All,
Based on the PCN and additional information you submitted on 3/30/2021, the above referenced project appears to be
authorized under Nationwide Permit (NWP) 51 and does not require notification to the Corps. Attached is a copy of the
NWP 51 including the applicable permit conditions. Please note that the project must be accomplished in strict
accordance with these conditions and your submitted description, and any violation of the conditions or deviation from
your submitted description may subject the permittee to a stop work order, a restoration order and/or appropriate legal
action. The Action Identification Number for this project is SAW-2020-02138.
Although it is our understanding that this project fits Water Quality General Certification No. 4271 (issued 12/18/2020),
it is also possible that the project may trigger one or more of the Individual 401 WQC thresholds or circumstances listed
on Pages 2-3 of this Certification. It is your responsibility to contact the North Carolina Division of Water Resources
(NCDWR) Winston Salem Regional Office to determine the 401 requirements for this project. Please note that, if an
Individual 401 WQC is required from NCDWR, the conditions of the Individual 401 WQC once issued are also conditions
of the NWP referenced above. You may not conduct the activity authorized by the above referenced NWP without a
valid 401 Water Quality Certification.
Lastly, in reviewing Sheet Number EX 1.0 and Figure 6.0: Impact Figure Overview Map from the PCN package (see "Pages
from 20210330 PCN and Plans.pdf", attached), I noted a possible overlap of a portion of a solar array with a stream
(Stream IS-5). Please note that no discharge of dredged or fill material has been proposed or authorized for any portion
of this project other than the road crossing described in the PCN.
