Perhaps I do not understand the problem? This ditch does not appear to be heavily eroded? 1 This ditch is shown to be an "existing ditch" on the State Stormwater permitted plan as opposed to a new ditch that would have been designed for the subdivision. Additionally, the project was certified by a Professional Engineer within the past month to have been constructed per the approved plan. It was really nice to speak with you on Tuesday. I have a question for you regarding the Deer Crossing Permit Number SW8 000245 that had been initiated as a permit to transfer from the Deer Crossing developer and current Permit Holder, N & K Development, Incorporated (signing official and Deer Crossing developer; Mr. Wilson Ki) from the transfer of ownership to the Deer Crossing Homeowners Association. I understand that your department has been provided with the following documents: Impervious Area Summary, the latest inspection report, and the SW8 000245 State Stormwater Management Permit that was dated September 21, 2020 but in order for you to address the questions and concerns for the Deer Crossing HOA and the newly appointed Board of Directors I have attached additional documents such as Site maps, Open Space Deed Reviews, The Site, Grading, Drainage, Erosion Control Management and Utility Plan Number 05011 and the Adjacent Parcel Zoning Plan. The SW Permit Design Standards in Permit Number SW8000245 identifies only 139 lots in Section II. I need clarification regarding the SW8 131307 Impervious Allocation Summary as well as the other parcels within the Deer Crossing Development that appear to be deeded to the developer, Wilson Ki as well leave approximately 20 or more plats that I am not certain fall within the standards of this permit since there was no mention of them in Section II. The new areas within Deer Crossing include, to my knowledge, are part of a newer portion of the Deer Crossing Community, which contain roadways and parcels located on Fawn Settle, Rustling Leaves and on Eco Circle. The Deer Crossing Homeowners at the following addresses have informed me of substantial issues regarding erosion that have been an ongoing issue for more than 5 years that have not been addressed by the developer, Mr. Wilson Ki with no avail: 6534 Rustling Leaves, Wilmington NC 28404, 6522 Settlers Dream, Wilmington NC 28404, and 1477 Eco Circle, Wilmington NC 28404. I have assessed the home located at 6522 Settlers Dream and I have attached photographs of the area of erosion in which the homeowners back lawn and fence are falling into the drainage ditch which runs along the neighboring plats. My personal opinion and recommendation would be to construct a retention wall along the banksides adjacent to the drainages ditches that should be filled with materials that are designed by civil and structural engineers to ensure the formational integrity of the remediation and provide directives accordingly such as using gravel as opposed to fill dirt due to withstand the pressure and movement to the back of the retention wall. I have emailed the developer, Mr. Wilson Ki, and I have provided him with the photos, as well as sent a copy of the email correspondence to the homeowner, although I did not provide a directive of any kind. Mr. Ki did respond back to me by copying me on an email and to his maintenance landscaper, Norberto, to go to the home and assess the matter. The homeowner has stated to me that this issue has been ongoing and for during the 5 years his home and fence have been receding into the drainage ditch. As you and I were discussing the hypotheticals that I presented you with on Tuesday, I believe that you stated that if the ditch in question is confirmed to be part of the swale, it would fall under the responsibility and accountability as such. My question is do all plats within the Deer Crossing Community fall under the jurisdiction of the SW8000245 Storm Water Permit that has be obtained. And if not could you provide us with directives as to how we can proceed. I understand that you have a great deal on your agenda and this is a tremendous task. Understandably the Homeowners at Deer Crossing as well as myself are concerned about the possible ramifications if they have not been identified as part of this Storm Water Permit and should have been. Could you please review all of the documents I have provided for you and address the status of the 20 plus additional plats that are not reflected in the permit's Design Standards. Eight deed restriction documents have been submitted for various sections, but I am unable to line up which lots/sections are represented by each document. A summary is needed. Once a plan has been approved, the land disturbing activity must be conducted in accordance with the plan and permit conditions The county shall forward to the Director of the Division of Water Quality a copy of each erosion and sedimentation control plan for a land disturbing activity that involves the utilization of ditches for the purpose of dewatering or lowering the water table of the tract. EGEIVE,wkj OCT 0 3 2012 KY: l4 Section 23-248 Erosion and sedimentation control plans (b) Persons conducting land disturbing activity on a tract which covers one or more areas shall file three copies of the erosion control plan with the county at least 30 days prior to beginning such activity and shall keep another copy of the approved plan and a posted copy of the permit at the job entrance, or on the job site before construction begins. No land disturbing activity is allowed until both the land disturbing permit and, if applicable, a County Stormwater ATC permit has been approved. After approving the Plan, if the county either upon review of such plan or inspection of the job site determines that a significant risk of accelerated erosion or offsite sedimentation exists or if design changes have been made to the original plan, the county will require a revised Plan. Pending the preparation of the revised plan, work shall cease or shall continue under conditions outlined by the approved plan and/or appropriate regulatory authority. (i) Applications for amendment of an erosion control plan in written and/or graphic form may be made at any time under the same conditions as the original application Until such time as said amendment is approved by the county, the land disturbing activity shall not proceed except in accordance with the erosion control plan as originally approved. 6) Any person engaged in land disturbing activity who fails to file a Plan in accordance with the Ordinance or who conducts a land disturbing activity except in accordance with provisions of an approved Plan and/or the permit conditions shall be deemed in violation of this article. Section 23-250 Inspections and investigations (b) If through inspection it is determined that a person engaged in land disturbing activity has failed to comply with the Act, this Ordinance, or rules or orders adopted or issued pursuant to this Ordinance, or has failed to comply with an approved Plan or permit conditions, a notice of violation shall be served upon that person by registered or certified mail or other means reasonably calculated to give actual notice. The notice shall set forth the measures necessary to achieve compliance with the Plan, specify a reasonable time period within which such measures must be completed, and warn that failure to correct the violation within the time period will result in additional civil and criminal penalties for a continuing violation. However, no time period for compliance need be given for failure to submit an erosion control Plan for approval or for obstructing, hampering or interfering with an authorized representative while in the process of carrying out his official duties. If the person engaged in land disturbing activity fails to comply within the time specified, enforcement action shall be initiated. Section 23-251 Penalties (a) Civil penalties. (1) Any person who violates any of the provisions of this Ordinance, or rules or orders adopted or issued pursuant to this Ordinance, or order adopted or issued pursuant to this Ordinance or the Act by the commission, or who initiates or continues a land disturbing activity for which an erosion control Plan is required except in accordance with the terms, conditions, and provisions of an approved plan, shall be subject to a civil penalty. The maximum civil penalty for a violation is $5,000.00 per calendar day. A civil penalty may be assessed from the date of the violation. Each day of a continuing violation shall constitute a separate violation. The person alleged to be in violation will be notified of the violation by registered or certified mail, return receipt requested or other means reasonably calculated to give actual notice. The notice shall describe the violation with reasonable particularity, specify a reasonable time period within which the violation must be corrected, and warn that failure to correct the violation within the time period will result in the assessment of a civil penalty or other enforcement action. If, after the allotted time period has expired, the violator has not completed corrective action, a civil penalty may be assessed from the date of the notice of violation. However, no time period for compliance need be given for failure to submit an erosion control Plan for approval or for obstructing, hampering or interfering with an authorized representative while in the process of carrying out his official duties. (2) The County Manager or his designee shall determine the amount of the civil penalty to be assessed under this subsection and shall notify the person who is assessed the civil penalty of the amount of the penalty and the reason for assessing the penalty. In determining the amount of the penalty the County Manager or his designee shall consider the degree and extent of harm caused by the violation and the cost of rectifying the damage, the amount of money the violator saved by noncompliance, whether the violation was committed willfully, and the prior record of the violator in complying or failing to comply with this article and shall direct the violator to either pay the assessment or contest the assessment within 30 days after the receipt of the notice of assessment, by filing a petition for a contested case in the Office of Administrative Hearing in accordance with Article 3 of Chapter 150B of the General Statutes. Notice of the assessment shall be by registered or certified mail or other means reasonably calculated to give actual notice. (3) Any appeals from the determination of the Office of Administrative Hearing shall be made by the Secretary of the Department of Environment and Natural Resources in accordance with Articles 3 and 4 of Chapter 150B of the General Statutes. Appeal from the final decision of the Secretary of the Department shall be to the Superior Court of the county where the violation occurred. Such appeals must be made within 30 days of the final decision of the Secretary of the Department of Environment and Natural Resources. If payment is not received or equitable settlement reached within 30 days after demand for payment is made, the matter shall be referred to the county attorney for institution of a civil action in the name of the county in the appropriate division of the general courts of justice for recovery of the penalty. A civil action must be filed within three years of the date the assessment was due. An assessment that is not contested is due when the violator is served with a notice of assessment. An assessment that is contested is due at the conclusion of the administrative and judicial review of the assessment. (4) Civil penalties collected pursuant to this article shall be credited to the general fund of the county as nontax revenue. (b) Criminal Penalties Any person who knowingly or willfully violates any provision of this article, or rule or order adopted or issued pursuant to this article, or who knowingly or willfully initiates or continues a land disturbing activity for which an erosion control plan is required except in accordance with terms, conditions, and provisions of an approved plan, shall be guilty of a Class 2 misdemeanor which may include a fine not to exceed $5,000.00 per calendar day. Section 23-252 Injunctive relief (a) Whenever the governing body has reasonable cause to believe that any person is violating or threatening to violate this article or any rule or order adopted or issued pursuant to this article, or any term, condition, or provision of an approved erosion control plan, it may, either before or after the institution of any other action or proceeding authorized by this article, institute a civil action in the name of the county, for injunctive relief to restrain the violation or threatened violation. The action shall be brought in the Superior Court of the county. (b) Upon determination by a court that an alleged violation is occurring or is threatened, it shall enter such orders or judgments as are necessary to abate the violation to ensure that restoration is performed, or to prevent the threatened violation. The institution of an action for injunctive relief under this section shall not relieve any party to such proceedings from any civil or criminal penalty prescribed for violations of this article. Corrective measure(s) needed and Time to Comply: Within three (3) calendar days of receipt of this notice stabilize the onsite stream banks where soil was disposed with jute mat until a final decision is made by other agencies with jurisdictional control. Within 20 working days of receipt of this notice, submit revised land disturbing plans for the area disturbed outside the previously approved limits of disturbance and the associated fees.
