PROJECT SUMMARY: The applicant proposes to install a new jet -ski lift for a total of 4 slips. 8108 Bald Eagle Lane, Robert and Christy Peyton Page Two 9. PROJECT DESCRIPTION The project site is located at 8108 Bald Eagle Lane, on the Atlantic Intracoastal Waterway (AIWW), in New Hanover County. To locate the project site from the Wilmington Regional Office (WiRO), travel north on Market Street (NC Highway 17), turn right onto Porters Neck Road and travel approximately 1 mile to the traffic circle, take the second exit to stay on Porters Neck Road and travel another 1.4 miles and then turn right onto Bald Eagle Lane. Travel approximately 0.3 miles and the property of interest will be located on the left. According to the applicant, the Peyton parcel located at 8108 Bald Eagle Lane, has an average elevation of 18' above NHW and is approximately 0.52 acres. The parcel is bordered to the north by a single-family home under construction, to the south is a vacant lot with a docking facility, to the west is Bald Eagle Lane, with the AIWW to the east. The parcel has approximately 108' of shoreline frontage currently stabilized by a vinyl bulkhead that approximates normal high water (NHW). The lot has an existing single-family home and pool with the highground vegetation consisting primarily of ornamental landscaping and maintained lawn grasses. Waterward of the existing bulkhead is primarily open water with a sand beach exposed at low tide which transitions to the man-made access channel located approximately 40-50' east of the bulkhead. The existing channel allows boating access to the AIWW for several private docking facilities in the vicinity and is located approximately 50' waterward of the existing bulkhead. The existing docking facility consists of a 6' by 30' access pier ending in a partially covered T-head platform. The covered portion of the platform measures 12' in width by 22' in length with the uncovered portion located waterward, measuring 7' in width by 20' in length. On the north side of the T-head platform is a 16' by 16' boatlift, A ramp extends south from the T-head platform to an 8' by 24' floating dock, positioned partially in the 15' riparian setback. This docking facility was originally authorized by General Permit # 64041-D issued on 8/29/2014 to Jam Properties. Additionally, the subject property was also named as a co -applicant on General Permit # 64067-D for maintenance dredging the adjacent access channel issued on 10/2/2014. The boat lift was added through State Permit # 112-16 issued on 10/17/2016 and expired on 12/31/2019. Most recently, General Permit # 74214-D authorized a new bulkhead to be constructed 2' in front of the existing bulkhead and was issued on 4/4/2019. The City of Wilmington/New Hanover County Land Use Plan classifies the adjacent waters as Conservation, and the adjacent high ground portion of the project area as Residential. The waters of the AIWW are classified SA-ORW by the Division of Water Resources and are NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries. They are OPEN to the harvest of shellfish. PROPOSED PROJECT The applicant proposes to install a new jet -ski lift for a total of 4 slips. The proposed lift would include adding 2 pilings, which measure 6' wide by 8' in length, that would be installed on the waterward side of the T-Head platform. The access channel located directly waterward of the T-head platform is approximately 40' in width. The proposed 2 piling jet ski lift would extend a maximum of 6' into the 40' wide man-made access channel. According to the applicant water depths in the vicinity of the proposed lift are 24" at normal low water (NLW) see sheet 3 of 4. Installation of the proposed 6' by 8' jet ski lift would result in the incorporation of approximately 48 ft2 of Public Trust Area. 8108 Bald Eagle Lane, Robert and Christy Peyton Page Three 10. ANTICIPATED IMPACTS The proposed project area would result in incorporation of 48 ft2 Public Trust Area. As proposed, the new 2 piling jet ski lift would extend a maximum of 6' into the 40' wide man-made access channel. No work is proposed in the 15' riparian setback. Minor increases in turbidity should be expected during project construction. The Peyton's would like to install a new 2-pole Jet Ski lift on the southeast corner on the waterward side of the existing partially covered, fixed platform. The pilings will be set 8 feet apart and the forks will be approx. 6 feet in width and will not encroach into either of the adjacent 15' riparian corridor setbacks. The requested modification will still be located well landward of the 'A width of the waterbody. If this agency does not render a permit decision within 70 days from April 6, 2021, you may request a meeting with the Director of the Division of Coastal Management and permit staff to discuss the status of your project. Such a meeting will be held within five working days from the receipt of your written request and shall include the property owner, developer, and project designer/consultant. NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the property of your proposed development. You should post this notice at a conspicuous point along your property where it can be observed from a public road. Some examples would be: Nailing the notice card to a telephone pole or tree along the road right-of- way fronting your property; or at a point along the road right-of-way where a private road would lead one into your property. Failure to post this notice could result in an incomplete application.
