Dear Mr. Lastinger and Ms. Higgins:
S &ME, Inc. (S &ME) is submitting this application for proposed impacts to waters of the
U.S. in accordance with Department of the Army Nationwide Permit (NWP) No. 39 —
Commercial and Institutional Developments along with supporting documentation.
S &ME has been retained by the Wake County Board of Education (WCBOE), the
applicant for the proposed project, to provide services related to acquisition of the NWP
and corresponding North Carolina Water Quality Certification (WQC) pursuant to the
Clean Water Act.
The project will involve a proposed road crossing of an unnamed perennial tributary of
Richland Creek that will result in 198 linear feet of permanent stream impact by the
placement of two 72 -inch reinforced concrete pipes (RCP) to accommodate the stream
flow and associated headwall/wingwall structures and 57 linear feet of temporary impact
to accommodate the stream pump around plan and construction access. Also, the road
construction will permanently impact 11,460 square feet of Zone 1 Neuse buffer and
4,209 square feet of Zone 2 Neuse buffer and temporarily impact 1,839 square feet of
Zone 1 Neuse buffer and 1,856 of Zone 2 Neuse buffer.
In addition, there will be an installation of 8 -inch gravity fed sewer line within a 30 -foot
easement to convey wastewater from the school and associated facilities to a City of
Raleigh collection system. This sewer installation will not impact streams, wetlands, or

Zone 1 of the Neuse buffer, however will temporarily impact 4,176 square feet of the
Zone 2 Neuse buffer.

BACKGROUND INFORMATION
The location of the project area is depicted on the Grissom N.0 (1993) USGS
Topographic Map (Figure 1), and the Wake County Soil Survey Map (Figure 2), included
in Appendix II.
The purpose of the proposed project is to provide elementary school facilities to the
population surrounding Wake Forest and will involve the construction of an elementary
school and associated facilities, utilities, and a roadway extension for traffic ingress and
egress that ties into an existing road in the Wallridge Subdivision.
Arcadis performed the original wetland and stream delineation on November 28, 2007
(Northern Tract) and July 15, 2008 (Southern Tract) and conducted regulatory meetings
with the USACE (Crystal Amschler) and the NCDWQ (Lauren Witherspoon). A
NCDWQ Buffer Confirmation letter was issued on January 22, 2008. An approved
Jurisdictional Determination was issued by the USACE on January 6, 2009. Both of these
are still valid as they have not expired and are included in Appendix IV.
An updated survey was performed by Taylor Wiseman & Taylor Surveying in October of
2012 to accurately reflect all streams and wetlands on site and incorporated into the
master plan.
A pre - application meeting was conducted at the offices of S &ME on October 18, 2012, to
review the proposed project and associated impacts and to receive initial feedback from
the USACE and NCDWQ. The meeting was attended by members of the Wake County
Public School System (applicant), The Wooten Company (project engineer), McNeely

and Associates (landscape architect), S &ME (consultant/authorized agent), USACE (Mr.
James Lastinger), and NCDWQ (Mr. Ian McMillian).
PROPOSED PROJECT IMPACTS
As mentioned above, the project will involve a proposed road crossing of an unnamed
perennial tributary of Richland Creek that will result in 198 linear feet of permanent
stream impact by the placement of two 72 -inch reinforced concrete pipes (RCP) to
accommodate the stream flow and associated headwall/wingwall structures and 57 linear
feet of temporary impact to accommodate the stream pump around plan and construction
access. Also, the road construction will permanently impact 11,460 square feet on Zone 1
Neuse buffer and 4,209 square feet of Zone 2 Neuse buffer and temporarily impact 1,839
square feet of Zone 1Neuse buffer and 1,856 of Zone 2 buffer.

Plan and profile details for the proposed project are included in Appendix III. The
location of Stream 1 is depicted on the attached Figures 1 and 2 (Appendix II). No
jurisdictional wetlands will be impacted as a result of the proposed development.
PROTECTED SPECIES AND CULTURAL RESOURCES
Protected Species
S&ME's review of potential protected species habitat entailed a literature review of
existing records obtained from federal and state sources to identify documented records
of protected species. The USFWS current list of federally protected species was
consulted for a listing of protected species documented within Wake County, North
Carolina This review identified one protected plant species and two animal species.
Listed fauna and flora and their federal status are identified in Table 1. Explanations of
rankings are included at the end of the table.

As part of the literature review, S&NE also consulted the North Carolina Natural
Heritage Program NCNHP Geographic Information Systems (GIS) database Virtual
Workroom and Element Occurrence (EO) Database for a listing of EO's of endangered or
threatened species within or near the project area. This review did not identify EO's
pertaining to federally protected species within a two-mile radius of the project area.
A copy of this NWP No. 39 application will be provided to the NCNHP and the U.S. Fish
and Wildlife Service (USFWS), Raleigh Field Office on December 3, 2012 requesting
their review of records they may have in regards to the proposed project and to provide
comments regarding agency interests.
Cultural Resources
A copy of this NWP No. 39 application will be provided to the North Carolina State
Historic Preservation Office (SHPO) on December 3, 2012 requesting their review of
records regarding cultural, archaeological, or historical resources in or near the project
area and to provide written comments regarding the interests of their agency.
AVOIDANCE AND MINIMIZATION
The road extension alignment was dictated by the existing connector road alignment
( Wallridge Drive) and is within an existing City of Raleigh 40 foot wide maintained
sewer easement corridor with an aerial sewer pipe crossing. When the subdivision and
Wallridge Drive were originally permitted and constructed, the Neuse Buffer rules were
not in effect. Consequently, the road was designed planametrically in order to minimize
the amount of fill for the original development, and what resulted was a road stubbed
approximately 20 feet lower than the ground surface on the other side. This existing
condition, coupled with the Town of Wake Forest Subdivision requirements of a
maximum grade of 8% regarding road construction, has resulted in the need to excavate
15 -20 feet of existing soil on the school side of the crossing and refill and regrade to
achieve the required post — construction conditions. Since the topography on each side of
the stream is so steep and there are no wetlands impacted. Portions of the buffer have
already been impacted by the maintained sewer easement, and the existing aerial sewer
crossing will be buried as part of the road construction. The new sewer line was designed
in order to avoid any stream impacts, Zone 1 Neuse buffer impacts, or wetland impacts.
To prevent sedimentation of downstream portions of the stream, construction will be
conducted in the dry through the use of an impervious dam, a pump around, and a rip-rap
dissipator. The two 72 -inch RCP culverts were sized to accommodate the 100 -year storm
instead of the 25- year storm to reduce the chance of flooding the existing homes and/or
yards due to their low elevation.
Following construction, disturbed areas outside of the bank stabilization area will be
restored to original grade and elevation. The proposed project should not result in
permanent changes in pre- construction elevation contours or stream dimension, pattern or
profile beyond those described in this application. Excess material will be removed to a
high ground disposal area.

Appropriate sediment and erosion control practices outlined in the most recent version of
the "North Carolina Sediment and Erosion Control Planning and Design Manual" and
approved by the local governing authority (Town of Wake Forest) will be in compliance
with specifications governing the proper design, installation, operation and maintenance
of such Best Management Practices (BMP's) to comply with the appropriate turbidity
water quality standard. Sediment and erosion control measures placed in waters will be
removed and the original grade restored within two months after the Division of Land
Resources has released the project. Impacts have been avoided and minimized, and
appropriate measures will be taken during construction to allow flow and circulation
patterns of waters of the U.S. to remain unaffected. After construction, disturbed areas
will be seeded and restored.
No permanent or temporary impacts to wetlands are anticipated The two 72 -inch RCP
culverts will be buried a foot deep to allow for aquatic passage with the culvert on the
west side closest to the school allowing passage during low flows.
The proposed project will result in an impervious surface amount of 22.8% and all
stormwater from impervious surfaces will be routed to a properly sized wet detention
basin. The outflow will be connected directly to the storm drainage via the 6' diameter
storm manhole located on the road crossing culvert wingwall which eliminates the need
to provide diffuse flow through the buffer via a level spreader. See attached Exhibit
X1.02 in Appendix III for more information.
Finally, the project engineer will have the temporary construction limits of the proposed
road crossing clearly survey staked in the field, and will arrange a pre-construction site
meeting with the contractor and Mr. James Lastinger of the USACE Raleigh Regulatory
office which was requested by Mr. Lastinger during the October 18, 2012 pre - application
meeting.
MITIGATION
The proposed permanent impacts to the unnamed perennial tributary of Richland creek
due to the road crossing and culvert installation is 198 linear feet, which exceeds 150
linear feet and will require mitigation. Appendix V includes a Stream Mitigation
Confirmation letter from EBX, and stream mitigation will be provided through the EBX
sponsored Neu -Con Stream Umbrella Mitigation Bank: Howell Woods Site, in Neuse
HUC 03020201.
The proposed permanent impacts to Zone 1 and Zone 2 of the Neuse buffer is 15,669 sq.
ft. which exceeds 1/3 of an acre, and will therefore require mitigation. Appendix V
includes a Riparian Buffer Mitigation Confirmation letter from EBX, and buffer
mitigation will be provided through either the EBX Neuse Riparian Buffer Umbrella
Mitigation Bank/Rudolph Site or the Forrest Creek Riparian Buffer Mitigation Bank
located in Neuse HUC 03020201.

61. Comments: Due to the steep topography located at the proposed road crossing, and the elevation grade change limitations
of 8% required by the Town of Wake Forest Subdivision Code needed to Is into the existing Wallridge Drive,the proposed
permanent impacts to Zone 1 and Zone 2 of the Neuse Buffer will be 15,669 sq. ft. which exceeds 1/3 of an acre, and will
therefore require mitigation.
D. Impact Justification and Mtligation
1. Avoidance and Minimlzadon
1a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project.
The road extension alignment was dictated by the existing connector road alignment (Wallridge Drive) and Is within an existing
City of Raleigh 40 foot wide maintained sewer easement corridor with an aerial sewer pipe crossing. When the subdivision
and Wallridge Drive were originally permitted and constructed, the Neuse Buffer rules were not M effect. Consequently, the
road was designed planametrically in order to minimize the amount of fill for the original development, and what resulted was
a road stubbed approximately 20 That lower than the ground surface on the other side. This existing condition, coupled with
the Town of Wake Forest Subdivision requirements of a maximum grade of 8% regarding road construction, has resulted in
the need to excavate 15-20 feet of existing soil on the school sloe of the crossing and refill and regrade to achieve the
required post - construction conditions. Since the topography on each side of the stream is so steep there are no wetlands
Impacted. Portions of the buffer have already been impacted by the maintained sewer easement, and the existing aerial sewer
cossing will be buried as part of the road construction. The new sewer line was designed in order to avoid any stream impacts,
Zone 1 buffer Impacts, or wetland Impacts. To prevent sedimentation of downstream portions of the stream, construction will
be conducted in the dry through the use of a Impervious dam, a pump around, and a rip-rap dissipator. Original grades and
contours will be restored following construction. The two 72 -Inch RCP culverts were sized to accommodate the 100 year storm
instead of the 25 year storm to reduce the chances of flooding the existing homes and/or yards due to their low elevation.
1b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques.
As mentioned above, in order to prevent sedimentation of downstream portions of the stream, construction will be conducted
in the dry through the use of a impervious dike, a pump around, and a *rap dissipator. Following construction, disturbed
areas outside of the bank stabilization area will be restored to original grade and elevation. The proposed project should not
result in permanent granges in pre- construction elevation contours or stream dimension, pattern or profile beyond those
described in this application. Excess material will be removed to a high ground disposal area. Appropriate sediment and
erosion control practices outrmed in the most recent version of the "North Carolina Sediment and Erosion Control Planning
and Design Manual" and approved by the local governing authority (Town of Wake Forest) will be in compliance with
specifications governing the proper design, installation, operation and maintenance of such Best Management Practices
(BMP's) to comply with the appropriate turbidity water quality standard. Sediment and erosion control measures placed in
waters will be removed and the original grade restored within two months after the Division of Lands Resources has released
the project. Impacts have been avoided and minimized, and appropriate measures will be taken during construction to allow
flow and circulation patterns of waters of the U.S. to remain unaffected. After construction, disturbed areas will be seeded and
restored. No permanent or temporary impacts to wetlands are anticipated. The two 72 -Inch RCP culverts will be buried a foot
deep to allow for aquatic passage with the culvert on the west side closest to the school allowing passage during low flows.

Banker will notify applicant if the 396 SMU become considered "At Risk' of not being available
prior to permit issuance. Credits are not considered secured until payment in full is received
from the applicant resulting in the issuance of an Affidavit of Sale by the bank acknowledging
that the applicant has fully secured credits from the bank and the Banker has accepted full
responsibility for the mitigation obligation requiring the credits /units.
The Banker will issue the Affidavit of Sale within three (3) days of receipt of the balance of the
Purchase Price. Banker shall provide to Applicant with a copy of the Affidavit of Sale and a
documented copy of the debit of credits from the Bank Official Credit Ledger(s) showing the
permit number and the resource type secured by the applicant. A copy of the Affidavit of Sale,
