Wet ponds alone meet the TSS and TP removal but only have a 25% TN removal efficiency. The purpose of these level spreaders are for pollutant removal in order to get the additional TN removal, to meet the stormwater requirements of the Certification. That said, these level spreaders are one component of a treatment train within the SMP that will be reviewed and Approved by the Town of Apex. Is this not a duplication of effort? To have you review the level spreaders for diffuse flow, and then the Town review them to meet the 401 Stormwater Management program requirements? Not to mention, only one of the level spreaders out of the 4 being designed is directed towards a riparian buffer, the other 3 are being directed towards wetlands. If the DWQ is ready to approve the diffuse flow plan prior to the Town's approval of the stormwater plan, then we will be happy to issue a conditional approval. The only items of information requested is associated with a Stormwater Management Plan. The project is located within the Town of Apex, which is a Jurisdiction Certified for 401 Stormwater Management Plan review. To date, the project has not received a Stormwater Management Plan Approval from the Town of Apex however it is anticipated, in the near future. If the Avoidance and Minimization has been met for the project, why are we holding up the 401 Approval for Stormwater questions /concerns when the project is located within a Jurisdiction Certified for 401 Stormwater Management Plan review? Stormwater Management Plan (SMP) Approval From Local Community Required You are required to provide one copy of the approved SMP, including plan details on full -sized plan sheets, with proof of the town of Apex's approval. The approved SMP must be submitted to the DWQ Webscape Unit (1650 Mail Service Center, Raleigh, NC 27699 -1650) before any impacts authorized in this certification occur. The following requirements also apply: • The approved SMP must be constructed and operational before any permanent building or other structure is occupied at the site. • The approved SMP as well as drainage patterns must be maintained in perpetuity. • The SMP may not be modified without prior written authorization from the town of Apex. A copy of the approval letter and the modified SMP must be submitted to the DWQ Webscape Unit prior to the commencement of the modifications.
