During a City sampling event at Cormetech, grab samples were collected not composite. Cormetech was found in violation of Cd, but due to incorrect sampling procedures NOV and penalty was rescinded per Wes Bell. Both NOV's were included in the 2019 PAR. 6 CITY OF KINGS MOUNTAIN (NPDES #0020737) 2020 PAR NARRATIVE ❖Commercial Vehicle Group (IUP# 026) additional information: ❖ On 12/18/19 a NOV for no calibration of flow meter was certified mailed but returned on 1/26/2020 unclaimed. The NOV was then emailed on 1/9/2020 and CVG confirmed receipt on 1/10/2020. The City gave CVG until 2/09/2020 to send the flow meter calibration report. No calibration report was received by the City. ❖ On 2/12/2020 the City issued a NOV and Civil penalty of $1000 and ten business day (2/26/2020) to submit calibration report. No calibration report was received by the City. ❖ On 2/27/2020 the City met with CVG regarding 2019 NOV's and flow meter. ❖ On 3/23/2020 the City issued a NOV and Civil penalty of $1500 and thirty days (4/22/2020) to submit calibration report. ❖ On 3/27/2020 CVG requested an deadline extension. CVG had ordered two flow meter but with lead time and installation they felt they needed more time. The City extended the deadline until May 4, 2020. ❖ On 4/22/2020 CVG requested another extension due to COVID, layoffs, and the plant temporarily shutdown. The City extended the deadline until 6/1/2020. ❖ On 6/1/2020 the City received the flow meter calibration report. CITY OF KINGS MOUNTAIN (NPDES #0020737) 2020 PAR NARRATIVE SNC INFORMATION Listed below are Significant Industrial User of The City of kings Mountain's Wastewater Facility that were in Significant Non -Compliance (SNC) with the national pretreatment regulations, 40CFR Part 403 and state pretreatment regulations, 15NCAC2H .0900 and local pretreatment regulations. ❖CVG-Mayflower Vehicle Systems: CVG was found in Significant Non -Compliance during July -December 2019 and January -June 2020. CVG failed to calibrate flow metering device as requested by the Industrial User Permit issued to CVG-Mayflower Vehicle Systems. The City of Kings Mountain received CVG's flow meter calibration report on June 1, 2020. ❖Kings Mountain International: Kings Mountain International was found in Significant Non -Compliance during January -June 2020 for nickel and molybdenum. These parameters were found in violation >33% of the time. CONSENT ORDER AND COMPLIANCE SCHEDULE Pursuant to provisions of the Sewer Use Ordinance and the Industrial Wastewater Pretreatment Ordinances of the City of Kings Mountain, this Consent Order is made effective the 27th day of August 2020, between Kings Mountain International, Inc. and the City of Kings Mountain. Kings Mountain International, Inc. and The City of Kings Mountain hereby stipulate and agree as follows: 1. Kings Mountain International, Inc. holds City of Kings Mountain Pretreatment Permit No. 031 (hereinafter the "Permit", which shall refer to Kings Mountain International, Inc. existing permit and any subsequent renewals or modifications thereof) for the operations and regulations of ALL discharges into the City's Collection System. 2. Kings Mountain International, Inc. has been found in SNC (Significant Non -Compliance) during January -June 2020 for nickel and molybdenum. 3. Achievement of these requirements will require resolution of existing problems in the present treatment train and possibly, development of alternative solutions to alleviate noncompliance, including but not limited to the construction of additional pretreatment facilities as well as the preparation of plans and specifications as necessary. 4. Kings Mountain International, Inc. hereby agrees to do and perform all of the following: a. Meet and comply with all terms and conditions of the Permit (except as modified by the Order) provided, however, subject to the terms and conditions of the Consent Order, the following shall apply: Parameter Nickel Molybdenum Daily Max .600 mg/L 310 mglL Monitoring Frequency Detection Limit 1-Weekly 0.01 mg/L 1-Weekly 0.025 mg1L b. Unless and until Compliance is achieved, Kings Mountain International, Inc. will undertake activities necessary to bring the Kings Mountain International, Inc. into Compliance in accordance with the following schedule: (I) COMPLIANCE SCHEDULE Activities Deadline for Completion Prepare and submit a plan of action to achieve continuous Compliance flow monitoring and reporting (ii) Increase monitoring for nickel and molybdenum for the duration of the Consent Order. Submit results with monthly report. Plan Received August 20, 2020 August 31, 2020- May 1, 2021 (iii) Complete and submit Pilot Studies and identify December 31, 2020 alternatives chosen to achieve compliance. (iv) Begin construction (Upon Approval) and/or implement identified process alternative(s). (v) Achieve compliance with final (IUP #031), with all requirements in Permit No. 031. Kings Mountain International, Inc. shall perform each of the activities set forth in subparagraph (b) on or before the dates established thereby unless such dates are extended by agreement of Kings Mountain International, Inc. and the City of Kings Mountain may request such extensions for good cause, and the City will not unreasonably withhold its consent to such extensions. d. Kings Mountain International, Inc. shall submit a comprehensive written report for item (i) of subparagraph (b) by or on the date specified above. The reports shall be in narrative form, shall state in detail the activities undertaken since the last report to achieve compliance, and shall indicate whether Kings Mountain International, Inc. has met the due date for the relevant milestone established in this Consent Order. If any report contains notice of failure to meet a milestone date, the report shall also include a statement explaining the cause of the failure, any remedial actions taken, and the probability of meeting the next milestone. Assessment of Civil Penalty detailed below: (i) The City of Kings Mountain has assessed a Civil Penalty on July 24, 2020 in the amount of $1000 for consecutively exceeding their Nickel and Molybdenum limits for May and June 2020. King Mountain International is in significant noncompliance for the first half January - June 2020. f. Kings Mountain International, Inc. shall notify the City of any time that nickel or molybdenum limits are exceeded for the duration of time mentioned in item of subparagraph (b). Any violation of the terms of this Consent Order shall subject Kings Mountain International, Inc. to the enforcement authority outlined in the Ordinance. Such action may include, but is not limited to such fines, penalties and assessments as may be set forth in the Code of Ordinance of the City of Kings Mountain, as amended from time to time. g. In lieu of other penalties the following stipulated penalties shall apply for violations of Kings Mountain International, Inc.'s limits or failure to meet a milestone date under this Consent Order, or failure to achieve full compliance with Consent Order. Violation of limits Failure to collect required samples, meet compliance schedule deadlines, required reports, or other milestone dates contained herein Failure to achieve full compliance with Final IUP #031 limit at expiration of Order $1,000.00 per day, per violation $1,000.00 per day, per violation $10,000.00 per day Once Compliance is achieved, this Consent Order shall terminate and all obligations hereunder except any obligation to pay identified moneys to the City shall expire. Upon termination of this Order, Kings Mountain international, Inc. shall be subject to all terms of the Permit. h. In the performance of the activities herein ordered to be done and performed, Kings Mountain International, Inc. must otherwise follow the applicable procedures, rules, regulations, ordinances, and law of the City, the State and the Federal government.
