This crossing will be done as nearly to perpendicular as possible with a 48" culvert and s paved road. 4i. This stream crossing is a tributary to Phillippi Branch that divides the parcel. The types of equipment expected to be on site are an excavator, mini excavator, 20 ton dump trucks and dozer, all of which would prove beneficial in the installation of this crossing of this size. Please note that this decision does not assure that participation in the DMS in - lieu fee mitigation program will be approved by the permit issuing agencies as mitigation for project impacts. It is the responsibility of the applicant to contact permitting agencies to determine if payment to the DMS will be approved. You must also comply with all other state, federal or local government permits, regulations or authorizations associated with the proposed activity including G.S. § 143-214.11. This acceptance is valid for six months from the date of this letter and is not transferable. Work Limits: All work authorized by this permit shall be performed in strict compliance with the attached permit plans dated October 28, 2019 and revised plans submitted, which are a part of this permit. The Permittee shall ensure that the construction design plans for this project do not deviate from the permit plans attached to this authorization. Any modification to the attached permit plans must be approved by the U.S. Army Corps of Engineers (Corps) prior to any active construction in waters or wetlands. 2. Unauthorized Dredge and/or Fill: Except as authorized by this permit or any Corps -approved modification to this permit, no excavation, fill or mechanized land -clearing activities shall take place at any time in the construction or maintenance of this project, within waters or wetlands. This permit does not authorize temporary placement or double handling of excavated or fill material within waters or wetlands outside the permitted area. This prohibition applies to all borrow and fill activities connected with this project. 3. Sediment and Erosion Control: a. No fill or excavation impacts for the purposes of sedimentation and erosion control shall occur within jurisdictional waters, including wetlands, unless the impacts are included on the plan drawings and specifically authorized by this permit. This includes, but is not limited to, sediment control fences and other barriers intended to catch sediment losses. b. The Permittee shall remove all sediment and erosion control measures placed in waters and/or wetlands, and shall restore natural grades on those areas, prior to project completion. c. The Permittee shall use appropriate sediment and erosion control practices which equal or exceed those outlined in the most recent version of the "North Carolina Sediment and Erosion Control Planning and Design Manual" to ensure compliance with the appropriate turbidity water quality standard. Erosion and sediment control practices shall be in full compliance with all specifications governing the proper design, installation and operation and maintenance of such Best Management Practices in order to ensure compliance with the appropriate turbidity water quality standards. This shall include, but is not limited to, the immediate installation of silt fencing or similar appropriate devices around all areas subject to soil disturbance or the movement of earthen fill, and the immediate stabilization of all disturbed areas. Additionally, the project shall remain in full compliance with all aspects of the Sedimentation Pollution Control Act of 1973 (North Carolina General Statutes Chapter 113A Article 4). Adequate sedimentation and erosion control measures shall be implemented prior to any ground disturbing activities to minimize impacts to downstream aquatic resources. These measures shall be inspected and maintained regularly, especially following rainfall events. Conditions and requirements as a part of this approval are attached below. Copies of the draft minutes from the meeting will be available upon request prior to the next Technical Review Committee meeting. As stipulated on the financial responsibility form, you are responsible for ensuring compliance with all aspects of the approved plan and the Pitt County Soil Erosion and Sedimentation Control Ordinance Your primary objectives include, but are not limited to, preventing offsite sedimentation, preventing sediment from entering watercourses, and establishing vegetation on all disturbed areas within 7-14 calendar days, following any completion of a phase of grading. As of April 1, 2019, all new construction activities are required to complete and submit an electronic Notice of Intent (NOI) form requesting a Certificate of Coverage (COC) under the NCG010000 Construction Stormwater General Permit. This form MUST be submitted prior to the commencement of any land disturbing activity on the above named project. The NOI form may be accessed at deq.nc.gov/NCG01. Please direct questions about the NOI form to Annette Lucas at Annette.lucas(wncdenr.gov or Paul Clark at Paul.clark@ncdenr.gov. After you submit a complete and correct NOI Form, a COC will be emailed to you within three business days. Please be aware that your project will be covered by requirements of the NPDES Construction Stormwater General Permit NCG010000. Please become familiar with all the requirements and conditions of this permit in order to achieve compliance. Upon discovery of noncompliance by our office, the following actions may be taken: 1. No further permits for building or other construction will be issued. 2. The authority to continue construction, other than for erosion control measures, will be terminated. 3. Penalties of up to $5000 per day may begin to accrue. Failure to immediately comply upon notice of noncompliance will result in injunctive and/or criminal action. Other Comments: 4. This erosion control plan shall expire three years following the date of approval if no land disturbing activity has been undertaken. 5. The Division of Water Quality may pursue legal action against you in order to enforce requirements of the NPDES, Phase II permit. 6. The Pitt County Soil Erosion and Sedimentation Control Ordinance authorizes County officials to inspect sites to ensure compliance with the Sedimentation Pollution Control Act. Title 15A NCAC 4B .0118(a) requires that a copy of the approved erosion control plan be on file at the job site. Also, this letter gives the notice required by G.S. 113A-61.1(a) of our right of periodic inspection to insure compliance with the approved plan. North Carolina's Sedimentation Pollution Control Act is performance -oriented, requiring protection of existing natural resources and adjoining properties. If, following the commencement of this project, the erosion and sedimentation control plan is inadequate to meet the requirements of the Sedimentation Pollution Control Act of 1973 (North Carolina General Statute 113A-51 through 66), this office may require revisions to the plan and implementation of the revisions to insure compliance with the Act. Acceptance and approval of this plan is conditioned upon your compliance with Federal and State water quality laws, regulations, and rules. Based on the calculations submitted, this development will require the installation of three Stormwater Control Measures (SCM) consisting of wet detention ponds. 2. All proposed SCM's must meet the requirements of the Pitt County Stormwater Ordinance and must be designed according the North Carolina Stormwater Design Manual. 3. As -built plans are required following the completion of the SCM's and prior to the final plat recording. 4. The owner will be responsible for maintenance of all stormwater SCM's. A stormwater maintenance agreement is required. 5. All paperwork from NCDEQ and other agencies for riparian buffer crossings will be needed in hand at the pre -construction meeting. 6. Floodplain limits and riparian buffers should be shown on all future plats. 7. Any wetlands paperwork must be in hand at the pre -construction meeting. 8. Additional silt fence and/or other protection may be required if erosion issues occur during construction. [NCDOT] 9. The turning lane as required for the driveway permit can be postponed until the beginning of construction of phase two. The roadway improvements must be completed before construction of that phase. 10. All proposed utilities must be installed to NCDOT specifications and will be required to have executed encroachment agreements in place. The location of the sewer line has been accepted by NCDOT as should any maintenance issue arise the entire roadway will be affected due to its depth. Greenville Utilities will be responsible for any and all repairs to the ROW due to sewer line maintenance including detour routes and the potential need for construction of such. Each lot will be evaluated in accordance with rules .1940 of the Laws and Rules for Sanitary Sewage Collection, Treatment, and Disposal (15A NCAC 18A .1900). 12. No fill material (including construction spoils) is allowed on any area to be used for a sewage disposal system or 100% repair area. Any amount of fill found on these areas will be grounds for disapproval of the proposed lot. 13. The location of any proposed berms must be shown on all subsequent maps. The final dimensions of the completed berm must be shown so that the Environmental Health staff can verify that no portion of any berms will interfere with the sewage system or 100% repair locations. 14. Locations of any soil stock pilings should be shown on the construction plan. These stock pilings should be placed in an area not to be utilized for on -site sewage disposal. 15.
