4a. Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application:*
The site is currently vacant, open land that is being maintained by routine mowing. The property has been graded and filled in the past. An abandoned house built in 1949 exists on the
property which will be demolished (see SHPO section, not believed to be historic). US 70 Hwy runs along the southern property line and Yeargan Rd along the southeastern property
line. Adjacent land uses are commercial to the south along US Hwy 70 and Yeargan Road, as well as to the north along Mechanical Blvd. Residential homes also exist along Yeargan
Rd, Henry Dr and and Loop Rd. to the north and east.

The purpose is to construct a residential apartment community.

The project will include eleven (11) apartment buildings, clubhouse, pool, and associated infrastructure to include roads, parking, stormwater control measures, as well as three (3)
future outparcel lots along US 70 Hwy and Yeargan Road. Heavy equipment such as excavators, bulldozers, dump truck, etc. will be used for the grading and site prep work.

la. Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project:
See attached "Raynor Meadows - Impact Justification" letter. S&EC was hired to delineate all potentially jurisdictional wetlands, streams and buffers
and obtain USACE and DWR verifications. The applicant then use this information minimize impacts as much as practicable. The road crossing at
impact are 2 was aligned to cross over an e>asting piped crossing to minimize stream and buffer impacts. However, impacts to the long, linear wetland
in the field area could not be completely avoided. Mitigation is proposed for these impacts.
1b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques:
See attached "Raynor Meadows - Impact Justification" letter. A land disturbance permit to include erosion and sediment control measures will be
obtained for the project to help protected avoided wetlands, waters and buffers as well as prevent impacts to downstream waters. A post construction
stormwater management plan will also be obtain for the project with the SCMs as shown on the plans.

This document confirms that W&M Partners, LLC (Applicant) for the Raynor Meadows (Project) has
expressed an interest to utilize 0.58 Riparian Wetland Mitigation Credits from the EBX-Neuse
sponsored Neu -Con Wetland & Stream Umbrella Mitigation Bank, specifically 0.58 from the Meadow
Spring Site in the Neuse HUC 03020201. As the official Bank Sponsor, EBX-Neuse I, LLC, attests to the
fact that mitigation is available for reservation at this time.
These mitigation credits are not considered secured, and consequently are eligible to be used for alternate
purposes by the Bank Sponsor, until payment in full is received from the Applicant resulting in the
issuance of a Mitigation Credit Transfer Certificate by the bank acknowledging that the Applicant has
fully secured credits from the bank and the Banker has accepted full responsibility for the mitigation
obligation requiring the credits/units.
The Banker will issue the Mitigation Credit Transfer Certificate within three (3) days of receipt of the
purchase price. Banker shall provide to Applicant a copy of the Mitigation Credit Transfer Certificate and

Western Most Drainage Impact Justification
The property of the proposed development is traversed by a stream with its associated Neuse
River Riparian Buffer, and an overhead electrical transmission line easement. The property
abuts two existing public roadways —US 70 HWY and Yeargan Road. Public safety issues
require vehicular access on each of these roadways, and inclusion in the development plan of
vehicular circulation routes through the site to ensure adequate access for life/safety
equipment to the proposed buildings, and to accommodate future extension of a vehicular
access route to/from Loop Road to the west. The driveway access points to each of the two
abutting roadways is governed by regulatory distances from the intersection of these
roadways —thereby limiting the available flexibility in the configuration of the site.
Additionally, stem length requirements for any connections to US 70 HWY create a
constraint on the potential configuration of the circulation system.
An existing narrow linear band of wetland bisects the site from north to south through an
agricultural field. The wetland originates at the discharge point of a drainage pipe from the
existing abutting development to the north, and extends southward to an existing 24" culvert
that passes under US 70 HWY.
Due to the above described constraints, it is necessary to cross both the buffered stream and
the narrow linear wetland with a vehicular access route. A private roadway is proposed from
Yeargan Road to the east to the western boundary of the project toward Loop Road as the
major element of the vehicular circulation system. This proposed roadway is located to
correspond to the division between the CR zoning (Commercial Outparcels) to the south, and
the MF-zoning (Residential Apartments) to the north. Due to constraints on the location of
the roadway connection to Yeargan Road, it is necessary that this proposed east -west private
road cross both the buffered stream and the narrow linear wetland feature. Retaining walls
have been employed to minimize the area of impact of the roadway crossing on the stream
and its associated riparian buffer. Retaining walls have also been employed to avoid impact
of the narrow linear wetland south of the proposed private road (between the private road and
existing US 70 HWY).
On the north side of the proposed private road, the configuration of the resultant parcel
created by the private road to the south, the buffered stream to the east, and the perimeter
boundaries of the property to the north and west dictates that the portion of the narrow linear
wetland north of the private roadway be eliminated to accommodate a layout of a sufficient
number of apartment units with associated parking and vehicular circulation routes to
develop a viable project. The proposed impact would eliminate approximately 65% of the
length of the narrow linear wetland feature on the property.
The proposed project includes two wet detention ponds located on the west and east sides of
the central drainage ditch that serve as the primary Stormwater Control Measure to address
water quality regulations and the control of stormwater discharge rates to those of pre -
development conditions up to and including the 100 year return interval event.

Project Description :
• The proposed project is a residential apartment community located on +/- 23.68
acres.
• Primary associated permits involve impacts to wetlands, streams and buffers that
have been requested through the U.S. Army Corps of Engineers (USACE — April
Norton) and N.C. Division of Water Resources (DWR — Rick Trone or Stephanie
Goss).
• There are no known or listed historic properties within or adjacent to the project
area. An abandoned house identified on local GIS databases as being built in
1949 is located on the property. This is the only structure older than 50 years on
the property.

• The house is abandoned and not habitable. It's a 2-story, salt box, possibly
asbestos siding, concrete block foundation, with no known historical context. The
house is proposed to be demolished in the initial phase of development to allow
for a required access drive/road into the property.
• The developer has the property under contract and is currently going through
local zoning and permitting with the Town of Garner.
• The house backs up to open land which has been graded and filled over the
years and maintained in grass with regular mowing.
• The site will be graded as depicted in the attached site plans.

Location description: The project area is located in the northwest quadrant of Yeargen Road and US Highway 70, at 120
Yeargen Road, in Garner, Wake County, North Carolina. The project area is shown as the area within the red -outlined
"Parcel Boundaries" on the attached sketch entitled "Figure 3 — Sketch Map."

A. Preliminary Determination
® There appear to be waters, including wetlands on the above described project area/property, that may be subject to
Section 404 of the Clean Water Act (CWA)(33 USC § 1344) and/or Section 10 of the Rivers and Harbors Act (RHA) (33
USC § 403). The waters, including wetlands have been delineated, and the delineation has been verified by the Corps to be
sufficiently accurate and reliable. The approximate boundaries of these waters are shown on the enclosed delineation map
dated 10/23/2019. Therefore this preliminary jurisdiction determination may be used in the permit evaluation process,
including determining compensatory mitigation. For purposes of computation of impacts, compensatory mitigation
requirements, and other resource protection measures, a permit decision made on the basis of a preliminary JD will treat
all waters and wetlands that would be affected in any way by the permitted activity on the site as if they are jurisdictional
waters of the U.S. This preliminary determination is not an appealable action under the Regulatory Program
Administrative Appeal Process (Reference 33 CFR Part 331). However, you may request an approved JD, which is an
appealable action, by contacting the Corps district for further instruction.

sufficiently accurate and reliable to support an enforceable permit decision. We recommend that you have the waters, including
wetlands on your project area/property delineated. As the Corps may not be able to accomplish this wetland delineation in a
timely manner, you may wish to obtain a consultant to conduct a delineation that can be verified by the Corps.

1) The Corps of Engineers believes that there may be jurisdictional aquatic resources in
the review area, and the requestor of this PJD is hereby advised of his or her option
to request and obtain an approved JD (AJD) for that review area based on an
informed decision after having discussed the various types of JDs and their
characteristics and circumstances when they may be appropriate.
2) In any circumstance where a permit applicant obtains an individual permit, or a
Nationwide General Permit (NWP) or other general permit verification requiring "pre -
construction notification" (PCN), or requests verification for a non -reporting NWP or
other general permit, and the permit applicant has not requested an AJD for the
activity, the permit applicant is hereby made aware that: (1) the permit applicant has
elected to seek a permit authorization based on a PJD, which does not make an
official determination of jurisdictional aquatic resources; (2) the applicant has the
option to request an AJD before accepting the terms and conditions of the permit
authorization, and that basing a permit authorization on an AJD could possibly result
in less compensatory mitigation being required or different special conditions; (3) the
applicant has the right to request an individual permit rather than accepting the terms
and conditions of the NWP or other general permit authorization; (4) the applicant can
accept a permit authorization and thereby agree to comply with all the terms and
conditions of that permit, including whatever mitigation requirements the Corps has
determined to be necessary; (5) undertaking any activity in reliance upon the subject
permit authorization without requesting an AJD constitutes the applicant's acceptance
of the use of the PJD; (6) accepting a permit authorization (e.g., signing a proffered
individual permit) or undertaking any activity in reliance on any form of Corps permit
authorization based on a PJD constitutes agreement that all aquatic resources in the
review area affected in any way by that activity will be treated as jurisdictional, and
waives any challenge to such jurisdiction in any administrative or judicial compliance
or enforcement action, or in any administrative appeal or in any Federal court; and (7)
whether the applicant elects to use either an AJD or a PJD, the JD will be processed
as soon as practicable. Further, an AJD, a proffered individual permit (and all terms
and conditions contained therein), or individual permit denial can be administratively
appealed pursuant to 33 C.F.R. Part 331. If, during an administrative appeal, it
becomes appropriate to make an official determination whether geographic
jurisdiction exists over aquatic resources in the review area, or to provide an official
delineation of jurisdictional aquatic resources in the review area, the Corps will
provide an AJD to accomplish that result, as soon as is practicable. This PJD finds
