This permit is issued pursuant to the requirements of North Carolina General Statute 143- 215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated October 15, 2007, or as subsequently amended. Changes to Your Previous Permit—Based on new surface water-quality stream standards, DWQ has replaced monitoring for Phenol (single compound)with Total Phenolic Compounds required of discharges to Water Supply(WS) waters. The Division has also removed previous Special Condition A. (4.)for Methyl Tertiary Butyl Either(MTBE). We will evaluate future MTBE compliance based on new surface-water standards for Human Health of 1500 µg/L, and Water Supply(WS) at 19µgIL. Please note that BTEX sampling events should coincide with annual WET test sampling [see Sections A. (L) and A..(2.)]. Finally, we have updated your facility description and site map,adding parameter codes to permit Sections A. (1.) and A. (2.) for your convenience. Therefore,the exclusive authority to operate and discharge from this facility arises under the permit conditions,requirements, terms, and provisions described herein. ACUTE TOXICITY MONITORING - LIMITED (ANNUAL) ACUTE TOXICITY MONITORING (EPISODIC) Petroleum Bulk Storage The Permittee shall conduct quarterly acute toxicity tests [except when relaxed to Annual monitoring] using protocols defined as definitive in E.P.A. Document EPA160014-901027 entitled"Methods for Measuring the Acute Toxicity of Effluents to Freshwater and Marine Organisms." The monitoring shall be performed as a Fathead Minnow(Pimephales promelas) 24-hour static test. Effluent samples for self- monitoring purposes must be obtained below all waste treatment. The tests will be performed on a discharge event during each quarter(January-March,April-June,July-September, October- December), except when relaxed to Annual monitoring_ Should there be no discharge of flow from the facility during a quarter in which toxicity monitoring is required, the Permittee will complete the information located at the top of the aquatic toxicity (AT)test form indicating the facility name,permit number,pipe number, county, and the month/year of the report with the notation of"No Flow"in the comment area of the form. The report shall be submitted to the Environmental Sciences Section at the address cited below. The parameter code for this test is TAE6C. All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Form (MR-1)for the month in which it was performed, using the appropriate parameter code. Additionally, DWQ Form AT-1 (original) is to be sent to the following address: Attention: North Carolina Division of Water Quality Environmental Sciences Section 1621 Mail Service Center Raleigh,N.C. 27699-1621 Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Section no later than 30 days after the end of the reporting period for which the report is made. Test data shall be complete and accurate and include all supporting chemical/physical measurements performed in association with the toxicity tests, as well as all dose/response data. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should any test data from either these monitoring requirements or tests performed by the North Carolina Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re- opened and modified to include alternate monitoring requirements or limits. These dikes are equipped with drain pipes controlled by hand-operated valves, normally closed. This controlled discharge constitutes a point source to the environment. Moreover, because this facility stores fuel hydrocarbons at the ground surface in excess of one (1) million gallons, it is specifically excluded from coverage under conventional stormwater regulations, therefore historically permitted as an individual NPDES permit, Class 1. WET Testin>;—This permit requires Acute Whole Effluent Toxicity (WET) testing using Fathead Minnow(Pimephales promelas), 24-hr definitive, LC-50 >100% [TAE6C]. Since last renewal (April 2008) the Permittee reports all WET testing as "PASS" in 8 of 8 samples at Outfall 002; 5 of 5 samples at Outfall 003. Acute WET testing frequency was relaxed to Annually prior to the previous permit cycle—no changes recommended.
