Accordingly, we are forwarding .the attached NPDES discharge permit: This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum 'of Agreement between North Carolina and the U.S. Environmental Protection Agency dated October 17, 2007 (or as subsequently amended.) This permit authorizes Polk County Government to discharge treated domestic wastewater from the Woodland Mills WWTP to the South Branch Little White Oak River, a class C water in the Broad River Basin. The permit includes discharge limitations and/or monitoring for flow,BOD5, ammonia nitrogen,total suspended solids (TSS), total residual chlorine and fecal coliform. The following procedure has been recently implemented by DWQ: Total residual chlorine (TRC) compliance level changed to 50 µg/l. Effective March 1, 2008, the Division received EPA approval to allow a 50 µg/l TRC compliance level. This change is due to analytical difficulties with TRC measurements. Facilities will still be required to report actual results on their monthly discharge monitoring report (DMR) submittals, but for compliance purposes;all'TRC values below 50 µgfl will be treated as zero. A footnote regarding this change has been added to the effluent limitations page-in the permit. For clarification purposes, the language of the footnote has been' modified since the draft permit. Please note the changes in footnote 2 on the Effluent Limitations and Monitoring Requirements page. The following are modification's in the final permit based on additional information and comments from the permittee. • The parameter, Total Suspended Residue has been changed to Total Suspended Solids to reflect the constituent that is limited and monitored by the facility. NPDES #NC0004464 • The monitoring frequency for temperature has been modified from daily to weekly to reflect.the requirements for a Class II facility with primarily domestic wastewater. The following modifications noted in the June 181h draft are included in the final permit. • A tablet dechlorinator has been added to the components of the wastewater treatment plant per the Authorization to Construct No. 004464A01 issued October 28, 2005. • Influent monitoring for BOD5 and Total Suspended Solids has been added to the permit and the facility must meet a removal efficiency of 85%. This is based on the requirement for a Publicly Owned Treatment Work (POTW). See footnote 1 on the Effluent Limitations page. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the .form of a written petition, conforming to Chapter 150B of the North Carolina General.Statutes, and filed with the office of Administrative Hearings, 6714 Mail Service Center, Raleigh, North Carolina 27699-6714. Unless such a demand is made, this permit shall be final and binding. Please take notice that this permit is not transferable. The Division may require modification revocation and reissuance of the permit. This permit does not affect the legal requirements to obtain other permits which may be-required by the Division of Water Quality or permits required by the Division of Land Resources, Coastal Area Management Act, or any other Federal or Local governmental permits may be required. The Division shall consider all effluent TRC values reported below 50 µg/l to be in compliance with the permit. However, the Permittee shall continue to record and submit all values reported by a North Carolina certified laboratory(including field certified),even if these values fall below 50 µg/l. 3. The pH shall not be less than 6.0 standard units or greater than 9.0 standard units. There shall be no discharge of floating solids or visible foam in other than trace amounts. Woodland Mills WWTP NCO004464 030802 South'Branch Little White Oak River Draft permit sent to public notice on June 18, 2008. Existing permit limits were renewed: BOD5 =30, Sum/Win NH3 = 12, 33, TRC = 28 ugll, Fecal = 200/100ml At this renewal the following changes were added to the permit: 1) Influent monitoring for BOD5 and TSS were added to the permit and the facility must meet 85% removal. This upcoming modification was noted in the final cover letter with the March 29, 2005 permit renewal. Polk County requested transfer of ownership of the former Woodland Mills Corp. in March 14, 2005. Woodland Mills (formerly Stonecutter Mills) was a textile mill in 2003, however since that time have ceased the process portion of the discharge. Comment from Polk Co. on the 2008 renewal ---Request that influent sampling and 85% removal requirement be removed from permit. Says that they are not a municipality, ww comes only from Polk Co. middle school and grounds and the Woodland Mills, which will be closing. DWQ response- This requirement must remain because Polk County owns the treatment plant and has the capability to accept flow from other sources. Currently waste from a school and Woodland Mills. ** County Manager, Ryan Whitson, said that in a few years, Polk County was going to go into "the water business" and accepting other wastewater. 2) Comment from Polk Co. on the 2008 renewal ---Request that temperature monitoring be changed from daily to weekly. DWQ response- Review of regs indicates that weekly effluent temperature monitoring may be appropriate for a Class lI facility with primarily domestic wastewater. 3) Comment from Polk Co. on the 2008 renewal ---Request that the permit be issued to Polk County Water Department instead of Polk County. DWQ response- Talked to Ryan Whitson and he said as long as the County is shown as the owner of the permit it was okay. We have been given until July 25"', 2008, to provide written comments. hlcluded in this letter are the items that we would like to see removed or altered from this permit. UNDER EFFLUENT LIMITATION AND MONITORING REQUIREMENTS 1) Note #1: The monthly average effluent BOD5 and Total Suspended Residue concentrations shall not exceed 15°/t of the respective influent value (85% removal) to include the influent monitoring for BOD5 and Total Suspended Residue. CHANGE REQUESTED: We would like to ask that this requirement be removed from the permit for the following reasons. (1) We are not a municipality. The flow to the treatment plant comes solely from the Polk County Middle School and grounds, and from Woodland Mills. The mill is in the process of closing and this flow will no longer be entering the facility, and (2) the allowable flow is at 15,000 gallons with an average flow through the plant of 4,000 gallons per day. 2) Effluent Characteristic Temperature to be monitored daily. CHANGE REQUESTED: We would like to request this requirement be changed to weekly. We do not believe that the low [low amounts would be of an impact to the receiving waters.
