Hi Dave,
I spoke with Sue this morning, and since we are staying in the NCDOT ROW, and replacing the existing line in the same
location and subsequently will not create a permanent impact, the project does not trigger an Individual Water Quality
permit under GC 4276.

Please reference the NWP 12 verification for the above referenced project (with the exception of the Deep River
crossing) dated 2/5/2021. Further, thank you for the additional information regarding the proposed alternative Deep
River crossing methods submitted via emails dated 3/9/2021 and 3/11/2021. Lastly, thank you for your email dated
4/5/2021 requesting reconsideration of the originally authorized project and the alternative Deep River crossing
methods for the use of NWP 58. Based on the preceding, the above referenced project is authorized under Nationwide
Permit (NWP) 58 and does not require notification. Please note that the project must be accomplished in strict
accordance with the attached conditions and your submitted description, and any violation of the attached conditions or
deviation from your submitted description may subject the permittee to a stop work order, a restoration order and/or
appropriate legal action. Attached is a copy of the NWP 58 and the applicable permit conditions. The Action
Identification Number for this project is SAW-2020-00682.
Please note that this project is still required to remain consistent and in compliance with Special Condition c of the
Individual Permit issued by the Corps to Piedmont Triad Regional Water Authority for the construction of Randleman
Lake (SAW- 1991-02669), specifically the Deep River and its adjacent 200-foot buffer (i.e. land owned by the Piedmont
Triad Regional Water Authority). The proposed alternative Deep River crossing methods submitted via emails dated
3/9/2021 and 3/11/2021 have been determined to meet these requirements by the Corps of Engineers, Wilmington
District (Corps). However, any deviation from these methods or those originally submitted (i.e. HDD crossing under the
entire buffer) will require coordination with the Corps to ensure continued compliance.
Sue, it is my understanding that this project fits Water Quality General Certification No. 4276 (issued 12/18/2020) and
does not trigger any of the Individual 401 WQC thresholds or circumstances listed on Pages 2-3 of WQC 4276. Please let
me know if this is not the case, and an Individual 401 WQC is in fact required for this project.

Hi Dave,
Per our conversation this morning, I wanted to confirm that since the Registers Creek Pump Station and Force Main
Project (SAW-2020-00682) does not require a Section 10 permit and does not result in a loss greater than 1/10 acre of
WOTUS, it meets the requirements fora non -reporting (i.e., no PCN required) Nationwide Permit 58 Utility Line Activities
for Water and Other Substances.
