Dear Mr. Styron:
The Division of Water Quality(the Division) hereby issues this final permit for the subject facility. This
permit is issued to Garland F. Fulcher Seafood Company, Inc. pursuant to the requirements of North
Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and
the U.S. Environmental Protection Agency dated May 9, 1994, or as subsequently amended.
Changes to Your Previous Permit. The Division has revised effluent parameter limits according
to federal guidelines for seafood processing (40CFR 408) for Outfalls 001, 002 and 003 to reflect
recent production data submitted on your permit renewal application and supplemental data
provided during the renewal process. In addition, Outfall 004 has been added to your permit as non
process-contact boiler blowdown wastes to be monitored under specified conditions.
Please be reminded that your facility discharges to waters within the Neuse River Basin. All
streams within this basin have been designated nutrient sensitive waters (NSW) as a result of
environmental problems including algal-blooms in the estuary. The North Carolina Environmental
Management Commission recently adopted rules establishing the Neuse River Basin Nutrient-
Sensitive Waters Management Strategy to reduce phosphorus and nitrogen inputs. The related
point source rule (15A NCAC 2B .0234) intends to reduce, by 30%, total nitrogen (TN) discharges
by the year 2003. The Division encourages you evaluate alternative discharge options such as
wastewater reuse, spray irrigation, subsurface discharge systems, or connecting to a larger
regional system.
If any parts, measurement frequencies, or sampling requirements contained in this permit are
unacceptable, you have the right to an adjudicatory hearing upon written request within thirty(30)days
after receiving this letter. Your request must be in the form of a written petition conforming to Chapter
150B of the North Carolina General Statutes, and must be filed with the office of Administrative
Hearings, 6714 Mail Service Center, Raleigh, North Carolina 27699-6714. Unless such a demand is made,
this permit shall be final and binding.

In compliance with the provision of North Carolina General Statute 143-215.1, other lawful standards
and regulations promulgated and adopted by the North Carolina Environmental Management
Commission, and the Federal Water Pollution Control Act, as amended,
Garland F. Fulcher Seafood Company, Inc.
is hereby authorized to discharge wastewater from a facility located at
Garland F. Fulcher Seafood Company, Inc.
301 Hodges Street, Oriental, NC
Pamlico County
to receiving waters designated as Raccoon Creek within the Neuse River Basin in accordance with
effluent limitations, monitoring requirements, and other conditions set forth in Parts I, 11, III and IV
hereof.
This permit shall become effective February 1, 2005.
This permit and authorization to discharge'shall expire at midnight on June 30, 2008.

SUPPLIMENT TO EFFLUENT LIMITATIONS
AND MONITORING REQUIREMENT'S
A. (5.) TOTAL NITROGEN MONITORING
The Permittee shall calculate the annual mass loadim of total nitrogen as the sum of monthly
loadings, according to the following equations:
(a) Monthly Mass Loading(lbslmonth) = TN x Q x 8.34
where:
TN = the average total nitrogen concentration (mglL) of
the grab samples collected during the month
Q = the total wastewater flow discharged during the
month (MG/month)
8.34 = Conversion factor, from (mg/L x MG) to pounds
(h) Annual Mass Loading (lbslyear) = E (Monthly Mass Loadings) for the
calendar year
The Permittee shall report the total nitrogen concentration for each sample and the
monthly mass loading in the appropriate self-monitoring report and the annual
mass loading of total nitrogen in the December self-monitoring report for the
year,
A. (6.) SPECIAL OPERATING CONDITIONS
(a) Best Management Practice (BMP) Requirements:
(1) There shall be no discharge of fish parts or floating solids. Discharge shall
contain no foam visible in other than trace amounts.
(2) Permittee shall direct employees and provide resources to implement, at a
minimum, such practices that wastewater volume and wastewater
constituents are reduced, as follows:
• Dry cleanup shall be performed prior to
washdown of the facility;
• Personnel shall be instructed to stop water flow
through idle equipment;
• All process and washdown equipment shall be
fitted with high pressure/low volume nozzles;
• All on-demand water delivery hoses shall be
Fitted with automatic shut-off nozzles.

(b) Dry Clean-up Requirements:
(1) All batter drippings shall be collected in pans under the breading tables;
(2) Spilled batter shall be squeegeed off the floor prior to wet cleanup;
(3) Permittee shall not allow batter residuals to be discharged to surface
waters; all left over batter and solids shall be collected in a container and
properly disposed;
(4) Where practical, trays shall be placed under machines and conveyor belts
to collect particles of breading or other food products;
(5) Employees shall be instructed to remove, by hand or other method,
leftover breading from sifters and other machines prior to these solids
entering the drainage system;
(6) Flooring shall be brushed with a stiff broom prior to wet cleanup.
A. (7) USE OF BIOCIDE
The permittee shall use no biocide(s) other than those approved by the Division for
this specific discharge. Should the permittee intend to use a new biocide not previously
approved, a request for approval must be submitted to the Division no later than 90 days
prior to its intended first use. The Permittee's approval request shall include both an
accurately completed Biocide Form 101 and a Material Safety Data Sheet (MSDS) for
each proposed biocide.

FACILITY DESCRIPTION
Garland F. Fulcher Seafood Company, Inc. sits on the north western shore of the Raccoon Creek
where local topography is flat and low-lying, about 0.5 feet above MSL. The Permittee operates a
five-days per week seafood packing and processing facility that utilizes both year-round and
seasonal processes. The Permittee removes solids by physical screening, a minor, Class I
treatment facility. This facility and is not a member of the Lower Neuse River Basin Association
discharging to the Neuse River estuary as follows:
Outfall 001 -- crab processing per 40CFR 408.22(b), Subpart B.
Outfall 002 -- shrimp processing per 40CFR 408.122(b), Subpart L,
Outfall 003 fish processing (bottom fish) per 40CFR 408.212(b), Subpart U.
Outfall 004 -- boiler blowdown; General Permit conditions
Previous Permit. This facility was first permitted in 1980. The previous permit requires
monthly monitoring for most parameters at Outfalls 001 through 003, with quarterly and annual
monitoring for various nitrogen and phosphorus parameters required for NSW waters. The
previous permit was issued in June 5, 2000 and expired on June 30, 2003 and the Division has
received the appropriate documentation to renew.

Waste Load Allocation (WLA). The Division prepared the last Waste Load Allocation in
1991. Effluent limits were based on Guidelines (pH on saltwater guidelines). The Division views
this allocation appropriate for renewal except as noted herein.
Staff Report. The Washington Regional Office (WaRO) prepared an Staff Report dated
February 28 2003. The report noted that there are now four discharge pipes (Outfalls 001
through 004) located within a 10-meter distance. New Outfall 004 receives boiler blowdown
associated with crab cooking (non process-contact wastewater) and the WaRO recommends it be
added to the permit for this renewal.
Verification of Receiving Stream Conditions. The Division verified that Raccoon Creek,
located within sub-basin 03-04-10 [stream segment 27-129-8], has been classified as a Class Se;
HQW, NSW stream influenced by ocean tides. This waterbody is not listed as an impaired
stream on the Division's 303 (d) list. This facility discharges in proximity(upstream), but not
within waters classified Sa; HQW, NSW, see revised map.
PERMITTING APPROACH
Production and Outfalls. The Permittee's application estimated gross weights for processing crabs
(Table 2), shrimp (Table 3),and fish(Table 4), as required under federal regulations §40CFR 408,
Subparts B, L and U,respectively. Tables include parameters, renewal limits based on production, their
derivation, and previous limits for comparison. Newly identified boiler blowdown wastes associated
with,but separate from process wastes for crab cooking(Outfall 001), shall be added to this permit as
new Outfall 004.

Discharge Monitoring Report(DMR) Data Review. The Permittee generally reported
monitoring and sampling during the permit period in accordance with the permit. Data submitted
suggest that discharge at this facility is sporadic and seasonal, as indicated on the renewal
application. Although months reported by the Permittee as "no flow" did not always include all
outfalls, the Permittee generally submitted DMRs for months when no discharge occurred. The
Permittee will be reminded in the cover letter that failure to report all outfalls according to the
permit is a violation, even when no discharge occurs.
The Division reviewed 26 months of DMR data from January 2002 through February 2004.
Monthly levels reported for Oil & Grease and Total Suspended Solids (TSS) concentrations
ranged generally less than 1.0 lbslday well within permit limits except for a max TSS at 11.4
lbs/day on one occasions at Outfall 003.
Newly Designated Outfall 004. Based on recommendations made in the Washington Regional
Office Staff Report (received March 6, 2003), the Division will renew this permit with the
addition of Outfall 004, hereby designated for the purpose of monitoring boiler blowdown, a non-
contact cooling water source. Monitoring will be set monthly as with other outfalls, and based
on BPJ, parameters shall include TRC (if chlorine is used), pH, temperature, and oil and grease.

PART IV - EVALUATION AND RECOMMENDATIONS
The site visit and discussions with the permittee revealed that the
facility does have a discharge of boiler blowdown approximately every other
day during crab processing operations in the summer months. The Washington
Regional Office recommends that this permit be renewed for 5 years with the
addition of the appropriate monitoring and limitations requirements for
Outfall 004(Boiler Blowdown) .
