0n July 23, 1987 you wrote the Division requesting modification of the
supplement to cover sheet of your NPDES permit and revision in your effluent
limitation. The Division's Wilmington Regional Office and Technical Services Branch
has completed its review of your request. The Division concurs with yourrequestto
modify the supplement to cover sheet of your permit. Attached is a revised supplement
sheet which should be inserted into your NPDES permit and the old sheet discarded.
The Division cannot honor your request to revise the effluent limits in your
modified permit. The limits contained in the modified permit are the ones required to
protect water quality in the receiving stream. If the Town's request for an effluent
channel designation is granted the Division will evaluate new effluent limitation at
that time.
Existing dates on file with the Division does not indicate any violation of the
State's water quality standard upstream of your facility. The Division's field
analyses are not routinely performed for facilities wishing to receive less stringent
effluent limits. 0ur decision are based on the best available information. If you
think our recommendation are inappropriate you are welcome to submit any information
that you feel will support your request. This information will be reviewed by our
Technical Service Branch.

If this decision is unacceptable to you, you have the right to an adjudicatory
hearing upon written request within thirty (30) days following receipt of this
letter. This request must be in the form of a written petition, conforming to Chapter
150B of the North Carolina General Statutes, and filed with the Office of
Administrative Hearings, Post Office Drawer 11666, Raleigh, North Carolina 27604.
Unless such a demand is made, this decision shall be final and binding.
