see the attached.
Would you please e -mail me a letter so we may proceed with our pool permitting process.

You have our authorization of exemption from the Catawba River Riparian Buffer Rules [15A
NCAC 2H.02431 for the rebuilding of a home and pool at the subject property addressed
above. This exemption applies only to the rebuilding of the home and pool within the exact
footprint of the previous structures, as shown in the attached plat received by DWQ from
you on January 31, 2013. No additional impervious surface can be added without either a
buffer authorization or variance, as applicable. If you change your project, you must notify
us and you may be required to send us a request for buffer authorization or variance.
You can contest this authorization as provided in Articles 3 and 4 of General Statute 150B by
filing a written petition for an administrative hearing to the Office of Administrative Hearings.
You may obtain a petition form from the Office of Administrative Hearings at
http: / /www.ncoah.com/ or call (919) 431 -3000 for information.
Within sixty (60) calendar days of receipt of this authorization, you must file the petition with
the Office of Administrative Hearings. A petition is considered filed when the original and one
(1) copy is received in the Office of Administrative Hearings during normal office hours (Monday
through Friday between 8:00am and 5:00pm, excluding official state holidays).
The petition may be faxed to the Office of Administrative Hearings at (919) 431 -3100, provided
the original and one copy of the petition is received by the Office of Administrative Hearings
within five (5) business days following the faxed transmission.
