Howard, Division Environmental Officer, Division 10 SUBJECT: Natural Resources Technical Report for TIP:W-5710AI,WBS: 44856.3.37, Federal Aid#HSIP-0218(016). INTRODUCTION The North Carolina Department of Transportation(NCDOT)proposes to construct a Roundabout at the intersection of NC 218 and SR 1606 (Sikes Mill Road), Union County. This Roundabout will help with the serviceability and safety of the existing intersection. PROTECTED SPECIES Endangered Species Act Protected Species As of July 17, 2020, the United States Fish and Wildlife Service (USFWS) list three federally protected species, under the Endangered Species Act (ESA) for Union County (Table 1). For each species, a discussion of the presence or absence of habitat is included below along with the Biological Conclusion rendered based on survey results in the study area. Table 1. A review by the NCNHP database on 15 March 2021 show no record of the Carolina heelsplitter being present within our PSA. Rhus michauxii USFWS Optimal Survey Window: May-October Biological Conclusion: No Effect A site survey was conduct by NCDOT on 12 March 2021 that found suitable habitat for Michaux's sumac. This species is noted to be historic in Union County by USFWS website. A review by the NCNHP database on 15 March 2021 shows no record of Rhus michauxii within the PSA. Schweinitz's Sunflower USFWS Optimal survey window: Late August-October Biological Conclusion: No Effect Habitat is present within the PSA in the form of disturbed roadside rights-of-way. A review of the NCNHP database, revealed no occurrences within the PSA. Even though habitat exist within the PSA all work will be conducted within the existing roads disturbed area and therefore there will be No Effect to this species. Northern long-eared bat USFWS Recommended Survey Window: June 1 —August 15 Biological Conclusion: May Affect;Not Likely to Adversely Affect Investigations on March 12, 2021 indicated habitat in the form of medium to large trees exist within the PSA. During the summer,NLEB roost singly or in colonies underneath bark, in cavities, or in crevices of both live and dead trees. Few mature trees are present within the study area and therefore provide little suitable habitat. A review of the NCNHP database,revealed no occurrences within the PSA. There are currently no known hibernaculum or maternity roost trees in Division 10 counties for NLEB. Bald Eagle and Golden Eagle Protection Act The Bald Eagle is protected under the Bald and Golden Eagle Protection Act and enforced by the USFWS. Habitat for the Bald Eagle primarily consists of mature forests in proximity to large bodies of open water for foraging. Large dominant trees are utilized for nesting sites, typically within 1.0 mile of open water. A desktop-GIS assessment of the project study area, as well as the area within a 1.0-mile radius of the project limits, was performed on March 12, 2021 using recent color aerials. No potential habitat or larger bodies of water were noted with in the vicinity of the project. Additionally, a review of the NHP database on March 12, 2021 revealed no known occurrences of this species within 1.0 mile of the project study area. Due to the lack of no observed nests, known occurrences, and minimal impact anticipated for this project, it has been determined that this project will not affect this species. WATER RESOURCES Water resources in the study area are part of the Yadkin Pee-Dee [U.S. Geological Survey (USGS) Hydrologic Unit 03040105]. One stream was identified in the study area (Table 2). The location of the stream is shown in attached maps. Table 2. The North Carolina 2018 Final 303(d) list of impaired waters does not identify this UT to Grassy Creek as being impaired. No other surface waters were identified in the study area. REGULATORY CONSIDERATIONS Clean Water Act Waters of the U.S. One jurisdictional stream was identified in the study area (Table 3). The location of this stream is shown on Figure 2. All jurisdictional streams in the study area have been designated as warm water streams for the purposes of stream mitigation. Table 3. Due to the road widening that will be necessary for the construction of this job we will be filling .02 acres of wetland. Based on the NRCS soil survey (attached) no hydric soils exist within the study area. However, the CmB soil classification has a high-water table during years with high rain volumes and usually situated above intermittent streams. N.C. River Basin Buffer Rules No Buffer Rules exist within the project limits. Rivers and Harbors Act Section 10 Navigable Waters There are no Navigable Waters under Section 10 of the Rivers and Harbors Act within the PSA. Coastal Area Management Act Areas of Environmental Concern There are no Coastal Area Management Act (CAMA) Areas of Environmental Concern (AEC) identified in the study area.
