Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated May 9, 1994 (or as subsequently amended). This final permit includes no major changes from the draft permit sent to you on September 10, 2003. This permit includes a'IRC limit that will take effect on June 1, 2005. If you wish to install dechlorination equipment, the Division has promulgated a simplified approval process for such projects. Guidance for approval of dechlorination projects is attached. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you,you have the right to an adjudicatory hearing upon written request within flirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center,Raleigh, North Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding. Please note that this permit is not transferable except after notice to the Division. The Division may require modification or revocation and reissuance of the permit. This permit does not affect the legal requirements to obtain other permits which may be required by the Division of Water Quahty or permits required by the Division of Land Resources, the Coastal Area Management Act or any other Federal or Local governmental permit that may be required. To answer A(2) and A(3)of Wastewater Water Treatment Plant Permit #NC0047091. A.(2) Flood Plain Analysis; The Waste Water Treatment Plant of Silver Maples is In the 100 year flood plain zone. We will schedule the elimination of this plant when the City Of Concord NC finishes their Waste Water Line to this property. This line is in the process of being built now. The first line the city built is filled to capacity. For the completion and availability of this service,the waste water engineer for Concord NC Mr. Mark Fowler can be contacted for this information. A(3) Engineering Alternatives Analysis; The only alternative we have is to connect onto the Kings Grant Rocky River Interceptor when the second line is complete.This line is being built now.As we stated above for information on the availability and completion of this line Mr. Mark Fowler can furnish you with this information. The information we have is the waste water that is coming from the Concord Mills Mall has taken up all the capacity in a line that terminates at a lift station at Lowe's Motor Speedway and there is no room for us until a new line is finished from the life station onto the County waste Treatment Plant.1f we can be of further help in this matter,please advise.
