Sullins, Director Division of Water Quality June 4, 2007 DWQ Project # 06-1827 Johnston County CERTIFIED MAIL: RETURN RECEIPT REQUESTED Mr. Matthew Winslow Denmark Properties, LLC 416B U.S. 1 North Youngsville, NC 27596 Subject Property: Brighton Ridge Subdivision Ut to Hooks Branch [030404, 27-45-4, C, NSW] RETURN OF APPLICATION Dear Mr. Winslow: On November 21, 2006, the Division of Water Quality (DWQ) received your application dated November 20, 2006, to impact 1101inear feet of intermittent stream, and 6,000 square feet of Zone 1 Neuse River basin protected riparian buffers and 4,000 square feet of Zone 2 Neuse River basin protected riparian buffers, to construct the proposed residential subdivision. On January 12, 2007, March 12, 2007, and Apri126, 2007, the DWQ received additional information from you, however, the DWQ has determined that your application remains incomplete and/or provided inaccurate information as discussed below. In the April 19, 2007, the DWQ requested that you provide a plan detail and level spreader worksheet for each proposed level spreader. These worksheets have not been fully completed and some of the required items are missing. In particular, plan details for the bypass structure associated with level spreader 2 have been omitted. Also, photographs of the vegetation downslope of each level spreader have been omitted. Appropriate photographic evidence is necessary to claim the filter strip vegetation as "thick ground cover" and thus have a shorter level spreader length. 2. Level spreader 8 is proposed to be 139 feet in length, which exceeds the allowable length of 130 feet. For these reasons your permit application is hereby considered returned. Once you have redesigned your project to address the problems and inadequacies with your application as it was submitted, you will need to reapply for DWQ approval.
