Dear Mr. Thornton:
The Division of Water Quality received your letter dated January 5, 2004, regarding the
acquisition of the former Swift Textiles, Incorporated facility and associated NPDES permit (NC0001406).
On February 26, 2002 Division staff met with Town and Swift representatives at the Division's
Fayetteville Regional Office to discuss the permit and future use of the facility. At that time, no final
decisions had been made as to how the Swift facility would be used by the Town (although some ideas
were brought forward). The Town and Swift explained the discharges connected to the existing plant.
Division staff discussed possible ramifications for the Town to acquire the plant (and that the existing
limits could not be retained by the Town).
The most recent permit for Swift Textiles, Incorporated was issued March 31, 1997, with a
subsequent expiration date of July 31, 2001 (this expiration date was extended to March 31, 2002).
Swift Textiles submitted an application for renewal of the permit on October 12, 2001; this was done
primarily to satisfy the renewal requirement, with the understanding that manufacturing operations
had already been discontinued at the plant. Based on this renewal application, the 1997 permit has
been administratively continued in its existing form up to this point.
The existing NPDES permit currently reflects limits for a textile facility. As discussed with the
Town previously, these limits are not appropriate for a municipal facility. In addition, this portion of the
Cape Fear River, while not currently listed as impaired, is contributing to the impairment of the River
further downstream. For this reason, the Division cannot maintain the permit "as is". This permit has
been held in abeyance for over two years and cannot be continued any longer.
The Town of Erwin must complete the following within 30 days of receipt of this letter:
• Submit a summary of future plans for the former Swift Textiles WWTP, along with timelines, and
the need for a continued NPDES permit.
• Submit an analysis documenting the costs (and outlining the needed components) to connect all
existing wastewater flows from the former Swift plant to the Town of Erwin's existing wastewater
treatment plant.
• Submit documentation on future use of the Swift Textiles water treatment plant and any
associated discharge.
• Submit proof of change of ownership along with the change in name/ownership form (which is
attached with this letter).

In regards to your July 14, 2004 correspondence concerning the status of the Town of Erwin
WWTP No. 2 NPDES Permit No. NC0001406 and related issues, the Town offers this response.
The Town of Erwin purchased the former Swift Textile facilities and properties as a result of the
unexpected closing of the Swift Textile manufacturing facilities as well as due to a desire not to
see these facilities fall into disrepair with hopes of attracting industry to fill the tremendous
economic void of losing the Town's major industry.
The Town of Erwin is currently deliberating an offer by the County of Harnett to purchase its
utility infrastructure, including the former Swift Textile facilities: With the receipt of a utility
regionalization evaluation performed by Green Engineering, PLLC, the Erwin Town Board of
Commissioners is fully involved in the decision making process. •-I fully anticipate the Erwin
Town Board of Commissioners reaching a decision in this matter within the next few months_
I request that the Division of Water Quality allow the Town of Erwin additional time to resolve
the consolidation issue prior to the submission of the requested information in your
correspondence as that if the Town of Erwin accepts the County of Harnett's offer, the ownership
and future of these facilities would no Longer reside in the hands of the Town of Erwin.
