Dear Mr. Reiter:
On March 12, 2007, the Division of Water Quality (DWQ) received your application dated
March 9, 2007, to impact 143 linear feet of perennial stream (113 linear feet of permanent
impact, 301inear feet of temporary impact), 7,750 square feet of Zone 1 protected Neuse River
basin riparian buffer and 5,000 square feet of Zone 2 protected Neuse River basin riparian buffer
to construct the proposed subdivision at the subject property. Your application was unacceptable
due to the following item:
1. Item #3 in the April 17, 2007 request for more information letter asked for a DWQ
worksheet for a dry detention basin. A wet detention basin worksheet was
incorrectly submitted. In addition, the Operation and Maintenance agreement
submitted was also pertinent to a wet, not a dry, detention basin.
For these reasons your permit application is hereby considered returned. Once you have
redesigned your project to address the problems and inadequacies with your application as it was
submitted, you will need to reapply for DWQ approval. Please be advised that plan sheet C-12
submitted on April 24 2007 indicates that the filter strip downslope from the proposed level
treader is signi~cantl~greater than the allowable 6-8 percent
