Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application:* The project site consists of approximately 79.80 acres located at 1031 Gibsonville Ossipee Road in Elon, Alamance County, North Carolina. The project site is bound by Travis Creek, forested areas, open greenspace, and private residences to the north; forested areas to the east; North Manning Avenue, forested areas, open green space, and residential developments to the south; and Gibsonville Ossipee Road, forested areas, and private residences to the west. The site is comprised of approximately 4 acres of relict agricultural field and an abandoned homestead, with the remainder of the site consisting of mixed hardwood forest with pine stands approximately 10 years old interspersed throughout. The proposed residential development will consist of 198 single-family homes, stormwater control measures, and utility improvements (i.e. public water supply and sanitary sewer alignment). A delineation of the site was completed by Timmons Group on July 28 and August 4, 2020. A site visit was conducted by Chris Hopper (USAGE), Sue Homewood (NC DWR), and Josh Johnson (Town of Elon consultant with Alley, Williams, Carmen, and King, Inc.) on October 13, 2020 confirming the boundaries utilized for avoidance and minimization during project planning. Sue Homewood (NC DWR) issued a buffer determination letter on December 1, 2020, to which Josh Johnson as a representative for the Town of Elon, concurred with on December 18, 2020. 4b. Comments: In order to provide adequate site access and connectivity, one road crossing impact (Impact 2), resulting in 0.07 acres of permanent impact to Wetland E, is required. Of these impacts, 0.06 acres is associated with roadway fill and 0.005 acres is associated with a riprap dissipater pad. Roads were sited utilizing existing connector road requirements and the delineation was used to help avoid and minimize impacts as much as possible to adjust the road crossing to cross at the narrowest portion of the wetland possible. In addition, the road was aligned with an existing earthen road. Due to site grading requirements, and to promote community cohesion, 0.01 acres of permanent impacts to Wetland J are required (Impact 3). This impact is associated with a b(1) non -adjacent basin wetland, which is not 404-jurisdictional. This impact is proposed to be authorized under DWR's General Certification IWGP100000, which permits up to 0.5 acres of isolated basin wetland impacts within the Piedmont Region. Comments: The road crossing (Impact 1) is required for access and connectivity of the eastern and western portions of the site. The crossing was sited based on road requirements and along a portion of the stream that would minimize impacts by avoiding riparian wetlands. The proposed crossing will involve installation of one 42-inch RCP with headwalls up- and downstream of the crossing, as well as grading to ensure safety of the crossing. Impacts associated with the road crossing will result in 89 linear feet of permanent stream impacts. In addition, a riprap dissipater pad that will be keyed into the streambed is proposed at the culvert outfall and is associated with 29 linear feet of permanent no loss stream impacts. 6. Comments: The road crossing and associated proposed riparian buffer impacts (Impact 1) are required for access and connectivity of the eastern and western portions of the site. Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project: Impacts to jurisdictional features have been avoided and minimized to the maximum extent practicable by incorporating resourceful site planning, including utilization of the wetland/stream delineation to adjust the layout of the Site design to avoid and minimize impacts. The stream crossing (Impact 1) was designed to cross the stream as close to 90-degrees as possible. Furthermore, headwalls were utilized in project design to limit impacts to streams and wetlands at impact locations 1 and 2. The remaining impacts proposed are necessary in order for the project's goals to be realized. 1b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques: Proper sedimentation and erosion control methods will be utilized during all phases of construction and installation as described in accordance with the requirements of the North Carolina Department of Environment and Natural Resources: Erosion Control Planning and Design Manual (May 2013) and local codes. All work will take place during dry conditions and can be facilitated from high, non -jurisdictional, stable ground. The contractor shall install silt fence, inlet protection, sediment traps, division ditches, temporary coffer dams, tree protection, and clearing only as necessary to install devices. All erosion and sediment control measures will be checked for stability and operation following every runoff producing rainfall, but in no case less than once every week. Any needed repairs will be made immediately to maintain all measures designed. An erosion control inspections report is required and will be kept by the owners representative. Temporary seeding and permanent seeding plans are included to restore impacted areas. The project will meet all relative requirements of Best Management Practices and Engineered Stormwater Control Structures as outlined through State and Local Stormwater Rules. Measures will be taken to prevent oil, tar, trash, debris, and other pollutants from entering adjacent jurisdictional features. Any excess excavated materials not utilized as back fill will be placed and contained within upland areas and permanently stabilized to prevent erosion into adjacent jurisdictional features. Therefore, stockpiling of excavated material within jurisdictional waters of the U.S. will be strictly prohibited as part of the construction of this project. All project construction activities initiated within jurisdictional waters of the U.S. will be carried to completion in an expeditious manner to minimize the period of disturbance within jurisdictional waters. 2. No historical places were listed within or in the immediate vicinity of the site's boundaries. Of these eight listings, one is a block face of consisting of houses, one is a study list site, four are survey only sites, and two are survey only - destroyed sites. While historic sites listed as SO (survey only) have not yet been deemed eligible for listing and can be deemed eligible in the future following further review from the State Historic Preservation Office (SHPO), the nearest undetermined SO site, AM0104, is located approximately 0.4 miles to the east of the site. Due to the lack of direct impacts and lack of anticipated visual impacts due to tree cover, the proposed project should have no effect on these resources. Therefore, due to the absence of historic resources within the immediate vicinity of the site, distance, and existing infrastructure and forested areas between the site and historic resources, the proposed project should have no effect on historic resources. 7c. The project area consists of approximately 79.8 acres and is largely occupied by mixed hardwood forest with a relatively small relict agricultural field located in the southern portion of the property. The project is proposing the development of a residential subdivision within the site. Impact maps and site plans are in progress and expected to be finalized within the next 30 days, but proposed impacts to jurisdictional features within the site are anticipated. Impacts to wetlands and streams delineated onsite should be minimal and limited to those necessary to install necessary utility connections, road crossings, and grading (where necessary) to ensure safety and accessibility of the site. Further, wetland and stream delineation is being used to avoid and minimize impacts to jurisdictional features to the maximum extent possible.
