This permit is issued pursuant to the requirements of North Carolina General Statute 143-2 I5.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated December 6, 1983. The conditions in this final permit include no changes from the draft permit the Division sent to you in February 2000. If any parts, measurement frequencies, or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the office of Administrative Hearings, Post Office Drawer 27447, Raleigh, North Carolina 276 1 1=7447. Unless such a demand is made, this permit shall be final and binding. Please take notice that this permit is not transferable except after notice to the Division of Water Quality. Permit Part II, EA. addresses the requirements to be followed in case of change in ownership or control of this discharge. SPECIAL OPERATING CONDITIONS Best Management Practices (BMP,)_Requirements: • There shall be no discharge of fish parts, floating solids, or foamy effluent. • Permittee shall direct employees and provide resources to follow, at a minimum, the following practices such that wastewater volume and wastewater constituents are reduced, as follows: 1. Dry cleanup shall be performed prior to washdown of the facility: 2. Personnel shall be instructed to stop water flow through idle equipment; 3. All process and washdown equipment shall be fitted with high pressure/low volume nozzles; 4, All on-demand water delivery hoses shall be fitted with automatic shut-off nozzles. Dry Clean-up Requirements: • All batter drippings shall be collected in pans under the breading tables; Spilled batter shall be squeegeed off the floor prior to wet cleanup: • Permittee shall not allow batter residuals to be discharged to surface waters; all left over batter and solids shall be collected in a container and properly disposed; • Where practical, trays shall be placed under machines and conveyor belts to collect particles of breading or other food products; • Employees shall be instructed to remove, by hand or other method, leftover breading from sifters and other machines prior to these solids entering the drainage system; • Flooring shall be brushed with a stiff broom prior to wet cleanup. A. (4.) USE OF BIOCIDE The permittee shall not use any biocide(s) other than approved in conjunction with the Permit apolication. If the permittee wishes to use any other biocide(s), a request must be submitted to the Division at least 90 days prior to the (planned) first use of the biocide. Each request must include a completed copy of Biocide Form 101 and an MSDS for each proposed biocide. The Division permitted the facility to discharge untreated /monitored effluent at two outfalls: Outfall 001 (crab processing) and Outfall 002 (oyster shucking). It was then was sold near the end of 1998. Upon notice of change of ownership/name to Captain Charlie's Seafood, Inc. in January 1999, the last NPDES modification included revised permit parameters effective on January 20, 1999. The permit expires on March 31, 2000 and the Division has received the appropriate documentation to renew. The Washington Regional Office inspected the facility most recently on October 26, 1999 (Kristin Jarmin). The Region recommended: 1) that this permit be reissued; and 2) that Outfall 002 be deleted from the permit because oyster shucking has been discontinued at this facility. Violations were reported in 1997 and 1998 for failure to monitor and failure to report, although . the facility typically reports "no discharge" four to five months of the year. Violations included TSR and settleable solids, but none in 1999. PERMITTING APPROACH Verification of Existing Conditions -- The Division has verified that Far Creek is a Class SC- HQW stream; (Tidal, therefore summer 7Q10= 0 cfs, winter 7Q10= 0 cfs, and 30Q2 = 0 cfs); and that Far Creek (sub-basin 030308) is not listed as a 303 (d) stream (Joe Corporon, January 18, 2000). Shellfishing within this basin has been DEH banned since 1994 due to NP fecal coliform. fact shoet NMt_S R01WWid r ~ Review of DMR Data -- The Division considered the monitoring data from the existing DMRs. Intermittent discharge volumes during active periods appear to average approximately 1,700 gallons per day for 3 to 4 days per week, but are sporadic. Questionable effluent temperatures for 1998 and 1999 are reported as either exactly "45" or "50" degrees C alternately each month. Contacted Permittee RE: Outfall 002 -- Division contacted the permittee to ask if they still needed Outfall 002. Ms. Kim Davenport stated that Mr. Philip Carawan (owner) was currently out of the county, but if he indicated two outfalls on the permit-renewal request, then it would be best for the company to keep both. She went on to say that crabs (001) and oysters (002) are processed in two separate buildings and they may wish to continue with oysters in the future. Captain Charlie's Seafood, Inc. would continue to report idle periods for both outfalls as "no discharge" (personal communication to Joe Corporon, January 21, 2000). Contacted Region RE: Need for Outfall 002 — Kristin Jarmin of the Washington Regional Office informed the Division that there is no significant reason not to renew Outfall 002 if the permittee wishes to retain it (personal communication to Joe Corporon, February 2, 2000).
