a)Tax Certifications will only be processed for facilities under the authority of the DWR and only if the DWR has found that the described property:
1.Has been or will be constructed or installed;
2.Complies with or that plans therefore which have been submitted to the DWR indicate that it will comply with the requirements of the Environmental Management Commission;
3. Is being effectively operated or will,when completed,be required to operate in accordance with the terms and conditions of the permit,certificate of approval,or other document of approval
issued by the DWR;and
4.Has or,when completed,will have as its PRIMARY rather than incidental purpose the reduction of water pollution;
5.Is being used exclusively(100%)for waste treatment.

Cumberland County, NC. Clear Path Recycling LLC uses both Clear Path Recycling LLC facilities and DAK Americas LLC facilities to
treat wastewater. The equipment listed is a pre-treatment wastewater system constructed and owned by Clear Path Recycling
LLC. It was initially constructed during 2010 and is operational. This is a waste water pre-treatment facility that feeds into DAK

The Division of Division of Water Quality inspected these wastewater treatment facilities and
equipment on 3/22/2013. As of this date, based on the inspection and information supplied by the
applicant the equipment and facilities listed on the attached application that meet the following
requirements for Tax Certification are eligible.
1. The property has been,or will be, constnitted or installed;
2. The property complies with, or if still under construction will comply with,the
requirements of the EMC,
3. The property is being effectively operated,or will when completed be required to operate,
in accordance with the terms and conditions of approvals issued by the EMC; and
4. The listed property has,or when completed will have,as its primary rather than incidental
purpose the reduction of water pollution resulting from the discharge of sewage or waste.
Items listed that are NOT eligible for Tax Certification are item#20 which is no longer present.
Please note that as part of this Tax Certification process, the DENR-DWQ staff did not make any
efforts to confirm either the cost of the items certified or the year of their acquisition. This Facility
was previously Tax Certified by the Solid Waste Section on 8/15/2011 and 9/19/2011.
