City of Newton's Pretreatment Program
-The Headwork's Analysis was approved on 1/19/2018.
- The Long Term Monitoring Plan was approved on 8/5/2015.
-The Sewer Use Ordinance was approved on 2/11/2013.
- The Enforcement Response Plan was approved on 2/5/2020
-The Allocation Table was last updated on July 2018.
-The Industrial Waste Survey was approved on 3/4/2020.
-On Newton's IDSF, if results are BDL, then we use 'A DL as value.
-Also on Newton's IDSF, the pollutants Selenium and Fluoride are listed as Annual Testing Only
and testing is conducted to support the requirements of the LTMP and Land Application testing.
Clark Creek WWTP
-On the week of May 23, 2020, the WWTP was issued an NOV for exceeding the Effluent solids
limit due to a heavy rain event. A monetary fine was given and Newton paid. The WWTP was
back in compliance immediately after correcting the issue.
-On June 17, 2020, the WWTP was issued an NOV for exceeding the Chlorine limit No fine was
imposed and the WWTP was back in compliance immediately after correcting the issue.
-On January 6, 2021, the WWTP was issued an NOD. During a plant inspection it was found that
on November 3, 2020 we had a low pH which was a permit violation. Everything else that day
had been good but the pH probe broke on the tip and no one noticed when they checked the
Effluent pH at the end of the day.
Dental Amalgam
-Mailed out letters on January 29, 2019 to 7 dental offices that we showed listed for Newton. 1
have received all of the one-time compliance forms back to keep on file.
Technibilt, Ltd.
-Manufactures metal shopping carts and material handling equipment.
First six months- On January 24, 2020 and February 24, 2020 issued an NOV for exceeding
Flow limit. They were not in SNC and they were back in compliance immediately.
On May 27, 2020 issued an NOV for exceeding COD limit. Not in SNC and they were back in
compliance immediately after correcting issue.
Second six months- No NOV's issued. Company in compliance.
Special Metals
-Nickel Alloy Welding Materials Manufacturing
-First six months -On February 5, 2020 issued an NOV for exceeding the Chromium and Nickel
limit. They were not in SNC for Chromium and were back in compliance after correcting the
issue, but they were in SNC for Nickel. Ran an ad in the newspaper.
-On August 27, 2020 issued an NOV for failure to comply with permit required sampling for the
2id Quarter. This was their first offence and were going through a termination and hiring process
of a new person in that position. Did not impose a fine at that time. They corrected it by
sampling several months and becoming compliant.
-Second six months -On September 16, 2020, October 27,28,29, 2020 Issued NOV for Chromium
and Nickel limit violation. Not in SNC and became back in compliance with Chromium limit.
-On December 8,9,10, 2020 issued an NOV for exceeding Nickel limit. They are in SNC at this
time. I have run an ad in the newspaper and they are currently working to correct the issue and
are diligent in trying to stay in compliance.
-Placing them on a consent order for the Nickel violations.

notice. Listed below is the significant industrial user that was in Significant Non -Compliance
(SNC) with National Pretreatment Regulations 40 CFR part 403 and State Pretreatment
Regulations, 15 NCAC 2H..0900 and Local Pretreatment Regulations for the period of January
1, 2020 through June 30, 2020
Special Metals Welding Products Company was in SNC for exceeding Nickel limit. Special
Metals is working to correct the issue and there was no impact to the City of Newton's WWTP
or the environment.
