Skvarla, III Secretary DWQ # 12 -1136 Franklin County On December 19, 2012, the Division of Water Quality (Division) received your application requesting a Minor Variance from the Tar - Pamlico Riparian Buffer Protection Rules from the Division for your project. The Division has determined that your application is incomplete and cannot be processed. The application is on -hold until all of the following Information is received: 1. This Office believes that the project can be moved or reconfigured to avoid the impacts to Zone 2 of the protected riparian buffer. Please withdraw your application for impacts or provide documentation as to why the current site plan and /or future proposed building cannot be redesigned to move the parking spaces out of Zone 2. a. Because the Division believes that the project can be moved or reconfigured to avoid the impacts, a review of your proposed stormwater management plan has not been completed. 2. The U.S. Fish and Wildlife Service National Wetland Inventory is not a regulatory tool. Please provide a jurisdictional determination from the U.S. Army Corps of Engineers and include the wetland boundary on your site plans. a. If your project has impacts to jurisdictional wetlands, a 404 permit from the U.S. Army Corps of Engineers and corresponding 401 Water Quality Certification may be required. Provide documentation from the NC Ecosystem Enhancement Program (NCEEP) indicating their willingness to accept your request to purchase buffer credits to mitigation for the proposed buffer impacts listed in your application. Mitigation provider selection must conform to the requirements of G.S. 143 - 214.20. Pursuant to Title 15A NCAC 02B.0259 (9), the applicant shall furnish all of the above requested information for the proper consideration of the application. If all of the requested information is not received in writing within 30 calendar days of receipt of this letter, the Division will be unable to approve the application and it will be returned. The return of this project will necessitate reapplication to the Division for approval, including a complete application package and the appropriate fee. Please respond in writing within 30 calendar days of receipt of this letter by sending three copies of all of the above requested information to the Wetlands, Buffers, Stormwater — Compliance and Permitting (Webscape) Unit, 1650 Mail Service Center, Raleigh, NC 27699- 1650. Please be aware that you have no authorization under Section 401 of the Clean Water Act for this activity and any work done within waters of the state may be a violation of North Carolina General Statutes and Administrative Code.
