Accordingly, Special Condition (m) is hereby replaced with the following- m) In order to compensate for permanent impacts to 2,136 linear feet of stream channel and 8_9 acres of riparian wetlands, the permittee shall make payment to the North Carolina Ecosystem Enhancement Program (NCEEP) in the amount determined by the NCEEP, sufficient to perform the restoration of 1,400 linear feet of stream channel and 8_9 acres of Riparian, Non - Rivenne wetlands (of Headwater habitat type) in the Cape Fear River Basin, Cataloging Unit 03030004, and in accordance with the below phased mitigation table: -3- Mitigation Phases: Mitigation Phase Impact Areas Impact Timeline Payment By Date Phase 1 R1 ,R2, R8, R9 and R11 0 -6 months March 1, 2013 Phase 2 R4, R5, R6 and R7 8 -24 months September 1, 2014 Phase 3 R10 and R12 36 -60 months September 1, 2017 Phase 4 Lake 24 -60 months September 1, 2017 Construction within jurisdictional areas of each phase on the property shall begin only after the permittee has made full payment to the NCEEP and provided a copy of the payment documentation to the Corps for impacts authorized in each respective phase, and the NCEEP has provided written confirmation to the Corps that it agrees to accept responsibility for the mitigation work required, in compliance with the NCEEP In -Lieu Fee Instrument, approved by the United States Army Corps of Engineers, Wilmington District on July, 28, 2010 " Additionally, the following permit special condition (t) has been added as follows. tt) Temporary impact areas should be restored back to pre- construction contours and in accordance with your temporary impact area restoration plan After review of the file and all modification requests we have determined that the proposed changes to the permit are minor, and that a supplemental public notice is not necessary. It is understood that all other conditions of the original permit and previous modifications remain applicable, including the permit expiration date of December 31, 2017. This permit modification letter does not authorize any additional impacts to wetland or other waters of the U.S. Any request for new work, including requests for authorized work not completed by the expiration date of this permit, shall warrant re- evaluation under current regulations and other program stipulations. Please also reference the "Permanent Conservation Easement" you provided to us on December 11, 2012 In the document you have stated that the easement holder would be Anderson Creek Property Owners Association, Inc The Corps requires that the conservation easement be held by an acceptable easement holder, specifically the holder should be either a recognized conservation organization, or a governmental entity that intends to enforce the conditions of the conservation easement As such, please locate an approved easement holder and update the conservation easement documentation accordingly You should be aware that condition "n)" requires that an acceptable conservation easement be executed and recorded in the Harnett County Register of Deeds prior to beginning any work authorized by the permit In If you have questions, please contact Ms Crystal Amschler of the Wilmington Regulatory Field Office, at telephone (910) 251 -4170.
