Dear Ms. Castleberry:
Mr. Howard Goldman of Amerada Hess Corporation (the former owner of the permitted facility)
originally requested this permit renewal. The lengthy delay in renewal of the permit is primarily due to
its location in the environmentally sensitive Neuse River Basin. A prolonged discussion over nutrient
monitoring and TMDL development was complicated by a request for a public hearing on all Neuse
River basin permits by the Neuse River Foundation(NRF). Subsequent negotiations between the
Division and NRF have resulted in an agreement to renew permits least likely to discharge nutrients
(oil terminals, water treatment plants, etc.). Therefore, permit NC0003549 has been finalized.
Your ownership change request arrived prior to reissuance of the subject permit. In
accordance with the application for a discharge permit received on January 15, 1998, and your
request for change of ownership received June 18, 1999, the Division is forwarding herewith the
subject NPDES permit. This permit is issued pursuant to the requirements of North.Carolina General
Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S.
Environmental Protection Agency dated December 6, 1983.
As was agreed upon during earlier conversations between Mr. Goldman and Paul Clark
{formerly of our NPDES Unit staff}, two.permits have been combined into one. The permit for the
Selma North Terminal (NC0076589) has been incorporated into the permit for the South Terminal
(NC0003549) as outfall 003. Permit NCO076589 will be rescinded after the effective date of
renewed permit NC0003549.
Other changes to the permit are the result of either the DWg oil terminal permitting
requirements or the Neuse River Basin Nutrient Sensitive Waters (NSW) Management Strategy. Those
changes are explained in the following paragraphs. Please refer to the Effluent Limitations and
Monitoring Requirements pages of the permit as you read the following text.
Oil Terminal Permitting Guidance
In 1996, the Division developed standard permitting requirements for all terminals in North
Carolina. As oil terminal permits are submitted to the Division for renewal, the requirements are
implemented. Monitoring at outfall 002 already reflects these requirements because this outfall was
added after the requirements were developed.

EPA Methods 624/625 series is one of the standard requirements, The 624/625 series is a
comprehensive list of over 100 compounds. This requirement allows the Division to identify the
compounds (on the 624/625 list) discharged by the terminals.
Ethylbenzene is included in the 624/625 series and specific monitoring for this parameter has
been eliminated from the permit. MTBE is not included in the 624/625 series and is not believed to be
present in oil terminal discharges; thus monitoring is not required for this parameter.
Statistical analyses were conducted on effluent data for benzene, toluene, lead, turbidity, and
oil and grease. At outfall 001, analytical results indicated that all these parameters had the potential
to violate the water quality standard and thus, they are all limited at this location. At outfall 003,
analyses results indicated that benzene, toluene, and oil and grease, whereas turbidity did not (lead
was not monitored at this outfall) thus, these three parameters are limited at this location.
Phenol and chlorinated phenols are separate and distinct and should not be grouped in the
same category when determining discharge limits (as has been inadvertently done in the past). Phenol
is a common component of petroleum compounds stored in terminals, can result in tainting of fish
tissue, and can cause taste and odor (organoleptic) problems in drinking water. There is no water
quality standard for phenol, although phenol discharged from terminals can combine with chlorine in
water treatment facilities to form chlorinated phenols for which there is a state water quality standard
of 1.0 µg/1.
Minimizing the discharge of phenol into water supply classified waters could reduce chlorinated
phenol formation and their concentration in drinking water. As a result of the possible occurrence of
phenol in oil terminal facility discharges and the possibility of chlorinated phenol formation, phenol is
monitored (but not limited) on a monthly basis at those terminals that discharge to water-supply
classified waters.
There is limited toxicity data for chlorinated phenols, and the 1.0 µg/1 standard protects water
supplies from taste and odor problems. Monitoring for certain chlorinated phenols will occur under
EPA 624/625 for all oil terminal discharges. If one or more chlorinated phenols are detected at
concentrations greater than 50 µg/1, additional monitoring will be required of those terminals that
discharge to water-supply classified waters.
Neuse River Basin NSW Management Strategy
Implementation of the Neuse River Basin NSW Management Strategy requires Total Nitrogen
and Total Phosphorus monitoring for all individually permitted facilities that discharge to surface.
waters in the Neuse River Basin. A special condition has also been added to the permit that explains
some of the calculations associated with the new nutrient monitoring requirements.
May 19, 1998 Letter Concerns
In a letter dated May 19, 1998 (copy attached), Mr.-Goldman raised several concerns pertaining
to the draft permit. The Division concurred with items 1-5 and the permit has been-revised "
accordingly.
The Division anticipated item 6 (parts 1 and 2) based on previous conversations between Dean
Blahaus (Advent) and Paul Clark. The Division will study this point further, but will not modify the
permit limits as requested. A standard procedure for calculating limits is used for all facilities which
discharge to surface waters across the entire state. A policy change would be required if the Division
were to change the method it uses to calculate limits. Policy changes are usually the result of much
study and investigation and are applied to all applicable facilities. If a policy change occurs, DWQ will
modify all permits to which the change applies.
The average flow of the unnamed tributary to Mill Creek is also equal to zero. Thus, the
would be the same whether the 7Q 10, 30Q2, or average flow was used.
A compliance schedule was requested to allow potential treatment system changes prior to the
implementation of the new permit limits. This request has not been granted, as it is DWQ policy that a
schedule may be given to facilities for modifications only necessary because of new permit limits. It is
only outfal1001 that has new limits for benzene, toluene, and lead. Outfalls 002 and 003 do not have
new limits. Mr. Goldman had subsequent discussions with Mr. Clark on this issue and sent a letter
dated September 29, 1998 (copy attached), proposing several options for changes in treatment at the
subject facility. No request for an Authorization to Construct was received by DWQ. If you wish to
pursue any of the options suggested in his letter, please contact the NPDES Unit.
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty
(30) days following receipt of this letter. This request must be in the form of a written petition,
conforming-to Chapter 150B of the North Carolina General Statutes, and filed with the Office of
Administrative Hearings, Post Office Drawer 27447, Raleigh, North Carolina 27611-7447. Unless such
demand is made, this decision shall be final and binding.
Please note that this permit is not transferable except after notice to DWQ. DWQ may require
modification or revocation and reissuance of the permit. This permit does not affect the Iegal
requirements to obtain other permits which may be required by the Division of Water Quality or
permits required by the Division of Land Resources, the Coastal Area Management Act or any other
Federal or Local governmental permit that may be required.

A. (4.) TOTAL NITROGEN MONITORING
The Permittee shall calculate annual total nitroge-_:�'::,iass loading as the sum of monthly loadings,
according to the following equations:
(1) Monthly Loading t1b) = Days x TN x Qw x 8.34
where:
Days = the number of discharge days in that month
TN = the average total nitrogen concentration (mg/1) of the grab samples collected during the month
Qw= the average daily waste flow (MGD) for the month
8.34= conversion factor, from (mg/l x MGD) to pounds
The annual mass loading is the sum of the monthly loadings:

The Permittee shall report the total nitrogen concentration for each sample and the monthly mass loading
in the appropriate monthly self-monitoring report; the annual total nitrogen mass loading shall be
reported in the self-monitoring report for December of each year.
A. (5.) ACUTE TOXICITY MONITORING (Annual)
The permittee shall conduct annual toxicity tests using protocols defined in U.S. EPA Document
EPA/600/4-90/027 entitled "Methods for Measuring the Acute Toxicity of Effluents to Freshwater and
Marine Organisms." The monitoring shall be performed as a Fathead Minnow (Pimephales promelas)24-
hour static test. Effluent samples for self-monitoring purposes must be obtained below all waste
treatment. The permittee will conduct one test annually, with the annual period beginning in January of
the calendar year of the effective date of the permit. The annual test requirement must be performed and
reported by June 30. If no discharge occurs by June 30, notification will be made to the Division by this
date. Toxicity testing will be performed on the next discharge event for the annual test requirement.
The parameter code for this test is TAE6C. All toxicity testing results required as part of this permit
condition will be entered on the Effluent Discharge Form (MR-1) for the month in which it was performed,
using the appropriate parameter code. Additionally, DWQ Form AT-1 (original) is to be sent to the following

Test data shall be complete and accurate and include all supporting chemical/physical measurements
performed in association with the toxicity tests,.as well as all dose/response data. Total residual chlorine
of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of
the waste stream.
Should any test data from either these monitoring requirements or tests performed by the North Carolina
Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re-opened
and modified to include alternate monitoring requirements or limits.
NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control
organism survival and appropriate environmental controls, shall constitute an invalid test and will require
immediate follow-up testing to be completed no later than the last day of the month following the month of
the initial monitoring,

A. (6.) ACUTE TOXICITY MONITORING (Episodic)
The permittee shall conduct FIVE acute toxicity tests using protocols defined in U.S. EPA Document
EPA/600/4-90/027 entitled "Methods for Measuring the Acute Toxicity of Effluents to Freshwater and
Marine Organisms." The monitoring shall be performed as a Fathead Minnow (Pimephales pro►nelas)24-
hour static test. Effluent samples for self-monitoring purposes must be obtained below all waste
treatment.
Sampling and subsequent testing will occur during the first five discrete discharge events after the
effective date of this permit. After five toxicity tests are completed, the permittee will conduct one test
annually, with the annual period beginning in January of the next calendar year. The annual test
requirement must be performed and reported by June 30. If no discharge occurs by June 30, notification
will be made to the Division by this date. Toxicity testing will be performed on the next discharge event for
the annual test requirement.
The parameter code for this test is TAE6C. All toxicity testing results required as part of this permit
condition will be entered on the Effluent Discharge Form (MR-1) for the month in which it was performed,
using the appropriate parameter code. Additionally, DWQ Form AT-1 (original) is.to be sent to the

Test data shall be complete and accurate and include all supporting chemical/physical measurements
performed in association with the toxicity tests, as well as all dose/response data. Total residual chlorine
of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of
the waste stream.
Should any test data from either these monitoring requirements or tests performed by the North Carolina
Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re-opened
and modified to include alternate monitoring requirements or limits.
NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control
organism survival and appropriate environmental controls, shall constitute an invalid test and will require
immediate follow-up testing to be completed no later than the last day of the month following the month of
the initial monitoring,

Draft NPDES Permit
Dear Mr. Clark:
As per Amerada Hess Corporation's July 14, 1998 correspondence, upgrades will be required at
both of the above referenced facilities in order to meet the permit limitations specified within the
draft permit. The following upgrades will be performed to ensure compliance with the permit
limitations:
North Terminal
An onsite treatment system will be installed to further treat the water generated at the Terminal's
loading rack and pump pad. After treatment by the existing oil/water separator, the water will be
treated by a sand or bag filter, followed by carbon filtration.
South Terminal
In order to meet the Lead, Benzene and Toluene limitations at the South Terminal's tank-field
outfalI (Outfall 001), the tank-field outfall (001) will be routed to the lagoon system for the
railcar loading area that ultimately discharges to OutfalI 002. This would allow for the settling
and biological degradation of the stormwater prior to discharge.
As discussed, a compliance schedule will be needed within the final permit in order to meet the
new permit requirements.

Dear Mr. Clark:
Thank you for taking the time to speak with me on July 1, 1998 regarding the above referenced
draft permit. As discussed, upgrades will be required at both of the above referenced facilities in
order to meet the permit limitations specified within the draft permit.
The precise upgrades to be performed are currently being evaluated. However, at the present
time Amerada Hess Corporation anticipates either collecting and hauling the loading rack water
off-site for treatment or installing an onsite treatment system at the Selma North Terminal. If a
treatment system were to be installed it would consist of a sand filter, followed by carbon
filtration. The system would only receive water from the facility's oil/water separator.
In order to meet the Lead, Benzene and Toluene limitations at the South Terminal's tank-field
outfall (Outfall 001), one option under evaluation would be to route the tank-field outfall to the
,lagoon system for the railcar loading area which ultimately discharges to Outfall 002. This
would allow for the settling and biological degradation of the stormwater prior to discharge.
As discussed, a compliance schedule will be needed within the final permit in order to meet the
new permit requirements. A final plan for treatment at all outfalls will be provided by September
30, 1998.

Amerada Hess Corporation has completed the review of the above referenced draft permit. The
fallowing comments have been provided:
1. Supplement to Permit Cover Street
The Supplement to Permit Cover Sheet contains errors in the description of the discharges. It
is requested that the following revisions be inserted into the final permit:
1). At Outfall 001 (South Terminal), stormwater from the tank field area and hydrostatic
tank test water will not be routed through an oil/water separator prior to discharge. Loading
rack stormwater and wash water will be routed through an oil/water separator prior to
discharge.
2). At Outfall 003 (North Terminal), stormwatcr from the loading rack area and pump pad
area, as well as incidental wash water, are treated by an oil/water separator prior to discharge.

The permit limits for Toluene (Outfall 001 and 003) and Lead (Outfall 001) are equal to the

.0211(3)(1) presents the values as "maximum permissible levels". Therefore, the exposure
period for these standards is set at a one-day duration. However, based on conversations with
to NC DENR personnel, the numerical values given in Rule .0211(3)(1) for Toluene and Lead
are derived from chronic aquatic life criteria which have corresponding exposure periods of
four days. Therefore, chronic aquatic life criteria, developed as four-day exposure periods,

are being applied as one-day maximum limits without any translation to account for the
° differing exposure periods.

values). Said translation technique has been applied in NPDES permits throughout the
country.

Amerada Hess Corporation requests that NC DENR utilize the translation technique for
Toluene and Lead. A description of the technique is given in Section 5.4 (beginning on page
98) of the TSD. As an example (using Tables 5-1 and 5-2 on page 102-103), daily maximum
limits for Lead and Toluene could be derived as follows:

percentile; 1-day value)
Toluene
WLA= 11 ppb (chronic aquatic life wasteload allocation -no dilution; 4-day value)
LTA=0.527 * 11 ppb = 5.8 ppb (long term average assuming CV= 0.6 at 99th percentile)
MDL =3.11 * 5.8 ppb = 18 ppb (maximum daily limit assuming CV= 0.6 at 99th percentile;
1-day value)
A final Lead limit of 41 ppb and a final Toluene limit of 18 ppb as daily maximums represent
the conversion of a 4-day chronic aquatic life criteria to 1-day maximum limits. No monthly
average limits are appropriate for Toluene and Lead as the monitoring frequency is one
sample per month for these parameters.
2.) Benzene Permit Limits
The permit limits for Benzene (Outfall 001 and 003) are equal to the water quality standard to
protect human health through water consumption and fish tissue consumption for carcinogens
in Class WS-IV waters (15A NCAC 2B .0216 (3)(g)(ii)). This standard has been applied as a
daily maximum limit since Rule .0216(3)(g)(ii) presents the value as a "maximum
permissible concentration". Therefore, the exposure period for this standard is set at a one-
day duration. However, based on conversations with NC DENR personnel, the numerical
value given in Rule .0216(3)(g)(ii) for Benzene is derived from a human health criterion,
which has a corresponding exposure period of 30 days. Therefore, a human health criterion
is being applied as a one-day maximum limit without any translation to account for the
differing exposure periods.

Amerada Hess Corporation requests that NC DENR utilize a statistical translation technique
to appropriately convert the human health criterion for Benzene (30-day value) to daily
maximum limits (1-day values). As with Toluene and Lead, the USEPA TSD can be used to
calculate appropriate daily maximum limits from human health criteria. An example
calculation for Benzene is as follows:

WLA= 1.19 ppb (human health wasteload allocation -no dilution; 30-day value)
LTA= 0.782 * 1.19 ppb = 0.93 ppb (long-term average assuming CV=0.6 at 99th percentile
and 30-day exposure period)
MDL = 3.11 * 0.93 ppb = 2.89 ppb (maximum daily limit assuming CV = 0.6 at 99th
percentile; 1-day value)
A final Benzene limit of 2.89 ppb as a daily maximum represents the conversion of a 30-day
human health criteria to a 1-day maximum limit. No monthly average limits are appropriate
for Benzene as the monitoring frequency is one sample per month for this parameter.
3.) Stream Design Flow for Human Health Protection
The Benzene draft permit limit of 1.19 ppb is equal to the human health water quality
Qa� =�• 0/'standard applied at end-of-pipe; no dilution of the receiving stream has been utilized. In
accordance with 15A NCAC 2B .0206(a)(3)(B), the stream design flow to protect human
__l health from carcinogens through the consumption of water, fish, and shellfish has been
�7(a efined as the mean annual flow. Although the 7Q10 and 30Q2 flow of the receiving stream
(unnamed tributary of Mill Creek) have both been defined as 0 cfs, Amerada Hess
Corporation requests that the NC DENR document the mean annual flow of the unnamed
tributary to Mill Creek to determine applicable water quality based effluent limits for
Benzene. If the mean annual flow is greater than zero, this flow can be applied towards the
Benzene wasteload allocation, thereby revising the daily maximum permit limits at Outfall
001 and 003.

Permit Nos. NCO003549 (South Terminal) and NCO076589 (North Terminal) will be
combined into one discharge permit with this renewal.
NCO03549 (001) - discharge stormwater, washwater, and hydrostatic test water from
loading rack area and diked containment storage tank area through outfall 001. All
loading rack stormwater and washwater pass through oil/water separator prior to
discharge. (002) - discharge stormwater and wastewater from railcar loading area
through 4500 gallon oil/water separator and 0.7 MG lined containment basin through
outfall 002.
NCO076589 (001) (to be 003 - see below) - discharge stormwater and
washwater from loading rack area through an oil/water separator to outfall 003 and also
discharge stormwater and hydrostatic test water from diked containment area and
stormwater from paved areas through outfall 003.
NCO076589 will be rescinded and the outfall 001 of this permit will be
renumbered 003 under NC0003549.
Compliance SummwZX
Review of data from January 1995 to January 1998 indicate the facility has been in
compliance except for a few violations of the benzene,toluene, and lead water quality
standards. Both north and south terminals have passed their toxicity tests. Outfall 002
has not yet discharged.
WLA Sum
In 1996, DWQ developed standard permitting guidance and requirements for all terminals
in North Carolina. These requirements were incorporated into permit no. NCO003549 for
only outfall 002 in 1997 as part of the permit modification when this outfall was
constructed. These requirements will now be implemented for outfalls 001 and 003. The .
EPA Methods 624/625 monitoring requirement is one of these standard requirements.
This requirement allows DWQ to identify which of the compounds that are part of
624/625 are discharged by the terminals.
At outfall 001,the reasonable potential analysis indicated that the potential exists for
turbidity and oil and grease water quality standard violations,thus, turbidity and oil and
grease will continue to be monitored and limited even though this is not normally required
of terminals (as specified in terminal permitting guidance). The reasonable potential
analysis also indicated that the potential exists for benzene,toluene, and lead water quality -
violations and thus all three of these parameters will be limited in the permit. It should be
noted that when the reasonable potential analysis was run without 970112 data, toluene
would not be limited. (potential cause of high data on 0970112 and 970602 is
under investigation - region, please provide any info if possible).
There was no discharge from outfall 002, and thus no reasonable potential was
conducted.

At outfall 003, the reasonable potential analysis indicated that oil and grease, benzene, and
toluene all have the potential to violate water quality standards and they will be limited. It
should be noted that when the reasonable potential analysis was run without 970112 data,
toluene would not be limited. (potential cause of high data on 0970112 and
970602 is under investigation - region, please provide any info if
possible). Turbidity does not have the potential to violate water quality standard and
thus will not be limited or monitored as is consistent with terminal permitting guidance.
MTBE monitoring will be eliminated because this compound has no surface water quality
standards or federal criteria (one of the main reasons monitoring for MTBE is not required
as part mi of the terminal pertting g6idar ce). Review of'effluent data indicaie'one MTBE
detection equal to 125 ug/l (less than the groundwater MTBE water quality standard).
Ethylbenzene monitoring will be eliminated as monitoring for this compound is included
in 624/625 and review of the data only indicated one detection equal to 1.4 ug/l. The
phenol limit will be eliminated as explained in the following paragraphs.
Phenol and chlorinated phenols are separate and distinct and should not be grouped in the
same category when determining discharge limits (as has been inadvertently done in the
past). Phenol is a common component of petroleum compounds stored in terminals, can
result in tainting of fish tissue, and can cause taste and odor(organoleptic)problems in
drinking water. There is no water quality standard for phenol, although phenol
discharged from terminals can combine with chlorine in water treatment facilities to form
chlorinated phenols for which there is a state water quality standard of 1.0 pg/l.
Minimizing the discharge of phenol into water supply classified waters could reduce
chlorinated phenol formation and their concentration in drinking water. As a result of the
possible occurrence of phenol in oil terminal facility discharges and the possibility of
chlorinated phenol formation, phenol is monitored (but not limited) on a monthly basis at
those terminals that discharge to'water supply classified waters.
There is limited toxicity data for'chlorinated phenols, and the 1.0 pgll standard protects
water supplies from taste and odor problems. Chlorinated phenols are not expected to be
discharged from oil terminals and would not a problem with oil terminal discharges into
non-water supply classified waters. Monitoring for certain chlorinated phenols will occur
under EPA 624/625 for all oil terminaldAcharges.`If one or more chlorinated phenols are
detected, additional monitoring will be required of those terminals that discharge to water
supply classified waters.
Total Nitrogen and Total Phosphorus will be monitored and special conditions have been
added to the permit which explain conditions 'related.to the Neuse River Basin NSW
Management Strategy. Please refer to Neuse River Basin NSW Management Strategy

Amerada Hess stores low/high sulfur diesel, kerosene, and gasoline as well as fuel additives.
The facility has had several discharge events in the past year. Outfall 001 of NCO003549
has had detect levels of MTBE, lead, benzene, toluene, and xylene with values above the
instream water quality standards for lead, toluene and benzene.
NCO076589 has also had occasional discharges. January 1997 indicated values above
detect levels for xylene, benzene, and toluene.
The RRO has no objection to reissuance of these permits, pending approval by the NPDES
Unit. However, the RRO recommends that these permits be combined for a single permit
with three outfalls (if Amerada concurs).

Selma North Terminal
Selma South Terminal
northwest of Selma
Johnston County
to receiving waters designated as an unnamed tributary to Mill Creek in the Neuse River Basin
in accordance with effluent limitations, monitoring requirements, and other conditions set forth in Parts I,
II, III, and IV hereof.

2 The discharge shall not cause the turbidity of the receiving water to exceed 50 NTU. If the turbidity exceeds these levels due to natural background
conditions, he discharge level cannot cause any increase in the turbidity in the receiving water.
3 Where possible,the grab sample for oil and grease should be skimmed from the surface of a quiescent(calm water) zone.

with the permittee's next scheduled monitoring event, occur on a semi-annual basis, and will last for the duration of the permit. Eight chlorophenols include
