Dear Mr. Johnson:
In accordance with the request for discharge permit application received on February 3. 1998, the
Division is foneardine herewith the subject state - NPDES permit. This permit is issued pursuant to the
requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between
North Carolina and the U.S. Environmental Protection Auenev dated December 6. 1983.
The following modifications have been included in the final permit:
• The addition of a quarterly monitoring requirement for the parameters of total nitrogen
and total phosphorus. This requirement has been added for the compilation of nutrient
data prior to the development of a nutrient management strategy for High Rock Lake
located in the Yadkin River Basin. This monitoring requirement has been added to
several dischargers within the subbasins above High Rock Lake.
• The addition of an effluent monitoring requirement for temperature. This requirement
has been added as a required test and measurement per 15A NCAC 2B .0508 (d).
Changes made since the draft permit mailed on September 8, 1999:
• The correction of the measurement frequency to continuous and the sample type to
recording for the flow parameter. These are the same monitoring requirements as in the
previous permit issued in September 1994.
• The deletion of upstream and downstream monitoring for conductivity and fecal coliform.
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you. you have the right to an adjudicatory hearing upon written request within thirty (30)
days following receipt of'this letter. This request must be in the form of a written petition, conforming to
Chapter I50B of the North Carolina General Statutes, and filed with the office of Administrative Hearings,
Post Office Drawer 27447. Raleigh, North Carolina 27611-7447. Unless such a demand is made, this permit
shall be final and binding.

governmental permits may be required.

I. Continue to operate a 0.030 MGD wastewater treatment facility consisting of a
comminutor, parallel extended aeration basin, parallel clarifiers, dosing tank, two
surface sandfilters, tablet-type chlorinator, tablet-type dechlorinator, chlorine
contact chamber and step aeration. The facility is located DOT I-77 Rest Area, on
Interstate 77, southeast of Lambsburg, Sury County, and

into Naked Run. which is classified WS-IV Trout waters in the Yadkin-Pee Dee
River Basin.

SPECIAL CONDITIONS
A (2). CHRONIC "TOXICITY PERlvill' LIMIT (QUARTERLY)
The effluent discharge shall at no time exhibit observable inhibition of reproduction or
significant mortality to Ceriodaphnia dubia at an effluent concentration of 13.0%.
The permit holder shall perform at a minimum, quarterlu monitoring using test procedures
outlined in the "North Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure." Revised
February 1998. or subsequent versions or "North Carolina Phase ❑ Chronic Whole Effluent
Toxicity Test Procedure- (Revised-February 1998) or subsequent versions. The tests will be
performed dur ng the months of February. May. August, and November. Effluent sampling for
this testing shall be performed at the NPDES permitted final effluent discharge below all
treatment processes.
If the test procedure performed as the first Lest of any single quarter results in a failure or ChV
below the permit limit, then multiple-concentration testing shall be performed at a minimum.
in each of the two following months as described in "North Carolina Phase 11 Chronic Whole
Effluent Toxicity Test Procedure' (Revised-February 1998) or subsequent versions.
The chronic value for multiple concentration tests will be determined using the geometric mean
of the highest concentration having no detectable impairment of reproduction or survival and
the lowest concentration that does have a detectable impairment of reproduction or survival.
The definition of -detectable impairment.- collection methods, exposure regimes, and further
statistical methods are specified in the "North Carolina Phase II Chronic Whole Effluent
Toxicity Test Procedure" (Revised-February 1998) or subsequent versions.
All toxicity testing results required as part of this permit condition will be entered on the
Effluent Discharge Monitoring Form (MR-1) for the months in which tests were performed,
using the parameter code TGP3B for the pass/fail results and THP313 for the Chronic Value.

Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Branch
no later than 30 days after the end of the reporting period for which the report is made.
Test data shall be complete. accurate, include all supporting chemical/physical measurements
and all concentration/response data, and be certified by laboratory supervisor and ORC or
approved designate signature. Total residual chlorine of the effluent toxicity sample must be
measured and reported if chlorine is employed for disinfection of the waste stream.
Should there be no discharge of flow from the facility during a month in which toxicity
monitoring is required, the permittee will complete the information located at the top of the
aquatic toxicity (AT) test form indicating the facility name, permit number, pipe number,
county, and the month/year of the report with the notation of "No Flow" in the comment area
of the form. The report shall be submitted to the Environmental Sciences Branch at the
address cited above.

Should the permittce fail to monitor during a month in which toxicity monitoring is required,
monitoring will be required during the following month.
Should any test data from this monitoring requirement or tests performed by the North
Carolina Division of water Quality indicate potential impacts to the receiving stream, this
permit may be re-opened and modified to include alternate monitoring requirements or limits.
NOTE: Failure to achieve test conditions as specified in the cited document. such as minimum
control organism survival, minimum control organism reproduction, and appropriate
environmental controls, shall constitute an invalid test and will require immediate follow-up
testing to be completed no later than the last day of the month following the month of the
initial monitoring.

NC DOT 1-77 Rest Area is requesting renewal of existing permit. This is upstream of the
Va DOT 1-77 Rest Area. Discharges into Naked Run Branch. This stream is not on the
303d list for impaired streams in the Yadkin River Basin. Facility is permitted for 0.030
MGD with limits of:

This rest area has a chronic toxicity test of 13%, in FEB MAY AUG NOV.
Review of compliance data indicated that facility appears to be well operated. It has met
all limits consistently for the past two years. There were some exceedences of the TSS
and NH3 limits in 1996. However, 1998 data seems to indicate improvements were made
and the plant is meeting current limits with no problems.
Recommend renewal of the permit with all existing limits. All parameters and
monitoring frequencies remain the same.

Summary
NC DOT—I-77 Rest Area is requesting renewal of its existing NPDES
permit. The receiving stream, Naked Rum Branch, is not on the 303d list for
impaired streams. Review of compliance data indicates no real problems
with plant. Plant appears to be well operated. Has consistently passed the
chronic toxicity test, however there was no report in May 1999. Recommend
renewal of existing effluent limits.

Dear Mr. Weaver:
The N. C. Department of Environment and Natural Resources has advised us by letter of
November 10, 1998 that the NPDES permit for the 1-77 Surry'Couniy WC/RA, Permit No.
NC 0029190, will expire on June 30, 1999.
This is to request a permit renewal for the NPDES permit at this facility. We do not
anticipate any major changes in this system. Sludge removal from this treatment plant is by private
license septage hauler. Quotations are requested from private haulers within the area and purchase
orders are issued by DOT Purchasing Unit. The licensed private hauler is required to furnish a
certification, along with the invoice, that the material was properly disposed of in an approved system.
The discharge point will not change and the volume may increase slightly.
Attached are three copies of the completed renewal application form along with
check #364977 in the amount of $200.00 for payment of the NPDES permit renewal processirtg fee.
Your attention and consideration of this request will be greatly appreciated.

By cover letter dated June 30, 1994, the subject facility was issued NPDES Permit
No. NCO029190 with an effective date of August 1, 1994, and expiration date of June 30,
1999. Upon review of the permit a discrepancy was noted in the M3 page and the
conditions page of the permit. The M3 page of the permit indicates that toxicity testing
information is found in Part III, Condition D. However, the conditions page indicates
toxicity testing information is found in Part III, Condition E. It is the recommendation of
this office that the M3 page be modified to read "Chronic Toxicity (Ceriodaphnia) P/F at
13%: February, May, August, and November; See Part III, Condition E.
I appreciate your assistance to undertake the necessary steps to modify the existing
permit and incorporate the recommendation cited above. Should you have any questions,
