3. Project Description
3a. Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this
application:
Initial phases of this development were done by the previous owners. No previous permits were known to be required as
the development occurred in upland areas. The remaining property is currently forested with an existing Gas Line
Easement that bisects the property on an east -west axis. The surrounding area is comprised primarily of existing
residential subdivisions as well as commercial development along the nearby NC 42 corridor.
3b. List the total estimated acreage of all existing wetlands on the property:
0.136
3c. List the total estimated linear feet of all existing streams (intermittent and perennial) on the property:

3d. Explain the purpose of the proposed project:
The purpose of the proposed project will be to complete the Villages at Cleveland Springs development. This will include
the necessary roadway infrastructure, utilities, etc. required for a residential subdivision.
3e. Describe the overall project in detail, including the type of equipment to be used:
As described above, initial phases of this development were done by the previous owners. With the market downturn in
recent years, the prior owners abandoned the site. The current owners wish to complete the development as was
originally proposed. The project will require two utility impacts to riparian stream buffers associated with two aerial sewer
installations. All remaining streams and wetlands on the property have been avoided. Typical equipment such as dump
trucks, front end loaders, backhoes, etc. will be utilized to complete the proposed residential development.

D. Impact Justification and Mitigation
1. Avoidance and Minimization
1a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project.
The applicant requested a detailed delineation of streams and wetlands prior to site plan development in order to
determine the extent and location of streams and wetlands on the subject property. The subject site contains
several intermittent and perennial streams and associated riparian wetlands. The applicant has avoided temporary
impacts associated with the utility line installation by providing two aerial crossings. The riparian buffer impacts are
necessary to install the piers associated with the aerial line. Additionally, the 20 -foot wide maintenance corridor will
be maintained in grass or other such shrub -like vegetation.
1b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques.
Orange protective silt fencing will be placed outside of the impacted sewer corridor to ensure protection of the non -
impacted riparian areas.
2. Compensatory Mitigation for Impacts to Waters of the U.S. or Waters of the State
2a. Does the project require Compensatory Mitigation for
impacts to Waters of the U.S. or Waters of the State?
❑ Yes No
As the proposed permanent impacts to wetlands are well
below 1 /10th of an acre, we do not believe compensatory
mitigation should be required for this project.
2b. If yes, mitigation is required by (check all that apply):

within one of the NC Riparian Buffer Protection Rules?
1 b. If yes, then is a diffuse flow plan included? If no, explain why.
Comments: There are no proposed discrete points of discharge for this project. All
stormwater is being collected and routed to the two proposed stormwater wet ponds
on the site. Level spreaders are incorporated as part of the SMP BMP design in
❑ Yes ® No
order to meet the TSS, TP and TN removal as required. The level spreaders are
part of the overall SMP and not standalone devices, and as such, do not require a
separate DWQ review and approval. Therefore, the Diffuse Flow Plan will be
incorporated into the Stormwater Management Plan (SMP) which is being reviewed
by Johnston County, a Certified Local Government.
2. Stormwater Management Plan
2a. What is the overall percent imperviousness of this project?
20.6%
2b. Does this project require a Stormwater Management Plan?
® Yes ❑ No
2c. If this project DOES NOT require a Stormwater Management Plan, explain why:
2d. If this project DOES require a Stormwater Management Plan, then provide a brief, narrative description of the plan:
While the project does not require an SMP for the purposes of this Buffer Authorization Request, Johnston County will
require an SMP for the development to comply with local stormwater control ordinances. The SMP proposes 2
stormwater wet ponds to treat the stormwater generated by this project. As Johnston County is a "Certified Local
Government* (CLG) by DWQ, they will be handling the review and approval of the proposed SMP.

2. Violations (DWQ Requirement)
2a. Is the site in violation of DWQ Wetland Rules (15A NCAC 2H .0500), Isolated
Wetland Rules (15A NCAC 2H .1300), DWQ Surface Water or Wetland Standards,
❑ Yes ® No
or Riparian Buffer Rules (15A NCAC 2B .0200)?
2b. Is this an after - the -fact permit application?
❑ Yes ® No
2c. If you answered "yes" to one or both of the above questions, provide an explanation of the violation(s):
3. Cumulative Impacts (DWQ Requirement)
3a. Will this project (based on past and reasonably anticipated future impacts) result in
0 Yes ® No
additional development, which could impact nearby downstream water quality?
3b. If you answered "yes" to the above, submit a qualitative or quantitative cumulative impact analysis in accordance with the
most recent DWQ policy. If you answered "no," provide a short narrative description.
We have reviewed the "DRAFT Internal Policy, Cumulative impacts and the 401 Water Quality Certification and Isolated
Wetland Programs" document prepared by the NC Division of Water Quality on April 10, 2004, version 2.1. The draft
states that most residential subdivisions are unlikely to cause cumulative impacts. This project does not meet any of the
three criteria of private projects that can clearly result in cumulative impacts. The proposed suburban in -fill development
is relatively small in nature, is within a residentially and commercially developed landscape bounded by existing home -
sites and a municipal land -fill and therefore, the utility infrastructure (i.e. water and electricity) are already in place to
service the proposed development. We anticipate that DWQ will advise us if a qualitative or quantitative impact analysis
is required.
4. Sewage Disposal (DWQ Requirement)
4a. Clearly detail the ultimate treatment methods and disposition (non - discharge or discharge) of wastewater generated from
the proposed project, or available capacity of the subject facility.
The development will connect to existing sewer lines. Johnston County will insure that the capacity of their treatment
facility will not be exceeded.

impacts?
El Raleigh
5c. If yes, indicate the USFWS Field Office you have contacted.
❑ Asheville
5d. What data sources did you use to determine whether your site would impact Endangered Species or Designated Critical
Habitat?
The NC- Natural Heritage Programs Virtual Workroom was used to search for elemental occurrences of state and
federally protected species in the vicinity of the project. The Dwarf Wedgemussel (Alasmidonta heterodon) is the only
Federally listed Endangered Species within the 2-mile radius search of the project center. Other State species (either
threatened or endangered) within a 2-mile radius of the project center include the Triangle Floater (Alasmidonta
undulate), the Yellow Lance (Elliptio lanceolsta), the Roanoke Slabshell (Elliptio roanokensis), the Atlantic Pigtoe
(Fusconaia masoni), the Eastern Lampmossel (Lampsilis radiate) and the Creeper (Strophitus undulates).
6. Essential Fish Habitat (Corps Requirement)
6a. Will this project occur in or near an area designated as essential fish habitat?
❑ Yes ® No
6b. What data sources did you use to determine whether your site would impact Essential Fish Habitat?
The proposed project is in Johnston County which is not near any coastal or tidal habitat that would support EFH (i.e. salt
marshes, oyster reefs, etc.)
7. Historic or Prehistoric Cultural Resources (Corps Requirement)
7a. Will this project occur in or near an area that the state, federal or tribal
governments have designated as having historic or cultural preservation
