Accordingly,we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated May 9, 1994 (or as subsequently amended). This final permit includes the following changes from the draft permit sent to you on July 20, 2005: • Because the Environmental Protection Agency has tagged MTBE as a potential carcinogen and this discharge is to water-supply waters, MTBE monitoring has been included in this permit. Effluent data gathered in recent years shows MTBE to be present, so the monitoring frequency required will be monthly and an action plan for its elimination is also being added. • The limit for Total Suspended Solids is being changed to 45 mg/L to conform with Division policy for oil terminal permits. If any parts,measurement frequencies or sampling requirements contained in this pertnit are unacceptable to you,you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition,conforming to Chapter 150B of the North Carolina General Statutes,and filed with the Office of Administrative Hearings (6714 Mail Service Center,Raleigh,North Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding. Please note that this permit is not transferable except after notice to the Division. Samples shall be collected at the effluent discharge pipe. 2. Flow —During periods of no flow, the Permittee shall submit a monthly Discharge Monitoring Report (DMR) indicating "No discharge." Flow shall be monitored with each discharge event and may be monitored in one of four ways: a) measure flow continuously; b) calculate flow based on total rainfall per area draining to the outfall; (See Special Condition A. (4.) for rational equation); c) estimate flow at 20-minute intervals during the entire discharge event; or d) report flow based on discharge pump logs. 3. Turbidity—Effluent shall not cause receiving stream turbidity to exceed 50 NTU. If receiving stream background turbidity exceeds 50 NTU, effluent shall not cause this background value to increase. 4. Oil and Grease — Where possible, sample shall be skimmed from the water surface of a quiescent zone. 5. Naphthalene — Monitoring requirement applies to facilities that store, or have historically stored,diesel or other heavy fuels on site. 6. MTBE — Facility shall submit a plan to the Division no later than October 1, 2006 detailing how MTBE levels will be reduced at this outfall. Permittee may request that monitoring frequency be reduced to quarterly after a substantial amount of sampling (24 sampling events over a two year period)indicates that MTBE levels are consistently below detection level. 7. Acute Toxicity (Fatbead Minnow, 24-hour), Annual [see Special Condition A.(3)]. Permit holder shall sample for acute toxicity and BTEX concurrently. There shall be no discharge of floating solids or foam visible in other than trace amounts. There shall be no direct discharge of tank solids,tank bottom water,or the rag layer. There shall be no direct discharge of tank(or pipe) contents following hydrostatic testing unless benzene concentration is less than 1.19 fLgll and toluene concentration is less than l I jig/I. There shall be no discharge of floating solids or foam visible in other than trace amounts. Permit NC0004839 EFFLUENT LIMITATIONS AND MONITORING REQUIREMENTS SPECIAL CONDITIONS A. (3) ACUTE TOXICITY MONITORING (ANNUAL) The Permittee shall conduct annual toxicity tests using protocols defined as definitive in EPA Document EPA/600/4-90/027 entitled "Methods for Measuring the Acute Toxicity of Effluents to Freshwater and Marine Organisms." The monitoring shall be performed as a Fathead Minnow (Pimephales promelas) 24-hour static test. Effluent samples for self-monitoring,purposes must be obtained below all waste treatment. The permittee will conduct one test annually, with the annual period beginning in January of the calendar year of the effective date of the permit. The annual test requirement must be performed and reported by June 30. If no discharge occurs by June 30, notification will be made to the Division by this date. Toxicity testing will be performed on the next discharge event for the annual test requirement. The parameter code for this test is TAE6C. All toxicity.festing results required as part of this permit condition will be entered on the Effluent Discharge Form (MR-1) for the month in which it was performed, using the appropriate parameter code. Test data shall be complete and accurate and include all supporting chemical/physical measurements performed in association with the toxicity tests, as well as all dose/response data. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should any test data from either these monitoring requirements or tests performed by the North Carolina Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re- opened and modified to include alternate monitoring requirements or limits. NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism survival and appropriate environmental controls, shall constitute an invalid test and will require immediate follow-up testing to be completed no later than the last day of the month following the month of the initial monitoring. Outfall 002 -discharges treated groundwater. The treatment system consists of an oil water separator,an air stripper, and a carbon-polishing unit. FILE REVIEW Correspondence The Mecklenburg County Department of Environmental Protection (MCDEP) conducts annual inspections at this facility as part of a cooperative working agreement between the county and DWQ. Inspection records indicate satisfactory ratings in all inspected areas. The facility has not received any notices of violation in the past permit term. DMR Review: Outfall 001 - DMRs were reviewed for the period of March 2003 to February 2005. The mean flow was 0.102 MGD. The highest monthly average flow (used below in the reasonable potential calculations) was 0.3438 MGD. Total suspended solids during this time averaged 6.6 mg/L for all the values above quantitation level, the maximum daily value was 22 mg/L. Oil and Grease was detected two times, the maximum was 8.7 mg/l. Phenol was not detected above the quantitation level. Quantitation levels for phenol were l0pg/L(before April 2004) and 5 tiglL (from April 2004 to present). Benzene was not detected above the quantitation level of I µgll. Xylene was detected once at 2 tLgll. Toluene was not detected above the quantitation level of 1 pg/L. The facility passed all acute toxicity tests since 2001. Regularly performed EPA Method 625 analysis showed no additional parameters of concern. Fact Sheet NPDES NCO004839 Renewal Page 1 Outfall 002 - DMRs were reviewed for the period of March 2003 to February 2005. The mean flow was 0.0069 MGD. The highest monthly average flow (used below in the reasonable potential calculations) was 0.013 MGD. Total suspended solids during this time were all below quantitation level. Oil and Grease was detected three times, the maximum value was 9.16 mg/L. Phenol was below quantitation level for all samples. MTBE was detected' in 11 of 24 monthly samples with a maximum of 69 jig/L. Chloroform, 1,2- Dichloroethane, benzene, ethylbenzene, xylene, and toluene were always below quantitation level. Regularly performed EPA Method 625 analysis showed no additional parameters of concern. Reasonable Potential Analysis: Outfall 001 --Xylene was the only parameter detected for which there is a water quality standard. It showed no reasonable potential to exceed water quality standards. Outfall 002 - No parameters monitored at this outfall showed reasonable potential to violate water quality standards. All samplings for all parameters that have standards were below detection level. PERMITTING STRATEGY The permitting strategy for this and all oil terminals in the state is based upon a document entitled, "NPDES Permitting Requirements for Discharges for Petroleum Bulk Storage, Surface Storage Greater than One Million Gallons, 2005-Permitting Strategy Addendum." This document is based upon a 2001 SOP and has been updated after a data review and internal discussions. It delineates monitoring frequencies and permitting limits for contaminants commonly found at these sites. Below, it is referred to as the -2005 Permitting Strategy." Oil Terminal SOP: For Outfall 001 the flow, toxicity, TSS and oil and grease requirements specified in the previous permit remain unchanged. Turbidity, benzene, xylene, toluene, phenol, and ethylbenzene showed no potential to exceed water quality standards. All samples for the past two years were below detection level for phenol and BTEX except for one detection of xylene at 1.8 µg/L in August 2003. Monitoring requirements will therefore remain in the permit without limits, and will be decreased from monthly to quarterly due to the lack of detections. The maximum allowable concentration for phenol was calculated using the maximum flow discharged for the evaluation period (0.3438 MGD) and the allocation of 0.43 lbs/day for each discharger in this area. MTBE will be removed from the permit based upon the permitting strategy. As per Parts 8. and 9. of the 2005 permitting strategy, there can be no direct discharge of tanks solids, tank bottom water or the rag layer, and no direct discharge of hydrostatic test water if concentrations of benzene and/or toluene exceed the water quality standard. The requirements for Outfall 002 in the previous permit were based on the requirements in the general permit for groundwater remediation systems for petroleum contaminated groundwater and similar wastewaters. Data was examined for turbidity,benzene, xylene, tuloene, and ethylenzene,phenol, chloroform, and 1,2 Dichlorethane. Turbidity is currently monitored quarterly and showed no reasonable potential, therefore its requirements will remain unchanged. All other samples for the past two years were below detection levels. Monitoring requirements will therefore remain in the permit without limits, and will be reduced from monthly to quarterly due to a lack of detections. MTBE will be removed from the permit based upon the permitting strategy The maximum allowable concentration for phenol was calculated using the maximum flow discharged for the evaluation period(0.013 MGD)and the allocation of 0.43 lbs/day for each discharger in this area. SUMMARY OF PROPOSED CHANGES Outfall 001 • Reduce monitoring frequency from monthly to quarterly for phenol, benzene, toluene, and ethylbenzene since these parameters were not detected in the effluent in the past two years. • Reduce monitoring frequency from monthly to quarterly for xylene since this parameter was detected only once in the effluent in the past two years, and that detection was 1.8 jig/L. The maximum predicted concentration was 3.9 AgIL and the allowable concentration based upon water quality standards is 780 t.g/L. • Remove requirement for Method 625 scans based upon 2005 permitting strategy. • Add monthly monitoring requirement for naphthalene based upon 2005 permitting strategy. Remove MTBE monitoring based upon 2005 permitting strategy.
