Pamlico County Dear Mr.Cross: The Division of Water Quality(the Division)hereby issues this final permit for the subject facility. This permit is issued to Pamlico Packing Company, Inc.pursuant to the requirements of North Carolina General Statute 143- '215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated May 9, 1994,or as subsequently amended. Changes to Your Previous Permit. The Division has revised effluent parameter limits according to federal guidelines for seafood processing(40 CFR§408)for Outfalls 002,003 and 004 to reflect new production data , submitted on your permit renewal application.In addition,Outfall 001 has been revised to reflect General Permit conditions servicing non process-contact fish packaging wastes only.The Division has also added Outfall 005 servicing boiler blowdown and understands that, similar to Outfall 001,these are non process-contact wastes likewise governed by General Permit conditions.Finally,the Division has revised parameter limits from the draft permit to.reflect new production data supplied by the Permittee during the draft review process [see Effluent Limitations and Monitoring Conditions,A (1) through A. (5)]. If any parts,measurement frequencies, or sampling requirements contained in this permit are unacceptable,you have the right to an adjudicatory hearing upon written request within thirty(30) days after receiving this letter. Your request must be in the form of a written petition conforming to Chapter 150B of the North Carolina General Statutes,and must be filed with the office of Administrative Hearings, 6714 Mail Service Center,Raleigh,North Carolina 27699-6714.Unless such a demand is made,this permit shall be final and binding. This permit is not transferable except after notifying the Division of Water Quality.The Division may require modification,or revocation and re-issuance of this permit.Please notice that this permit does not affect your legal obligation to obtain other permits required by the Division of Water Quality, the Division of Land Resources, the Coastal Area Management Act, or other federal or local governments. Therefore,the exclusive authority to operate and discharge from this facility arises under the permit conditions,requirements, terms, and provisions described herein. A. (7.) SPECIAL OPERATING CONDITIONS (a) Best Management Practice (BMP) Requirements: (1) There shall be no discharge of fish parts or floating solids. Discharge shall contain no foam visible in other than trace amounts. (2) Permittee shall direct employees and provide resources to implement, at a minimum, such practices that wastewater volume and wastewater constituents are reduced;as follows: 0 Dry cleanup shall be performed prior to washdown of the facility; 9 Personnel shall be instructed to stop water flow through idle equipment; • All process and washdown equipment shall be fitted with high pressure/low volume nozzles; • All on-demand water delivery hoses shall be fitted with automatic shut-off nozzles. Permit NC0002071 (b) Dry Clean-up Requirements: (1) All batter drippings shall be collected in pans under the breading tables; (2) Spilled batter shall be squeegeed off the floor prior to wet cleanup; (3) Permittee shall not allow batter residuals to be discharged to surface waters; all left over batter and solids shall be collected in a container and properly disposed; (4) Where practical, trays shall be placed under machines and conveyor belts to collect particles of breading or other food products; (5) Employees shall be instructed to remove, by hand or,other method, leftover breading from sifters and other machines prior to these solids entering the drainage system; (6) Flooring shall be brushed with a stiff broom prior to wet cleanup. A. (8) USE OF BIOCIDE The permittee shall use no biocide(s) other than those approved by the Division for this specific discharge. The Permittee operates a five-days per week seafood packing and processing facility that utilizes both year-round and seasonal processes. Considering all waste streams, total discharge flow averages between 3,000 and 4,000 gallons per day (gpd) through 5 outfalls. Peak production (daily) has reached 6,000 lbs/day(shrimp), 6,000 lbslday (fish), and 800 lbslday (crab), during summer months. Pamlico removes solids by physical screening through containers called"drain buckets" (a minor, Class I treatment facility). This facility discharges to the Neuse River Basin estuary and is not a member of the Lower Neuse River Basin Association. Outfall 001 --General Permit conditions for fish packing (without processing) operations Outfall 002 -- fish processing (bottom fish) per 40CFR 408.212(b), Subpart U. Outfall 003 -- shrimp processing per 40CFR 408.122(b), Subpart L, Outfall 004 -- crab processing per 40CFR 408.22(b), Subpart B. Previous Permit. Previous permit requires annual monitoring at Outfall 001 (fish packing) and monthly monitoring at Outfalls 002, 003, and 004 (seafood processing). This facility was first permitted in 1980. The previous permit was issued in July 31, 2000 and expired on June 30, 2003 and the Division has received the appropriate documentation to renew. Waste Load Allocation (WLA). The Division prepared the last Waste Load Allocation in 1991, Effluent limits were based on Guidelines (pH on saltwater guidelines). The Division views this allocation appropriate for renewal except as noted herein. Staff Report (SR). The Washington Regional Office (WaRO) prepared an Staff Report dated February 28 2003. The report noted that there are now five discharge pipes (Outfalls 001 through 005) located within a 10-meter distance. New Outfall 005 receives boiler blowdown associated with crab cooking (but is not process-contact wastewater) and the WaRO recommends it be added to the permit for this renewal. Verification of Receiving Stream Conditions. The Division verified that the Bay River, located within sub-basin 03-04-13 [stream segment 27-150-(1)], has been classified as a Class SC-Sw-NSW stream influenced by ocean tides. This waterbody is not listed as an impaired stream on the Division's 303 (d) list. This facility discharges in proximity (upstream), but not within, classified High Quality Waters (Sa, HQW, NSW), see revised map. PERMITTING APPROACH Production and Outfalls. The permittee's application estimated gross weights for processing shrimp (Table 2), crabs (Table 3), and fish (Table 4), as required under federal regulations §40CFR 408, Subparts B, L and U,respectively. Tables include parameters, renewal limits based on production, their derivation, and previous limits for comparison. The site visit and discussions with the permittee revealed that the facility does have a daily discharge of boiler blowdown during crab processing operations in the summer months. The boiler blowdown is discharged via a separate Pipe adjacent the other outfalls. The Washington Regional Office recommends that this permit be renewed for 5 years with the addition of the appropriate monitoring and limitations requirements for Outfall 005(Boiler Slowdown) .
