The Division of Water Quality(the Division) hereby issues the attached NPDES permit for the subject
facility. This permit is issued pursuant to the requirements of North Carolina General Statute 143-
215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental
Protection Agency dated October 15, 2007, or as subsequently amended.
Changes to Your Previous Permit—Based on new surface water-quality stream standards, DWQ has
replaced monitoring for Phenol (single compound)with Total Phenolic Compounds required of
discharges to Water Supply(WS) waters. The Division has also removed previous Special Condition A.
(4.)for Methyl Tertiary Butyl Either(MTBE). We will evaluate future MTBE compliance based on
new surface-water standards for Human Health of 1500 µg/L, and Water Supply(WS) at 19µgIL.
Please note that BTEX sampling events should coincide with annual WET test sampling [see Sections
A. (L) and A..(2.)]. Finally, we have updated your facility description and site map,adding parameter
codes to permit Sections A. (1.) and A. (2.) for your convenience.
Permit Changes from Draft to Final -- We have updated text regarding Whole Effluent Toxicity (WET)
testing to clarify Sections A. (L),A. (2.), and A. (3.). Please review these to insure your understanding
of conditions required to maintain WET test monitoring frequency.
If any parts, measurement frequencies, or sampling requirements contained in this permit are
unacceptable, you have the right to an adjudicatory hearing, upon written request submitted within
thirty(30) days after receiving this letter. Your request must take the form of a written petition
conforming to Chapter 150B of the North Carolina General Statutes, and you must file it with the

in accordance with effluent limitations, monitoring requirements, and other conditions set forth in Parts
I, II, III and IV hereof.
This permit shall become effective August 1, 2013.
This permit and authorization to discharge shall expire at midnight on March 31, 2018.

All previous NPDES Permits issued to this facility, whether for operation or discharge are hereby
revoked, and as of this issuance, any previously issued permit bearing this number is no longer effective.
Therefore,the exclusive authority to operate and discharge from this facility arises under the permit
conditions,requirements, terms, and provisions described herein.
TransMontaigne Operating Company, LP
is hereby authorized to:
1. continue to operate existing Water Pollution Control Systems, located at the TransMontaigne
Selma Terminals,North and South, 2600 West Oak Street, Selma, Johnston County, whereby the
Permittee may
2. continue to collect all North Terminal loading rack stormwater,pump-pad stormwater, and
washdown wastewater, and hold same for permitted transport and disposal off-site, and continue
to collect hydrostatic tank-test water and stormwater runoff from the North Terminal AST
containment area and paved areas, and rout same to Outfall 003, and
3. continue to collect stormwater runoff from the South Terminal AST containment area,
hydrostatic tank-test water,and stormwater from the South Terminal rail-car loading area,and
rout same to a lined lagoon and oil/water separator at Outfall 002,then
4. discharge from the above treatment works at the South Terminal via Outfall 002,and at the
North Terminal via Outfall 003, as located on the attached map, into an unnamed tributary to
Mill Creek [stream segment 27-40], a waterbody currently classified WS-1V;NSW within
subbasin 03-04-02 of the Neuse River Basin.

A. (3.) ACUTE TOXICITY MONITORING - LIMITED (ANNUAL)
ACUTE TOXICITY MONITORING (EPISODIC)
Petroleum Bulk Storage
The Permittee shall conduct quarterly acute toxicity tests [except when relaxed to Annual monitoring]
using protocols defined as definitive in E.P.A. Document EPA160014-901027 entitled"Methods for
Measuring the Acute Toxicity of Effluents to Freshwater and Marine Organisms." The monitoring shall
be performed as a Fathead Minnow(Pimephales promelas) 24-hour static test. Effluent samples for self-
monitoring purposes must be obtained below all waste treatment. The tests will be performed on a
discharge event during each quarter(January-March,April-June,July-September, October-
December), except when relaxed to Annual monitoring_
Should there be no discharge of flow from the facility during a quarter in which toxicity monitoring is
required, the Permittee will complete the information located at the top of the aquatic toxicity (AT)test
form indicating the facility name,permit number,pipe number, county, and the month/year of the report
with the notation of"No Flow"in the comment area of the form. The report shall be submitted to the
Environmental Sciences Section at the address cited below.
The parameter code for this test is TAE6C. All toxicity testing results required as part of this permit
condition will be entered on the Effluent Discharge Form (MR-1)for the month in which it was
performed, using the appropriate parameter code. Additionally, DWQ Form AT-1 (original) is to be sent
to the following address:

Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Section no later
than 30 days after the end of the reporting period for which the report is made.
Test data shall be complete and accurate and include all supporting chemical/physical measurements
performed in association with the toxicity tests, as well as all dose/response data. Total residual chlorine
of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of
the waste stream.
Should any test data from either these monitoring requirements or tests performed by the North Carolina
Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re-
opened and modified to include alternate monitoring requirements or limits.
NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control
organism survival and appropriate environmental controls, shall constitute an invalid test and will
require immediate follow-up testing to be completed no later than the last day of the month following the
month of the initial monitoring.

RESPONSE:
I have reviewed the draft permit and determined that the proposed discharge is not located
sufficiently close to any existing or known proposed public water supply intake so as to create an
adverse effect on water quality. The DWR concurs with the issuance of this permit provided the
Permittee properly operates and maintains the facility;the Permittee meets the stated effluent limits
prior to discharge; and the discharge does not contravene the designated water quality standards.
X I concur with issuance of the above permit provided the following conditions are met:

Facility Summary
This facility confines stormwater and maintenance wastewater behind bermed areas [dikes]. These
dikes are equipped with drain pipes controlled by hand-operated valves, normally closed. This
controlled discharge constitutes a point source to the environment. Moreover, because this facility

excluded from coverage under conventional stormwater regulations, therefore historically
permitted as an individual NPDES permit, Class 1.
WET Testin>;—This permit requires Acute Whole Effluent Toxicity (WET) testing using Fathead
Minnow(Pimephales promelas), 24-hr definitive, LC-50 >100% [TAE6C]. Since last renewal
(April 2008) the Permittee reports all WET testing as "PASS" in 8 of 8 samples at Outfall 002; 5
of 5 samples at Outfall 003. Acute WET testing frequency was relaxed to Annually prior to the
previous permit cycle—no changes recommended.

Outfall 002: Stormwater runoff from the South Terminal AST containment area, hydrostatic
tank-test water and stormwater from the South terminal rail-car loading area, is routed to a
lined lagoon (divided) from the facility. Stormwater from the railcar loading area and the AST
containment area are segregated in the lagoon and do not commingle within the lagoon.
Outfall 003: Stormwater runoff from the North Terminal AST containment area, paved areas,
and hydrostatic tank-test water.
North Terminal loading rack stormwater, pump-pad stormwater and washdown wastewater are
routed to a PCW tank (petroleum contact water) for eventual transport and disposal off-site.
These waters are not discharged through Outfall 003.
