DIRECTIONS TO THE SITE The basin in which the Hatteras-Southdock route ferries dock on the Ocracoke(Southdock)side.Northern end of Ocracoke Island. 18. Nature of Activity(Description of project,include all features) This project would allow for the expansion of the Southdock Ferry Terminal basin/entrance channel dredge limits.Our current permit allows for maintenance dredging up to 12'deep MLLW within the 225' limits of the existing channel.With the proposed expansion,the entrance channel would increase to 375'between points SO1 and NO1 on the workplan,or where it intersects with Sloop Channel.It would remain at 375'until it reaches points S02-NO2 where it starts to turn south towards the ramps.Between these points is where it would begin to taper off and gradually return to the 225' width at points S03-NO3.It would remain at 225'from that point until its termination at the ramps,or points SO4-N04.The dredging depth would remain at 12'MLLW. The widening of the channel would create 2.38 acres of new channel bottom.We would have a 3:1 slope on all sides. 19. Project Purpose(Describe the reason or purpose of the project,see instructions) The Southdock Ferry Terminal is used by the NCDOT Ferry Division to transport the public and supplies to and from Ocracoke Island.The Hatteras-Southdock ferry route is the busiest overall route within the NC ferry system. It provides transport for 500,000 to 800,000 passengers per year,and as many as six ferries run simultaneously during the summer months.Shoaling along the western side of the basin and channel has continued to be a consistent issue that affects how the Captains navigate in and out of the basin.The current width of the channel creates unnecessary risks during the summer when all of the ferries are running,and the likelihood of sudden weather events increases.Stabilization of the spoil site shoreline has allowed for improved protection during major storms but the dynamic nature of the area,combined with the increasing frequency of significant storm events,has resulted in the need to continually assess and improve upon our management plan. The basin/entrance channel extends from the southeastern section of the bulkhead, underneath the ferry ramps,to its intersection with Sloop Channel just north of the point. The Southdock Ferry Terminal is used by the NCDOT Ferry Division to transport the public and supplies to and from Ocracoke Island.The Hatteras-Southdock ferry route is the busiest overall (yearly)route within the NC ferry system.It provides transport for 500,000 to 800,000 passengers per year on average, and as many as six ferries run simultaneously during the summer months. Our current permit allows for maintenance dredging up to 12' deep MLLW within the 225' limits of the existing channel. With the proposed expansion,the entrance channel would increase to 375' between points SO 1 and NO1 on the drawing,or where it intersects with Sloop Channel. It would remain at 375' until it reaches points S02-NO2 where it starts to turn south towards the ramps. Between these points is where it would begin to taper off and gradually return to the 225' width at points S03-NO3. There is no SAV present in the project area due to the dynamic environment and water depth. This was confirmed via mapping and coordination with NC DMF. The purpose of this modification would be to promote safer travel in and out of the basin and reduce the frequency of maintenance dredging events.The expanded channel would be large enough to incur considerable shoaling along its western boundary before navigation was impacted. All dredge work would be performed by the NCDOT Ferry Division Marine Maintenance Unit. They would utilize the state-owned Dredge Manteo which is a 12"pipeline dredge that has dredged this channelbasin in the past.Dredging operations would be kept at least 10' off the bulkhead. Dredging would be limited to outside the moratorium period of March 1 to October 31 unless a major storm created consequential shoaling that required moratorium relief requests from the appropriate agencies.Depending on the severity of shoaling in the channel,dredging projects would last between three to eight weeks. All dredge material would be placed within the Southdock spoil site. Current NPS SUP#5700-028 authorizes the NC DOT to place dredged material via pipeline into the spoil site to maintain a 12' deep ferry channel. The permit also authorizes that this spoil site can be expanded an additional .76 acres to accommodate additional dredge material if needed. In accordance with this permit,the spoil site will be inspected by the NPS resource management staff for any threatened and state species of concern prior to any material being placed on the site. The proposed work, including any future maintenance dredging or nourishment events, shall not begin until the NC DOT has been issued a Special Use Permit from the National Park Service, if one is required. Prior to submittal of this application the NC DOT sent a project narrative with drawings to US FWS,NMFS,NC DMF,NC WRC and NC SHPO in order to receive input regarding the proposed project.No concerns were raised by any of the agencies contacted and the e-mail correspondence for each has been included as part of this application.As instructed by the US FWS,the Guidelines for Avoiding Impacts to the West Indian Mantatee will be implemented during all dredging events. The equipment used for the project will include the 12"cutter head pipeline dredge,tug,barge, excavator,bulldozer, 12"HDPE pipe and any other equipment needed for maintaining the spoil site. I thought I had already replied to your earlier email. Based on current information available, the expansion at the south dock basin constitutes minor modifications to normal maintenance dredging. Minimal chance for impact to any unknown potentially eligible submerged cultural resources. Even though we're currently outside of the growing period, I wouldn't mind seeing photos from your trip tomorrow,just to provide some follow- up. Taking all of this into consideration, I don't think that the proposal will result in impacts to SAV. If it's possible and practical to do a quick visual check for SAV prior to work starting (if permitted), that would be ideal. But based on the APNEP survey, the images you've provided, and looking at Google Earth, I wouldn't expect SAV impacts and I don't think I'd need any sort of substantial SAV survey be completed. These were both taken in early October 2020. On drone 3 and the workplan drawing you can see the dredge pipe on the shoreline as a point of reference. Nothing would change or be expanded from that point to the ramps. In drone 3,the area of propose expansion is pretty much directly in front of the camera and tapers back to the original width as it approaches the pipe. Drone 5 just gives a clear shot looking from the other angle. I can walk the shoreline and get some additional photos tomorrow. Although I am sure they won't be as clear they could supplement these as current photos if that works. Especially considering that one of the most recent surveys has indicated that there isn't SAV within the basin. And with there being a survey done within the last 10 years that indicated SAV wasn't present, I'd likely be willing to compromise and not request a survey. But, having a survey done for this would provide more updated results, which could be useful for any potential emergency dredging that may need to happen. If a survey can be included and isn't a severe financial burden for the project, it would be preferential that it be done prior to dredging, and within the active growing period(April through October). The area that I'm most concerned with is the shallower areas to the west and southwest of the proposed design, as that's where DMF records show it being present at some time between 1981 and 2015. But I'd even be fine with a more informal preliminary survey being done, and the results of that being the deciding factor in whether or not to do a more in- depth survey. For an informal survey, it would really just involve visually inspecting the shallow areas for SAV. If that preliminary survey shows that SAV isn't present, I'd be fine accepting those results and not requesting any additional surveying. If it found that SAV was present, I'd probably request a more in-depth survey. Hopefully this all makes sense, and I'd be more than happy to provide any additional guidance on it. Overall, though, taking into consideration that the APNEP survey didn't find SAV within the basin, I don't think it would be much of an issue for this to proceed without a survey. It would just be preferential to know that it's absent based on a more recent survey. Again, hopefully this is helpful and not confusing, and I'd be happy to discuss survey options further, if you decide to go that route. But, to provide the most simple, direct answer, I don't foresee SAV being an issue with the proposed expansion. And thank you for reaching out during the initial stages of the application. I would honestly prefer that it happen this way, as it usually results in issues being worked out before an application goes out, and minimizes any problems we might have. As for SAV, we do have the historical record of it being present close to the 2021 proposed design. However, that's based on data from 1981 to 2015, so it might be a little dated. Additionally, looking at the APNEP 2012-2014 SAV survey results, they didn't find any SAV within the basin. If it would be possible for you to include an SAV survey in your proposal, that would be preferential for DMF,just to be on the safe side. The only other item that I can think of is dependent on the dredging and disposal method to be used. The record I've got and the APNEP survey both show SAV throughout the inlet area. With that, we would likely prefer that any dredged material disposal within waters near the inlet occur on an outgoing tide in order to minimize potential sedimentation of nearby SAV. Hello Brian, Since there is very minimal, poor quality habitat for nesting sea turtles,piping plovers, and red knots at or near the project site, we would not expect any adverse effects to those species. There is the potential for the West Indian manatee to be present from June - October. However, if our Guidelines for Avoiding Impacts to the West Indian Manatee are implemented, we would not expect any adverse effects. Good morning Gary, I am in the initial stages of putting together permit applications for expanding the dredge limits of the Southdock basin/entrance channel and wanted to touch base with you regarding any concerns the US FWS may have about the project. I included an excerpt from the project description below and attached a drawing showing the existing and proposed limits for the project area. The Southdock Ferry Terminal is used by the NCDOT Ferry Division to transport the public and supplies to and from Ocracoke Island. It is the busiest overall route within the NC ferry system carrying between 500,000 and 800,000 passengers per year, and as many as six ferries running simultaneously during the summer months.Shoaling along the western side of the basin and channel has continued to be a consistent issue that affects how the Captains navigate in and out of the basin. The current width of the channel creates unnecessary risks during the summer when all of the ferries are running, and the likelihood of sudden weather events increases.Stabilization of the spoil site shoreline has allowed for improved protection during major storms but the dynamic nature of the area,combined with the increasing frequency of significant storm events, has resulted in the need to continually assess and improve upon our management plan at Southdock. Our current permit allows for maintenance dredging up to 12'deep MLLW within the 225'limits of the existing channel. With the proposed expansion, the entrance channel would increase to 375'between points S01 and N01 on the workplan, or where it intersects with Sloop Channel. It would remain at 375'until it reaches points 502-NO2 where it starts to turn south towards the ramps. Between these points is where it would begin to taper off and gradually return to the 225'width at points 503-NO3. It would remain at 225'from that point until its termination at the ramps, or points 504-N04. The dredging depth would remain at 12'MLLW. The widening of the channel would create 2.38 acres of new channel bottom. We would have a 3:1 slope on all sides. We believe this modification would result in less frequent maintenance dredging events as the channel would be large enough to incur considerable shoaling before impacting navigational safety. " = j Raleigh Field Office �QRa� Post Office Box 33726 Raleigh,North Carolina 27636-3726 GUIDELINES FOR AVOIDING IMPACTS TO THE WEST INDIAN MANATEE Precautionary Measures for Construction Activities in North Carolina Waters The West Indian manatee (Trichechus manatus), also known as the Florida manatee, is a Federally-listed endangered aquatic mammal protected under the Endangered Species Act of 1973, as amended(16 U.S.C. 1531 et seq.) and the Marine Mammal Protection Act of 1972, as amended(16 U.S.0 1461 et seq.). The manatee is also listed as endangered under the North Carolina Endangered Species Act of 1987 (Article 25 of Chapter 113 of the General Statutes). The U.S. Fish and Wildlife Service (Service) is the lead Federal agency responsible for the protection and recovery of the West Indian manatee under the provisions of the Endangered Species Act. Adult manatees average 10 feet long and weigh about 2,200 pounds, although some individuals have been recorded at lengths greater than 13 feet and weighing as much as 3,500 pounds. Manatees are commonly found in fresh, brackish, or marine water habitats, including shallow coastal bays, lagoons, estuaries, and inland rivers of varying salinity extremes. Manatees spend much of their time underwater or partly submerged, making them difficult to detect even in shallow water. While the manatee's principal stronghold in the United States is Florida, the species is considered a seasonal inhabitant of North Carolina with most occurrences reported from June through October. To protect manatees in North Carolina, the Service's Raleigh Field Office has prepared precautionary measures for general construction activities in waters used by the species. Implementation of these measures will allow in-water projects which do not require blasting to proceed without adverse impacts to manatees. In addition, inclusion of these guidelines as conservation measures in a Biological Assessment or Biological Evaluation, or as part of the determination of impacts on the manatee in an environmental document prepared pursuant to the National Environmental Policy Act,will expedite the Service's review of the document for the fulfillment of requirements under Section 7 of the Endangered Species Act. These measures include: 1 The project manager and/or contractor will inform all personnel associated with the project that manatees may be present in the project area, and the need to avoid any harm to these endangered mammals. The project manager will ensure that all construction personnel know the general appearance of the species and their habit of moving about completely or partially submerged in shallow water. All construction personnel will be informed that they are responsible for observing water-related activities for the presence of manatees. 2. The project manager and/or the contractor will advise all construction personnel that there are civil and criminal penalties for harming, harassing, or killing manatees which are protected under the Marine Mammal Protection Act and the Endangered Species Act. 3. If a manatee is seen within 100 yards of the active construction and/or dredging operation or vessel movement, all appropriate precautions will be implemented to ensure protection of the manatee. These precautions will include the immediate shutdown of moving equipment if a manatee comes within 50 feet of the operational area of the equipment. Activities will not resume until the manatee has departed the project area on its own volition(i.e.,it may not be herded or harassed from the area). 4. Any collision with and/or injury to a manatee will be reported immediately. The report must be made to the U.S. Fish and Wildlife Service(ph. 919-856-4520), the National Marine Fisheries Service (ph. 252- 728-8762), and the North Carolina Wildlife Resources Commission(ph. 252-448-1546). 5. A sign will be posted in all vessels associated with the project where it is clearly visible to the vessel operator. The sign should state: CAUTION: The endangered manatee may occur in these waters during the warmer months, primarily from June through October. Idle speed is required if operating this vessel in shallow water during these months. All equipment must be shut down if a manatee comes within 50 feet of the vessel or operating equipment. A collision with and/or injury to the manatee must be reported immediately to the U.S. Fish and Wildlife Service (919-856-4520), the National Marine Fisheries Service (252-728-8762), and the North Carolina Wildlife Resources Commission (252- 448-1546). 6. The contractor will maintain a log detailing sightings, collisions, and/or injuries to manatees during project activities. Upon completion of the action, the project manager will prepare a report which summarizes all information on manatees encountered and submit the report to the Service's Raleigh Field Office. 7. All vessels associated with the construction project will operate at "no wake/idle" speeds at all times while in water where the draft of the vessel provides less than a four foot clearance from the bottom. All vessels will follow routes of deep water whenever possible. 8. If siltation barriers must be placed in shallow water, these barriers will be: (a) made of material in which manatees cannot become entangled; (b) secured in a manner that they cannot break free and entangle manatees; and, (c) regularly monitored to ensure that manatees have not become entangled. Barriers will be placed in a manner to allow manatees entry to or exit from essential habitat. It is estimated that approximately 60,000 cubic yards of sand is needed to restore the dunes on Highway 12 on Ocracoke and only about 40,000 cubic yards can be removed during our upcoming maintenance dredging event. During the past couple of storm events the spoil site has experienced significant erosion and the material has been deposited along the western side of the basin.The expanded permitted area would allow us to reclaim that material and use it primarily to complete the work along 12, but also utilize any remaining material for rebuilding the spoil site berm.A rough sketch has been attached and we estimate that expanding 150'on the northwest side would create approximately 1.6 additional acres of channel bottom and expanding 100'on the northwest side would create approximately 1 acre. More specific limits and amount of material to be excavated would be generated as we moved forward in the process. The widening of the channel would also have public safety impacts as it would allow for easier navigation into the basin and keep the vessels further from the sheet pile wall. Furthermore, it would cut down on the frequency of dredging events since more material could be removed from a larger area during each event.
